Conservation Commission Meeting Minutes
October 8, 2014
Members Present:
Louis A. Napoli, Chairman, Douglas W. Saal, Vice Chairman,
John T. Mabon (arrived at 7:30 p.m.), Joseph W. Lynch, Jr., Deborah A. Feltovic.

Meeting came to Order at: 7:02PM Quorum Present.
Approval of Minutes of 7/23/14 & 8/13/14
A motion to accept the meeting minutes of 7/23/14 and 8/13/14 as drafted and reviewed
is made by Ms. Feltovic, seconded by Mr. Saal.
Vote unanimous.

Small Project
NACC#134, 116 Bridges Lane (Magliochetti)
The applicant Maria D. Magliochetti of 116 Bridges Lane is present.
Administrator reviews the proposal to replace the retaining wall, stairs and walkway in
kind.
A motion to accept this as small project 4.4.2.J is made by Mr. Lynch, seconded by Mr.
Saal.
Vote unanimous.
A motion to approve the project as proposed with conditions for pre and post construction
inspection is made by Mr. Lynch, seconded by Ms. Feltovic.
Vote unanimous.

Michael Livingston of Black Dog Builders, Inc. is present.
Ms. Feltovic read legal notice.
Mr. Livingston presents the project to install a foundation wall under the font of the
garage.
Mr. Lynch asks if this will be a full frost wall.
Mr. Livingston states yes it will.
Mr. Saal asks about the foundation on the rest of the building.
Mr. Livingston states there is a foundation under the rest of the building.
Mr. Lynch asks what will be done with surplus materials.
Mr. Livingston states they will be removed from the site, not stockpiled.
The commission discusses proximity to wetlands and need for erosion control which can
be moved closer to the garage nightly to allow driveway access.
Mr. Lynch states there should be no concrete washout near wetlands.
A motion to issue a negative determination #3 with conditions for pre and post
construction inspections, installation of wetland markers and erosion control is made by
Ms. Feltovic, seconded by Mr. Saal.
Vote unanimous.

Ms. Feltovic reads the legal notice.
The Administrator informs the Commission that stormwater review from Eggleston
Environmental was just received.
Mr. Zahoruiko presents alternatives considered during the design of this 5-lot
subdivision. A PRD would have been considered but the minimum lot size is 10 acres. A
wetland crossing is proposed.
Mr. Napoli inquires about waivers.
Mr. Lynch states the alternatives analysis is thorough and asks where utilities to the back
lot will be run.
Mr. Zahoruiko states they will be trenched. The sewer will be gravity and through a
sleeve in the ground.
Mr. Zahoruiko submitted a revised plan that shows the limits of BVW at the bridge
crossing.
Mr. Lynch asks about the bridge construction.
Mr. Zahoruiko reviews precast bridge and discusses alternatives considered.

Mr. Lynch states all appurtenances to the homes should be shown to avoid the need for
modifications.
The Administrator asks if the commission will wa-disturb

Commission agrees.
A motion to grant the request for a continuance to October 22, 2014 meeting is made by
Mr. Lynch, seconded by Ms. Feltovic.

Mr. Mabon reads the legal notice.
The Administrator distributes photos of the site and states there has been mowing within
the 25-foot No-Disturbance Zone.
Ms. Hanley presents the proposal to replace a failed septic system including the
distribution box and leach field. She states the project is exempt from NHESP review.
Mr. Lynch asks if the Board of Health granted a waiver.
Ms. Hanley states yes if the Commission in agreement.
The old system will be abandoned in place.
Ms. Hanley states the septic system is about 93-feet way for the resource areas on the
site.
The Commission discusses access on to the work area. Will be from adjacent lot.
Mr. Napoli states mowing of the No-Disturb Zone must stop.
Mr. Mabon asks if test pits were done on the site.
Administrator states yes test pits were done on the site.
A motion to close and issue a decision within 21 days is made by Mr. Lynch, seconded
by Mr. Mabon.
Vote unanimous.

Mr. Mabon read the legal notice.
Mr. Manuell states he confirmed the wetland delineation in the field with the
Administrator. He states the projects meet the setbacks and at the Administrators request
will put propane tank, generator, AC pad, etc. on the plan. Mr. Manuell also states that
the owner is working with the abutter to preserve the existing stone wall and treeline.
Mr. Manuell reviews the alternatives analysis and compliance with the Riverfront
regulations.
Mr. Mabon asks if the house will be on sewer.
Mr. Manuell states it will.
Mr. Mabon asks about the limit of clearing.
Mr. Manuell states a stone wall will mark the limit of clearing.
Mr. Napoli asks if the house can be moved away from the No-Build line.
Mr. Manuell states that if he can move it within the front yard setback and preserve the
stone wall he will.
Valerie A. Kozras of 59 Summer Street states she would like to keep her family farm
intact and buy back a piece of the field and stone wall now owned by Mr. Herrick.
The commission discusses lot line changes.
A motion to grant the request for a continuance to October 22, 2014 meeting is made by
Ms. Feltovic, seconded by Mr. Lynch.

Rishabh Shah & Ashish D. Shah of 1499 Salem Street are present.
Administrator states she and Mr. Mabon walked the site prior to the meeting and have a
few trail relocation suggestions for Mr. Shah.
Mr. Shah states he intends to build a trail to connect open space properties off of
stream/wetland area. He will only remove enough vegetation to allow passage. He will
leave cut brush on the side of the trail.
Mr. Mabon states Mr. Shah should use trail markers to guide public through the area.
Mr. Lynch asks if there is any concern about the height of the water and the boardwalk.
Mr. Mabon states the area is flat but it might be good to chain the ramps. The area is very
thick and there will be a lot of labor involved. The trail will need to be marked to connect
to Harold Parker under the utility lines.
Mr. Shah states he learned about trail construction and environmental impact.
Mr. Napoli asks about parking.
The Administrator states this will be more of a neighborhood trail.
Ms. Feltovic asks about the timeline.
Mr. Shah likely one to two weeks.
Mr. Mabon asks that Mr. Shah be in touch with him before starting the project.
Mr. Lynch states contact should be made with National Grid about crossing the Lincoln
Lab line.
A motion to issue a friendly Enforcement Order to allow work to occur in the Open
Space Area is made by Mr. Lynch, seconded by Ms. Feltovic.
Vote unanimous.

Administrator states the commission previously reviewed the easement documents but a
vote and signatures are now needed.
A motion to accept the new easement as presented is made by Ms. Feltovic, seconded by
Mr. Lynch.

The applicant Thomas Patenaude of 100 Salem Street is present.
Administrator reviews the deviations found between the proposed and as-built plans
including removal of the proposed driveway swales.
Mr. Patenaude states he changed the driveway drainage after speaking with the town
engineer.
Mr. Lynch worries that the driveway swales will be taken out by homeowners in future.
The Commission agrees the infiltrators need to be shown on the plan.
Ms. Feltovic states that the Commission needs the Operation and Maintenance
certification.
Mr. Lynch states the elevation of the one inch difference check with Eggleston
Environmental to make sure the stormwater management plan the O & M Plan is
working.
Mr. Patenaude states driveway stormwater is running into roadside swale and is working
well. He will need to get as-built information for the infiltrators and certification
information for catch basin cleaning.
