Conservation Commission Meeting Minutes

Meeting came to Order at: 7:35 PMQuorum Present.
General Business
A motion to grant the approval of minutes of 11/2/11 & 11/16/11 made by Mr. Manzi,
Seconded by Ms. Feltovic.

The applicant Tyler Munroe of 100 Foster Street and John Barrows of Marchionda &
Associates, L. P. arepresent.
The field inspector statesthatthisOrder of Conditions was for the construction of a large
garage and pavedparking lot. The Building, parking area and stormwater structures are in
substantial compliance with the proposed plan. There are some minor deviations but
nothingiscloser to the wetlands. The driveway is slightly wider at the entrance from
Osgood Street and then curves farther away from the wetlands than proposed. A proposed
stockade fence was not constructed. The catch basins have been cleaned. There is an area
of pavement to the southeast of the existing house that was proposed to be removed on
the original Notice of Intent, but was not removed. The area serves as parking for the
house and is outside of the 100-foot Buffer Zone. Overall the impervious is slightly less
than proposed 15,707 proposed built 15,496 on the as-built plan.
Mr. McDonough asks if the stockade fence was required in the Order.
The field inspector statesthatnothing in the Order of Conditions states thatthe fencewas
a requirement.
A motion to grant to issue the COC and release the bondismade by Mr. Manzi, seconded
by Ms. Feltovic.

The applicant Susan Rogers ispresent.
The field inspector states that a modification was issued previouslyfor the boulder
retaining wall. The fenced area was reduced is now just around the pool. The deck with
stairs andplatform that was proposed in the location of the current patio was not
constructed.Wetland markers are in place and erosion controls have been removed.
A motion to issue the COC and release the bond ismade by Mr. Manzi, seconded by Mr.
McDonough.

The field inspector statesthatthe applicant wishes to split another 7 unit building into a
4-unit and a 3-unit building. Thisonly alters the location of lawn. No other impervious
area or structures would beimpacted and no building is closer to the resource area than
previously proposed.

The administrator states that the plan updates show the stone wall detail. A letter stating
why soil testing was not done on the slope is in your packets. The soil data was in the
original filing and confirms what is stated in the letter.
Mr. Saal states that the wall detail should show it beingtoed into the ground at least one
foot.
A motion to close the public hearing and issue a decision within 21 daysismade by Mr.
McDonough, seconded by Ms. Feltovic.

Mr. Manzi recussed himselffromthe meeting.
The administrator states that the additional filing feehas beenreceived by the town. DEP
needs additional fee alsoandthis has been mailed in andthe applicant is requesting a
continuance to February 8, 2012 meeting.

Jeffrey Koetteritz of VHB, Inc. was present.
The administrator states that materials from VHB have been received.She discusses the
comments received from Eggleston Environmental. Shediscusses the outlet pipe near
the football field which is in jurisdiction. Merrimack College is meeting in Andover
tonight also with the Andover Conservation Commission.
Mr. Koetteritz states there was master plan done in 1999 and submitted to theAndover
Conservation Commission.
Mr. Koetteritz discusses the changes that have been made including the rain gardens,
changes to some of the catch basin connections and discusses revisions to the planting
plan.
The administrator states that they would like to see the day lilies replaced with something
better.
Mr. Kotteritz hands out planting plan copies to the commission members.
The commission discusses the As-built certification for the drainage.
Mr. McDonough asks about parking.
The commission discusses the pipe outlet and the discharge within the 25’ No-disturb
zone.
Mr. Kotteritz hands out photos and an aerial printout and discusses increasing the size of
the pipe and re-doing the outlet. They will move the outlet back as much as possible and
will increase the outlet apron.
The administrator states that planting in this area should be discussed.
Mr. Manzi asks about the date the pipe was installed. Discussion concludes that the
install date is unknown.
Mr. Kotteritz asks for a continuance.
