McDonough; Douglas W. Saal; Albert P. Manzi, Jr. (arrived at 8:40 PM) Member Absent: Joseph W. Lynch, Jr., Deborah A. Feltovic. Staff Members Present: Jennifer A. Hughes, Conservation Administrator; Heidi M. Gaffney, Conservation Field Inspector; Donna M. Wedge, Conservation Secretary. Pledge of Allegiance Meeting came to Order at: 7:35PM Quorum Present. General Business A motion to accept the minutes of October 26, 2011 is made by Mr. Mabon, seconded by Mr. . McDonough Vote unanimous. 242-1402, COC Request, 45 Hollow Tree Lane (Feeney) (Merrimack Engineering Services, Inc.) The field inspector reviews the project and states that the walkway was approved as an administrative modification and that the erosion controls have been removed. The commission briefly discusses the size of the deck and the portion of the deck removed. A motion to issue the COC and release the bond is made by Mr. Mabon, seconded by Mr. Saal. Vote unanimous. Documents: Letter from Merrimack Engineering Services Inc. dated 11/16/11 o WPA Form 8A-Request for Certificate of Compliance dated 11/16/11 o As-Built Site Plan of Land dated 9/27/2011 o Photos dated 12/20/11 & 12/21/11 o Small Project NACC#90, 186 Bradford Street (Ghikas) Mr. Ghikas was present. The administrator reviews the project and states that it is to replace the front stairs with two decks and new stairs. The work is in the front of the home and is approximately 70-feet from the Bordering Vegetated Wetland. The wetlands are to the rear and side of the home. There is a pile of discarded shrubs that should be removed. - disturb zone, however the town line is directly behind the house and the markers would then be in Boxford. A motion to accept this as a Small Project 4.4.2.A with a post-construction meeting and the removal of the discarded shrubs is made by Mr. McDonough, seconded by Mr. Mabon. Vote unanimous. Document: Application Checklist-Small Project o Letter from the Applicant David Ghikas dated 12/14/11 o Conceptual Drawing dated 12/14/11 o Property Plot Plan dated 12/14/11 o Photos dated 12/14/11 o Public Hearings: 8:15 PM Notice of Intent (NOI) 242-1531, 315 Turnpike Street (Merrimack College) (VHB) (cont. from 12/7/11) (Request to cont. to 1/25/12) The administrator states that Merrimack College is meeting with the Andover Conservation Commission on 1/11/12 and therefore requests a continuance to the 1/25/12 meeting. A motion to grant the request for a continuance to the January 25, 2012 meeting is made by Mr. McDonough, seconded by Mr. Mabon. Vote unanimous. 242-1533, 16 Berry Street (Fiore) (Goldsmith, Prest & Ringwall, Inc.) (cont. from 12/7/11) Mathew Bombaci of Goldsmith, Prest & Ringwall, Inc. is present. The administrator states that all final changes have been made to the plans. Plan changes including proposed post and rail fence barr-Disturb Zone are presented. Mr. Bombaci discusses the project and reviews the changes that have been made. The commission discusses the stormwater issues and the road ROW width as well as potential issues associated with future town acceptance of the roadway. Mr. Mabon states that a permanent barrier should be 2-foot x 2-foot stone wall with some plantings of shrubs for the No-Disturb Zone. Mr. Bombaci states that there is a planting plan and that the request is to allow the applicant to do the plantings and a post and rail fence instead of the usually required stone wall. The commission discusses the limits of clearing proposed under this NOI. The commission discusses the impervious areas and how the calculations have been done. Mr. Bombaci states that the roadway has been shorten in size the drainage has been accepted by Eugene Willis Town Engineer and there would be a Homeowners Association created to take care of the rain gardens. The administrator states that this may be changed in the Planning Board decision. Mr. McDonough states that a stone wall is usually required and is preferred as a permanent barrier at the No-Disturb Zones. Mr. Napoli states that a stone wall is usually required. Mr. Saal discusses having the entire pond surrounded by a stone wall at the No-Disturb Zone. The commission discusses the site and the No-Disturb Zones and how to best protect and mark these important areas permanently. The commission agrees on placing a stone wall around the pond where it is part of this project and requests that in the area of the pond that is not included in this NOI a post and rail fence or pressure treated posts be installed with -grow naturally. The NACC discusses the Vernal Pool No-Disturb Zone (NDZ) and agrees markers will be A motion to close the public hearing and issue a decision within 21 days is made by Mr. McDonough, seconded by Mr. Mabon. (cont. from 11/16/11) The administrator states that John Morin has a conflict tonight and the applicant requests to continue to 1/11/12. A motion to grant the request for a continuance to the January 11, 2012 meeting is made by Mr. Mabon, seconded by Mr. McDonough. Vote unanimous. Documents: Letter dated 12/20/11 from The Neve-Morin Group, Inc. requesting a continuance to o 1/11/12. Decision 242-1533, 16 Berry Street The administrator reviews the drafted Order of Conditions. the bond amount is to be set at $40,000, the stone wall required around the pond, as well as snow A motion issue the Order of Conditions as-drafted and amended is made by Mr. Mabon, seconded by Mr. Manzi. Vote unanimous. Discussion Erosion control monitor for Boston Hill The commission reviews the resume of the proposed monitor and agrees he is qualified to serve as erosion control monitor for the site A motion to adjourn the meeting at: 9:00 PM made by Mr. Manzi, seconded by Mr. McDonough. - Vote unanimous.
