My company is serving as the project manager for Verizon Wireless'deployment of
small cell Cloud Radio Access Network in various parts of New England,including North
Andover. In connection with the special permit application and building permit applications
submitted by McLane Middleton,as attorney for Verizon Wireless,I am respectfully requesting
that you issue the above-referenced building permits prior to expiration of the appeal period for
the special permit issued on September 2016. The reason for this request is simply a
matter of timing. We are unable to order materials until the building permit has issued,and
would like to make that order as soon as possible. We would not begin any construction
activities prior to the expiration of the special permit appeal period. Thank you.

The Planning Board herein approves the Special Permit to attach disguised Cloud Radio Access
Network(C-RAN)antennae,a single 24.2"tall cylindrical canister weighing approximately
twenty two(22)pounds,and additional supporting equipment,consisting of a remote radio head,
electrical junction box and meter,and fiber optic connections,mounted to nine(9)existing utility
poles,owned by National Grid,at the locations set forth above.The Special Permit was requested
by Christopher Swiniarski,Attorney for Verizon Wireless.This application and additional
documentation as cited herein were filed with the Planning Board on July 14,2016.The
Applicant submitted a complete application which was noticed and reviewed in accordance with
Sections 8.9,10.3,and 10.3.1 of the Town of North Andover Zoning Bylaw and MGL c.40A,
Sec.9.
The Planning Board finds that the applicant has met the following requirements as required by the
North Andover Zoning Bylaw Section 8.9:
FINDINGS OF FACT:
1. The Applicant originally had submitted an application with ten(10)pole locations.The
pole location removed was 635 Chickering Road(SC31 MA).The antenna was proposed
to be a 65 degree sector antenna as opposed to the nine(9)omnidirectional antenna.
During the review process the pole location was withdrawn from the application because
the proposed antenna was a design concept and had not yet been manufactured.
2. The Applicant's Attorney,Chris Swiniarski,provided testimony that there is an existing
substantial gap in coverage in the vicinity of the proposed installation and that the facility
is necessary in order to substantially close the gap in coverage
3. The Town's Wireless Review consultant has reviewed the application and has found that
the proposed installation of nine(9)utility pole mounted facilities in the public ways is
consistent with the overall principles and preferences under the zoning bylaw. (Please
see Consultant Review Memo from David Maxson with Isotrope dated August 13,2016).
4. Per the Town's Wheless Review Consultant findings, the Applicant has provided
theoretical RF field calculations,from a certified Radiation Safety Specialist,data for the
seven(7)sites that fall below the height exemption to indicate the summation of the
proposed Verizon Wireless RF contributions.The expert concluded that the proposed
facilities are designed to be fully in compliance with FCC requirements for human
exposure to radio frequency energy by a wide margin.(See correspondence from Donald '
L.Haes,Jr.PH.D.,CHP dated August 8,2016 and Consultant Review Memo from David
Maxson with Isotrope dated August 13,2016).
5. The Telecommunications Act of 1996 prohibits this Board from taking health effects of
RF transmissions into account beyond FCC requirements.
6. The Applicant has provided evidence that they have a legal right to install the wireless
facility as proposed.(See correspondence from National Grid from Amy Sullivan dated
October 20,2015).

7. Adequate and appropriate facilities will be provided for the proper operation of the
proposed use. The proposed antennas cables and equipment are described in detail on the
plans and reports referenced herein.
8. The Building Commissioner has determined that the"antenna"is so placed on an existing
structure and that the existing structure is a non-conforming structure and therefore
wireless facilities and their equipment do not increase their non-conformity.Therefore,
the Applicant does not need to petition the North Andover Zoning Board of Appeals for a
variance under Section 8.9.3(c)(v)(1).(See determination letter dated August 19,2016).
The application meets all of the filing requirements of the Wireless Service Facilities By-law
Section 8.9,with the exception of the waivers granted listed below:
Waivers
The installation will be constructed according to the Plans, with the following waivers
granted by the Town of North Andover Planning Board,according to the provisions of the
Town of North Andover Zoning Bylaw.These waivers are hereby granted in consideration of j
the installation as a pre-existent installation and a co-location:
8.3(2)(iv) The construction of any new wireless service facility on a previously
permitted facility as set forth in Section 8.9(3)(a)(ii)Wireless Service Facilities Use
Regulations(1998138).The proposed facilities that are referenced in the Application will
not be constructed on a previously permitted facility.

8.9(5)(a) Pre-Application Conference. Applicant met with the Board in December
relative to the same type of application and the installation of C-RAN technology at other
locations throughout the Town.

&9(5)(d)(ii)(4)A map showing the other preexistent and approved wireless service
facilities in North Andover and outside North Andover within one mile of its
boundary.Applicant may be aware of other carriers but is not in a position to provide a
multicarrier inventory.

8.9(5)(d)(iii)Siting Filing Requirements.A one4neh-equals-40 feet plan prepared by
a Registered Professional Engineer in the Commonwealth of Massachusetts showing

(1)Property lines for the subject property.Existing utility poles are on the
public way.
(2)Property lines of all properties within 300 feet of the proposed location. #

(3)Tree cover on the subject property and all properties directly abutting
the subject property, by dominant species and average height. This is
impracticable on the public way.
(4) Outline of all existing buildings, including purpose (e.g. residential
buildings,garages,Accessory structures,etc.)on subject property and all
properties adjacent to the subject property.The level of detail provided in the

site documents is sufficient to see the locations in context with nearby buildings
and uses.
(5) Proposed location of antenna, mount and equipment shelter(s). All
equipment will be attached to existing utility poles.
(6)Proposed security barrier,indicating type and extent as well as point of
controlled entry.No security barriers are necessary.
(7)Location of all roads,public and private,on the subject property and art
all adjacent properties within 300 feet including driveways proposed to serve
the wireless service facility. Site plans submitted are sufficient for the
application.
(8)Distances,at grade,from the proposed wireless service facility to each
building on the vicinity plan. Site plans submitted are sufficient for the
application.
(9)Contours at each 2 feet AMSL for the subject property and adjacent
properties within 300 feet. Site plans submitted are sufficient for the
application.
(10)Ali proposed changes to the preexistent property,including grading,
vegetation removal and temporary or permanent roads and driveways.No
changes are proposed.
(11) Representations, dimensioned and to scale, of the proposed mount,
antennas, equipment shelters, cable runs, parking areas and any other
construction or development attendant to the wireless service facility.No
changes are proposed.
(12)Lines representing the sight line showing viewpoint(point from which
view is taken) and visible point(point being viewed) from 'Sight Lines"
subsection below.Site plans submitted are sufficient for the application.
(13)Location of all wetlands on the subject property and within 100'of the
proposed facility as approved by the Conservation Commission.No ground
disturbance is proposed.

(2)In order to determine compliance with applicable FCC regulations,the
applicant shall provide a statement listing the preexistent and maximum
future projected measurements of RFR from the proposed wireless service
facility,including all co-locators,for the following situations:
(a)Preexistent or ambient:the measurement of preexistent RFR.No
wireless facilities exist at each location.
(b)Preexistent plus proposed wireless service facilities: maximum
estimate of RFR from the proposed wireless service facility plus the
preexistent RFR environment. Most proposed installations employ
more than one frequency and/or are above the height cutoff for ;
exemption from routine evaluation.(Table 1,47 CFR 1.1307).Sites SC ?

22 and CRAN 10 enjoy the FCC Table I exemption and are inherently
compliant.The remainder require routine evaluation.
The Applicant provided an evaluation provided by an independent expert
with substantial experience in the field.The Wireless Review Consultant
concurs with the expert's conclusion that all the proposed facilities are
designed to be fully compliant with FCC limits on human exposure to
their emissions;see Consultant Review Memo from David Masson with
lsotrope dated August 13,2016.
(e) Certification, signed by an engineer, stating that RFR
measurements are accurate and meet FCC Guidelines as specified in
the Radiofrequency Radiation Standards subsection of this Bylaw.
Most proposed installations employ more than one frequency and/or are
above the height cutoff for exemption from routine evaluation.(Table 1,
47 CFR 1.1307).Sites SC 22 and CRAN 10 enjoy the FCC Table I
exemption and are inherently compliant.The remainder require routine
evaluation.
The Applicant provided an evaluation provided by an independent expert
with substantial experience in the field.The Wireless Review Consultant
concurs with the expert's conclusion that all the proposed facilities are II
designed to be fully compliant with FCC limits on human exposure to
their emissions;see Consultant Review Memo from David Maxson with
Isotrope dated August 13,2016.
(3) Applicant must submit a copy of the letter from the Massachusetts
Department of Public Health approving the site for this facility as required by
105 CMR 122.000 requires that the Department of Public Health approve all
sites for wireless facilities with respect to emissions.
The Massachusetts Department of Public Health no longer requires notifications
and approvals under 105 CMR 122.000.(See memorandum dated March 15,2002)
89(5)(d)(viii)Federal Environmental Filing Requirements No hazardous materials
are proposed.
Finally the Planning Board finds that this project generally complies with the Town of North
Andover Zoning Bylaw requirements as listed in Section 8.9 but requires conditions in order to be
fully in compliance. The Planning Board hereby grants an approval to the applicant provided the
following conditions are met:
SPECIAL CONDITIONS:
I) The additional supporting equipment,the conduit and electrical junction box,shall be painted
to match the color of the utility pole they are mounted on.

2) Verizon or its contactors will notify the Planning Department and the property owners
abutting each pole two(2)days prior to beginning installation, 1
3) Discontinuance Abandonment
a) At such time that a licensed carrier plans to abandon or discontinue operation of wireless

service equipment,such carrier will notify the Town by certified US mail of the proposed
date of abandonment or discontinuation of operations.Such notice shall be given no less
than 30 days prior to abandonment or discontinuation of operations.In the event that a
licensed carrier fails to give such notice, the wireless service equipment shall be
considered abandoned upon discontinuation of operations.
b) Upon abandonment or discontinuation of use,the carrier shall physically remove the
wireless set-vice equipment placed on the site by the carrier within 90 days from the date
of abandonment or discontinuation of use. "Physically remove" shall include,but not be
limited to:
i) Removal of antennas,mount,equipment shelters and security barriers installed by the
carrier(unless the same will continue to be used by the owner)from the subject
property.
ii) Proper disposal of the waste materials generated by the carrier from the site in
accordance with local and state solid waste disposal regulations.
iii) Restoring the location of the wireless service facility in its condition before the j
installation,except that any landscaping and grading shall remain the after-condition.
c) The equipment shall be deemed to be abandoned or discontinued if it has not been used
for the purpose for which it was originally constructed for a period of six(6)months or
more.Once abandonment or discontinuance has occurred,the carrier shall remove the
equipment from the subject property within ninety days.
4) After the equipment on the facility is in operation,the Applicant shall submit to the SPGA,
within 90 days of beginning operations and at annual intervals from the date of issuance of
the Special Permit,current RFR measurements. Such measurements shall be signed and
certified by an RF engineer, stating that RFR measurements are accurate and are in
compliance or why the measurements fail to comply with all applicable FCC Guidelines as
specified in Section 8.9(5)(d)(vii)RFR Filing Requirements of this Bylaw.
5) The Applicant or their successor in interest shall maintain the wireless service equipment in
good condition. Such maintenance shall include,but shall not be limited to, structural
integrity of the antennas.

6) Annual Certification
Annual certification demonstrating continuing compliance with the standards of the Federal
Communications Commission,Federal Aviation Administration and the American National
Standards Institute,if required by those agencies,shall be filed with the SPGA by the Special

Permit holder.
a
7) Prior to Issuance of a Building Permit:
I
a) Two(2)recorded copies of the signed,recorded decision and the recorded plans must be i
delivered to the Planning Department.
b) A bond in the amount of five thousand dollars($5,000)shall be posted for the purpose [
of insuring that a final as-built plan showing the location of all on-site structures. The
bond is also in place to insure that the site is constructed in accordance with the approved

plan. This bond shall be in the form of a check made out to the Town of North Andover.
This check will then be deposited into an interest hearing escrow account.
c) A construction schedule shall be submitted to the Planning Staff for the purpose of
tracking the construction.
8) Prior to the final release of security a final as-built plan showing final construction and
location of the wireless hardware shall be submitted to and reviewed by the Planning Staff.
The Applicant must submit a letter from the architect or engineer of the project stating that
the construction and operations substantially comply with the plans referenced at the end of
this decision as endorsed by the Planning Board.
9) The provisions of this conditional approval shall apply to and be binding upon the applicant,
its employees and all successors and assigns in interest or control.
10)Any revisions shall be submitted to the Town Planner for review.If these revisions are
deemed substantial,the applicant must submit revised plans to the Planning Board for
approval.
11)This Special Permit approval shall be deemed to have lapsed after three years from the date
permit granted unless substantial use or construction has commenced. Substantial use or
construction will be determined by the Town Planner. j
