HomeMy WebLinkAbout1977-01-31January 31, 1977 - Monday Regular Meeting The PLANNING BOARD held a regular monthly meeting (replacement of first Feb. meeting) on Monday evening, January 31, 1977 at 7:30 P.M. in the Town Office Meeting Room~ 'The following members were present and voting: Fritz Ostherr, Chairm~_~; William Chepulis, Vice-Chairman; William N. Salemme, Clerk; Paul R. L~mprey and John J. Nonteiro. PLANS NOT REQUIRING APPROVAL: 1. NORTtIANDOVERASSOC. - SawMill Rd.: ~k~ank Gelinas addressed the BOARD by stating that someone in Boxford has purchased a 5 acre parcel and want to build very close to the N.A./Boxford line and have negotiated with N. A. Assoc. (lot 41A) to buy 1 acre. Plan dated Jan. 17, 1977. The drivewa~will come in from a road in B°xford. We are still holding covenants on these lots and the purchase is subject to these covenants. A motion was made by Mr. Chepulis to endorse the revised plan of land owned by North Andover Assoc. dated Jan. 17, 1977 as not requiring approvallunder subdivision control law. Mr. Salemme seconded and the vote was unanimous by Messer~ Salemme, Ostherr, Lamprey and Chepulis. Mr. Monteiro was out of the room at the time. 2. BARCO CORP. - Boxford St.: plan dated Jan. 31, 1976; plan had come before the BOARD at a previous time but it h~d 4 lots with remaining backland and no meets and bounds. Presently, the attempt is to take the entire land and breakup into 4 different parcels - lots lb, 2B, 3B and 4B; located on same side as gravel pit just beyond Marry Thomas'. Mr. Lamprey m~de a motion to endorse the plan as mot requiring approval under subdivision control law prepared for Barco, dated Jan. 31, 1976. Mr. Salemme seconded and the vote was unanimous. JOHN CO, EAU -Reques~ for waiver of undergroundu~ilities - NOLLOWTREELAN~: Atty. Helen Comeau represented the developer, Mr. Cemeau.~ She had talked with Jack Burke from the telephone company and it was suggested that a telephone pole be put up. A sketch of the area was presented showing telephone pole location. Weather conditions are bad. Mr. Monteiro felt that they might be able to run a temporary line in th&re and doubted statements m~de by the utility company. Charles Foster stated that one of the dangers cf a temporary line is that if it got idiscounected it would freeze up and would have to go so far with the cord there would be an energy drop. John Comeau stated that the builder would like to have heat, the situation is unfortunate, it is a cost fmotor. They requested a perma__,en~ installation in lieu of underground.i~ Mr. Chepulis commented that he did not feel that the BOARD should deviate from its ~les & Reg~bec~use a pre- cedent would be set for all subdivisions. There was one exception made 4 years ago, Barman Drive. Atty. Comeau reported that it would be mid-March or first of April before they could put the undergr~and in if they had to. A motion w~s made by Mr. Chepulis to deny the request to put in poles on Hollow Tree Lane and maintain that underground utilities shall be installed. Mr. Lamprey seconded and the vote was unanimous. Mr. Chepulis suggested that they tell the electric company what had happened here tonight and ask for reconsideration because it can be done. SAL~FOREST/GRANVILLE LANE: Mr. Ostherr stated that he and Mr. Lamprey had spent 1~ hours trying to resolve the problem withMr. Cyr, George Farr and Mr. Gelinas and ended up with a 5 item list that Messers 0stherr and Lamprey felt should be done - as follows: 1) drainage ditch slope should be a 3-1 slope as called for in the plans, 2) first cul- vert on Granville Lane should be left as is, 3) 112' elevation should be established which is to substitute for the box culvert where the ditch used to go under the rail- road right of way, based on sill level of the ibex culvert, 4) find, mark, and make a condition that the box culvert not be destroyed until the whole subdivision is com- pleted, to be used as reference point, and 5) iestablish the 109' invert level which is Jan. 31, 1977 - cont. where the dr~inag~ system g~es under Granville Lane to the meadow amd get the problem of the piping going into the road solved before any more work is done in that area. There w~s discussion as to when this should be done and feelings were that it should be done now before the building season comes upon us. Because we are on a mortgage bond, the BOARD has no recourse but to hold any further construction on lots until these things are completed. A motion was made by Mr. Nonteiro that a letter be sent to the developer pointing out these 5 conditions and stating that when the BOARD is satisfied with their completion it will cOnsider withdrawal. Mr. Lamprey seconded and the vote WaS ~lrAa~imous. Frank Gelinas mentioned that there had been a request from Mr. Farr asking Mr. Cyr for a release of funds for work that has been done. Board to send Mr. Cyr a copy of the letter and request an amount to be released upon satisfactory completion of this work. Regarding the railroad right of way, Mr. Gelinas stated that once Mr. Farr or a contractor breaks through, the culvert is going to be in the way and would like to reword ~#4; invited BOARD members to view the site; would like to work it through the Highway Surveyor. Mr. Ostherr suggested a change of benchmarks. George l~arr complained that there is more money in escrow than for just a finish coat of black-Sop, l~aming, and bounds and he had to go for a loan to pay his bills. He asked for some assurance that will enable him to pay his contractors. GMk~WOOD WEST DEFINITIVE PLANS - to be reviewed by the Subdivision Control Subcommittee. Letter from Atty. Duly Re ~EDAR LANE: letter referring to Lot #3 was read by the Chair- man. Secretary to send letter stating that according to our records all covenants with respect to this lot were released as of Dec. 11, 1974. IOMMUNICATION FROM SELECTMEN RE CAMPBELL RD.: Letter from the residents was read. Mr. Nonteiro made a motion that the BOARD recommend something be done, the road is in bad condition. Send a letter to the Selectmen and Highway Surveyor signifying that the PLANNING B~ARD is in Full accord and that this road be placed in high priority within the near future. The Highway Surveyor to investigate wha~*,easements are needed. Mr. Sa/emme seconded and the vote was unanimous. Ned Packer, resident of Campbell Rd., stated that N~. Cyr was interested in fixing the road but that their concern is that even in the best of conditions the road is only one lane wide. There have been 5 accidents and people are using the road that are not aware of the existing conditions. We asked Mr. Cyr if he could approach the S~ate inasmuch as they are involved in some of this. All the abutters have listed their full cooperation in working with Cyr and appreciate some of the work he has already done for the Town. Mr. Monteiro brought up the fact that, in long range planning, this road could become a primary way. ANDREW CIRCLE - Request for Letter of Release: the remaining small amount of work to be done on the subdivision is covered by a bank book in the amount of $1,000 with the Arling- ton Trust and therefore the BOAP~ released the ~femper Insurance Co. bond. CONSERVATION COMMISSION ORDER OF CONDITIONS - GREAT POND WOODLAND: was read and on file. LEGAL NOTICE: HAVERltTLL - was read and on file. BOARD OF APPEALSLEGAL NOTICE: STEPHEN DOMMR_TT- the BOARD recalled that this same request was withdrawn previously at which time the Board of Appeals required a single family home with off-street parking to ~e provided. Mr. Lamprey made a motion that the recommendation be for the above reasoning. Mr. Chepulis seconAed and the vote was u~a~imous. Jan. 31, 1977 - cont. FINALIZE PT.ANN~'S JOB DESCRIPTION: Secreta~to make and distribute copies to the Board of Public Works, Conservation Commission, Highway Surveyor, ~ilding Inspector, Fire, Police, Personnel, Board of Health, Tree Warden, Growth Policy Committee. BOARD reviewed the letter from the Personnel Board with copy of Artiole to be on the Town Warrant. Mr. 0stherr commended Mr. Chepulis for work well done. CHAPTER 808: Mr. Salemme commented on amendments or changes that are in the works and what to do about them. A letter is to be sent to Joe Hermann asking for input regarding activity on these amendments to Ch. 808 because we are in the process of proposing changes. A letter from the Board of Appeals was read and is on file. Mr. Salemme stated that in sec. 5.1 (2) the word '~oard" will have to be changed to "Planning Board". D~scussion: Planner with Adviso~ Board: It was reported that they did not think the BOARD was asking for enough money to ensure a qualified person but they sounded favorable. meeting adjourned at 10:30 P.M.
