HomeMy WebLinkAbout1981-07-06July 6, 1981 Regular Meeting The PLANNING BOARD held a regular meeting on Monday evening, July 6, 1981 in the Town Office Meeting Room with the following members present and voting: Michael P. Roberts, Vice Chairman; Vincent S. Turano, Clerk; John J. Burke; and Erich W. Nitzsche. Highway Surveyor William Cyr was also present. CONTINUED PUBLIC HEARING - Amendments to Rules and Regulation~ Tabled PLANS NOT REQUIRING APPROVAL Steve Duly - Salem T~urnpike, Hillside Rd., Andover By-Pass George Pelletier from Gelinas Associates spoke. This plan is for the Fellowship Bible Church to change configurations to accomodate expansion. MOTION: by Mr. Turano that the plan of land located in North Andover, Mass. prepared for the Fellowship Bible Church dated May 22, 1981 be approved under Subdivision Control Law Not Required. SECOND: VOTE : by Mr. Burke Unanimous - motion carries Richard Jones - Grosvenor Avenue ;lOTION: by Mr. Turano that the plan of land located in North Andover, Mass. prepared for R. Jones dated June 26, 1981 be approved under Subdivision Control Law Not Required with the condition that the boOk and page numbers be placed on the plan, if required. SECOND: by ~r. Burke VOTE : Unanimous - motion carries Richard Jones - Bonny Lane MOTION: by ~r. Turano that the plan of land located in North Andover, Mass. prepared for B&R Construction, dated June 26, 1981 be approved under subdivision control law not required. SECOND: VOTE : by ;.ir. Burke Unanimous motion carries. July 6, 1981 -2- Regular Meeting OTHER BUSINESS Rocky Ridge Bond Release Member Turano abstained. MOTION: by Mr. Burke that the Planning Board release $5,775 per the recommendation of the Board of Public Works. SECOND: by Mr. Nitzsche VOTE : Unanimous - motion carries Willow Industrial Park Phases I and II Bond Release Letters from Vincent Grasso, the Highway Surveyor, and the Board of Public Works were read. MOTION: by ~r. Turano that the Planning Board release $7,000 per the Highway Surveyor's recommendation on Phase I and $16,000 per the Highway Surveyor's recommendation and $16,560 per the recommendation of the BPW on Phase II. SECOND: by Mr. Burke VOTE : Unanimous - motion carries, Abbott Meadows - sign plan No test pits have been done to date according to George Pelleteir. MOTION: by Mr. Turano that the plan be signed at the next Planning Board meeting after review by the Planning Board as to com- pliance with the order of conditions of approval which were issued by the Planning Board. SECOND: by Hr. Burke VOTE : Unanimous - motion carries. Lisa Lane Release of lots Mr. Douglas Wilson was present. He has not yet received a letter from ~r. Borgesi of the BPW stating that the BPW will return the street to its original condition. Mr. Cyr added that before he recommends adju- dication, he wants a commitment from the BPW. The Board will instruct the Town Planner to forward a letter to the BPW and discuss this item at their next meeting. Shar. pner's Pond Rd. - Form A Plan Mr. Rhys Kear was present and made the following points to the Board: July 6, 1981 ,3- Regular Meeting Sharpner's Pond Rd. - continued The Planning Board denied this plan. Mr. Kear has met with Paul Hedstrom and Town Counsel. There was some concern on the part of the Planning Board as to whether or not this is a subdivision. The purpose of the meeting with Mr. Hedstrom and Town Counsel was to identify the issues and submit an alternative proposal. He (Mr. Kear) is here to determine if the decision of the Board is accurate, and if it is, to determine what the alter- natives are. - There are 13 Form A lots, all having the area and frontage re- quirements. - The Chairman had some concerns over the driveways. - The petitioner has stated that he is willing to abide by reasonable recommendations of the Board He would restrict the development of the site to 13 lots. The applicant can provide conventional looking lots at the street so that they will appear to look like other Form A lots. He presented a plan that he (Kear) felt best suited the land. The alternative is to divide the~frontage to provide acre/acre+ on the street. A case on file, Nantuckett v.s. Gifford, and a letter from the Fire Chief were reviewed by the Board and placed on file, Member Turano reminded those present that i.t was the safety factor from multiple driveways that caused the disapproval. Mr. Kear argued that in his opinion, this is a valid Form A plan. Mr. Scott Follansbee, the applicant, added: The concern of the Board was the length of the driveways, and he doesn't think it should be the Planning Board's business. The person buying the house should bear this concern. There are many people who want this land cleaned up. This is an old gravel pit that needs to be developed. The main issue in the Nantuckett case was the narrow width of the lots. His plan shows them to be considerably larger. July 6, 19B1 -4- Regular Meeting Sharpner's Pond Rd. continued Mr. Cyr added that his objections are that the Board could be setting a precedent and causing confusion to the Fire and Police departments. However, having fewer driveways is better for his department. The Board will discuss this item at their next meeting. Continued Public Hearin9 - Amendments to Rules and R.egulations A discussion took place with Member Nitzsche making several sugges- tions, among them: - Page 1, No. 1, Par. 2 - add "State Environmental Code Title V or the most recent edition" Page 2, (g) - put full and proper names of abutters - (h) add "including the width of such street or way" - (i) ' insert "sufficient to establish all lines on the ground" - Page 2, No. 3 - insert 3 A (2) "the zone in which the proposed subdivision is located, including the FAA flood areas" Page 2 to 3 - 4 (e) - insert "The Board may require that the applicant or developer to mitigate the run off to 0% increase in the rate of run off" Page 9 in existing Rules and Regulations - change (m) "location of observation holes perc tests with results" Page 10 in existing Rules and Regulations (o) change by adding "location of all permanent monuments properly identified as to existing or proposed" Page 4 Permanent Benchmark - change USC & GS to NGS, Page 5 - Item C2 should be "evaluate" Page 7 - No. 9 - "Any deviation or request for changes on the final plans and/or profiles must be submitted in writing and approved by the Planning Board after first obtaining authori- zation from the proper agency having jurisdiction over such" Highway Surveyor voiced his objections to the many changes being proposed. He asked - "Who is going to enforce these? I can't: On the g ravel depth ~ you are creating problems for me and your- self". MOTION: by Mr. Nitzsche to continue the public hearing until July 20, 1981. SECOND: by ,~r. Burke VOTE ; Unanimous - motion carries.
