Conservation Commission Meeting Minutes
March 12, 2014

Meeting came to Order at: 7:04 PM Quorum Present.
Approval of Minutes of 1/8/14, 1/22/14, & 2/12/14
A motion to accept the meeting minutes of 1/8/14, 1/22/14, and 2/12/14 as drafted and
reviewed is made by Mr. McDonough, seconded by Mr. Mabon.
Vote unanimous.

Request for Determination of Applicability
172 Sutton Street (Facilities Department, Town of North Andover)
Mr. Saal reads the legal notice.
Stephen E. Foster of Town of North Andover Facilities Department presents the project
for drainage improvements including minor grading, drip trenches and gutter work.
Mr. Napoli states he visited the site and saw that the sills are rotting because water is
hitting off the ground. Supports work to stop the rotting.
Mr. Foster states erosion control is proposed.
Mr. Mabon states work would occur on 3 sides of the building and would stay away from
brook.
Mr. Foster states there are no point source discharges. Looking to infiltrate.
Mr. Mabon asks about slope of regrading.
Mr. Foster states it would drain toward train tracks.
Mr. McDonough asks if any waivers are needed. Answer: none.
A motion to issue a negative determination is made by Mr. Mabon, seconded by Mr.
McDonough.
Vote unanimous.

Notice of Intent (NOI)

The applicant Eric Loft of North Andover Holdings, LLC, Ann Marton of LEC
Environmental Consultants, Inc., Theodore C. Regnante of Regnante, Sterio & Osborne,
LLP, Matthew Bombaci of Goldsmith, Prest & Ringwall, Inc. are present.
Administrator states the Zoning Board of Appeals approved a decision last night.
Ms. Marton states changes were made to the CR as requested by NHESP including a
change to the mowing schedule.
Mr. Mabon asked about the path surface.
Ms. Marton states a pervious rubber playground material would be used.
A motion to close the public hearing and issue a positive order of conditions within 21
days is made by Mr. McDonough, seconded by Mr. Saal.

Administrator states the applicant is requesting a continuance to March 26, 2014 meeting.
Joseph Peznola of Hancock Associates reviewed the porous pavement driveways. Some
were not functioning as intended. He recommends reviewing them after ground is
thawed.
A motion to grant the request for a continuance to March 26, 2014 meeting is made by
Mr. McDonough, seconded by Mr. Mabon.
Vote unanimous.

By-law Regulations, Fees and Checklist Revisions
Administrator reviews the proposed regulation changes: a fee change for delineation
review on NOI and RDAs where the resource areas are The
would be included in the NOI/RDA filing fees; changes to the submittal requirements;
and stormwater regulation changes.
The commission discusses the fee changes and agrees not many filers will be affected.
The commission thinks the submittal requirements should be tested before final approval.

Mr. Mabon states with stormwater management should be reviewed by Mr. Lynch.
A motion to continue bylaw regulation to April 9, 2014 meeting is made by Mr.
McDonough, seconded by Mr. Saal.
