HomeMy WebLinkAboutDecision - 0 GREAT POND ROAD 12/6/2016 (2) ,: ,�: raw Town of North Andover 1 Office of the Planning Department Community Development and Services Division 120 Maui Street .� North Andover,Massachusetts 01845 NOTICE OF DECISION Watershed Special Permit—Waiver Date of Decision:December 6,2016 Application oh Town of North Andover 384 Osgood Street North Andover,MA 01845 Premises Affected: 0 Great Pond Road/North Pump Station,North Andover,MA 01845 540 Pleasant Street(Hatch),North Andover,MA 01845 508 Pleasant Street,North Andover,MA 01845 Map 35&37 Parcels 21, 50,9 BACKGROUND On November 14, 2016, John Borgesi, Town Engineer and Bruce Thibodeau, Director Department of Public Works,requested a Waiver of the Watershed.Protection District Special Permit, in accordance with the North Andover Zoning Bylaw section 4.136.8, for the purpose of installing boat storage racks and providing parking and access along Lake Cochichewick within the Non-Disturbance Buffer Zone of the Watershed Protection District. The proposed activities are being proposed to enhance and preserve the Lake area by reducing erosion of the shoreline,while continuing to allow the public access to the Lake. FINDINGS OF FACT According to the North Andover Bylaw Section 4.136(8)(1),when any construction proposed on an existing structure within the Watershed Protection District will not expand the existing footprint of a structure,and will not disturb existing topography,and is a proposal on town sewer,the Planning Board may determine,without a public hearing,that submission of a watershed protection district special permit is not required. The area located along Pleasant Street has been historically used as a boat launch and boat storage area, I where numerous boats have been left abandoned and have not been used in years. These abandoned boats are located along the shoreline and embankment within the watershed,Tine boats create an impervious f surface where during rain events excessive runoff is directed towards the Lake creating a severe erosion problem along the shoreline and embankment of the Lake.To remedy the erosion issues and improve boat storage conditions and public access to the Lake the following activities are being proposed. • Designate two(2)specific boat storage and vehicle parking areas on the Lake(Old North Pump i Station and "Hatch"area); • Designate three(3)specific boat launch locations-one along Pleasant Street for walk-in walk-out boat launching and No boat storage,a second boat launch area at the Old Notch Pump Station, } and a third boat launch at the"Hatch" area near Stevens Pond;and f • Widen the shoulder along Pleasant Street to allow for some on-street parking. f J Currently parking is provided at the Old North Pump Station located on Great Pond road for boat access to the Lake.The existing building is scheduled to be demolished and the area grassed/graveled to provide a Boat Launch&Parking Upgrades Town of North Andover Watershed Special Permit- Waiver Page 2 of 2 an area for boat storage where boat racks will be provided for the public and an area to park your vehicle on the Lake. On June 7,2016 the Planning Board issued a Watershed Special Permit Waiver for the proposed demolition work at the North Pump Station.An Order of Conditions was issued by the Conservation Commission for the project. Since all of this work will be done after the demolition project,no clearing will be necessary. Additionally,no permanent structures are being built and the proposed boat racks will be constructed on skids and are temporary structures. In addition to the OId North Pump Station,an area located by the "Hatch"is proposed to have minimal clearing of low growing shrub brush to provide an area for approximately 6 boat storage racks.No additional surface treatment will be added in this area and after removal of the low growing shrub brush the area will be left in its natural state. Along Pleasant Street there are two areas along the Lake shoreline that are being used for boat storage and boat launch/walk in traffic.The proposed activities for each of these areas will include the following: I. The southern boat storage area will be eliminated and the abandoned boats in this area will all be removed. Furthermore additional large size boulders will be placed to deter future boats being ,placed/stored in this area. 2. The northern boat launch area will be enhanced to allow for five(S)on-street parking spaces along Pleasant Street.The existing shoulder will be expanded by performing minimal clearing, relocating existing boulders along the edge of the shoulder,and filling the area with minimal pervious sand/gravel fill.In addition,the walking path to the lake will be enhanced with the installation of wide spread timber steps.These steps will not only encourage the walk in/walk out use for boat launching but will also reduce erosion by reducing the stormwater runoff velocity. The proposed project will reduce the existing surface runoff at the Pleasant Street location.The newly proposed timber steps will be placed along the existing walking path slope to the Lake and will reduce the velocity of runoff.By reducing the velocity the steps will increase the amount of runoff allowed to infiltrate thereby reducing the runoff in this area.There will be no sub-surface discharges. 1 DECISION After discussion at the December 6,2016 Planning Board meeting, and upon a motion by David Kellogg seconded by Lora McSherry,the Planning Board Approves the Watershed Special Permit-Wavier with conditions,A vote of 4-0 was made in Favor of the waiver request(P. Boynton recused himself). CONDITIONS • The Staff planner will conduct a minimum of two site inspections during the construction. • Work done on the site will follow the highest standard of best practices appropriate for close i proximity to a highly sensitive area immediately adjacent to the water supply. • The Town Planner will have the authority to stop construction if it is determined that proper erosion control is not in place. rri�(/v�I I.Aean Enright, Tanning Director j e
