Regular Meeting
The PLANNING BOARD held a regular monthly meeting on Monday evening~ April 4, 1977 at
7:30 P.M. in the Town Office Meeting Room. All members were present and voting.
Minutes of 10/4/76 meeting were unanimously accepted as submitted.
PLANS NOTREQUIRING APPROVAL:
1. CATHERINE DONOVAN - Boxford St. - ~. Cyr ok'd re drainage. Motion made by Mr. Monteiro
seconded by Mr. Salemme to endorse the plan of land owned by Mrs. Donovan dated 5Iarch, 1977
as not requiring approval under subdivision control law. Vote: unanimous.
2. JEFFREY SIMMONS - Boxford St. - plan denoted 200 ft. frontage for lot on which the o~mer
resides (lot 5). Question as to whether or not he would have to go to Boxford Board also.
Mr. Monteiro felt it could not be mndorsed because Lots 4 & 5 are partially in Boxford. The
BOARD determined that there should be provisions on the plan showing both towns approvals.
Also, advised applicant that he could come back in with plan showing just lots 1, 2, & 3 for
now. 5~. Chepulis noted that the plan did not have the engineer's stamp on it. Mr. Simmons
agreed to come back April 18, 1977.
3. RICHARD P~EKINS - Winter St. - letter from F. Gelinas dated April 4 was read and is on
file. Scott Giles representing. Had to designate all lots in square footage rather than
acres as originally submitted for land court acfion. No changes made. The title insurance
company wants to see the PLANNING BOARD endorsement on this plan as well as the recorded
plan. Discussion regarding this being part of an approved subdivision, Winter Hill Estates
which was not noted on the plan. Mr. Chepulis suggested that a note be put on the Form A
plan to state "this plan is a corrective plan of Winter Hill Estates, etc." Giles to
return with this for the April 18 meeting.
4. GEORGE FARR - Boxford St. - After review a~ motiou was made by Mr. Monteiro to endorse
the plan of G. Farr, P. Breen, and J. Enright dated March 29, ~977 showing lots ~-4 as not
requiring approval under subdivision control lawi.. Mr. Salemme seconded and vote was unanimous.
5. JOSEPH BARBAGALLO - Boxford St. - land owned by N. A. Assoc. Motion made by Mr. Chepulis
to endorse plan dated March 24, ~977 showing Lots A & B as not requiring approval under sub-
division control law. Mr. Monteiro seconded and vote unanimous.
DENNIS DIONEE, ~9 Raleigh Tavern Lane Re Raleigh Tavern North: discussed drainage problem;
stated he had discussed this with Mr. Osgood and Mr. Cyr; the street is deteriorating and
will not get accepted until these problems are taken care of; very frustrating because both
Osgood and C~T point fingers to other parties. Asked for suggestions for resolution. Mr.
Monteiro suggested writing to both Cyr and 0sgood for nex~ agenda, have the subdivision con-
trol subcommittee view the site. Will notify Mr. Dionne of site review.
ATTY. JAMES EATON, III Re M. M. Selden Form A: requested approval of this as submitted last
week; it complies as to frontage and area; it is not a subdivision. Asked for reconsideration
and, if denied, would like decent specs as to what the requirements are on a Form "A". Mr.
Chepulis questioned whether or not he had an appeal on a Form "A" then reiterated drainage
problem with the easement. Eaton said this problem was entirely made by 9he Town and is an
encumbrance on the land. Charles Foster asked if Mr. Eaton knew where the natural water
flow was prior to the Colgate Dr. subdivision- in the same location but not at the degree
it is now, Eaton answered. ~r. Foster mentioned that the Town has means to take an ease-
ment and perhaps an amenable way is the easiest way. Mr. Eaton stated that they could
take it by eminent domain or purchase it.
Planm Not Requiring Approval cont'd:
6. J. BARBAGALLO - Lacy St.: plan includes 4 lots and dated March 1977, easement is
e×istingand has been used for years for the Commonwealth of Mass. to get back into
Boxford Forest. There is no mention in the deeds of this so they felt they would
establish it as existing. The ~OARD checked Ch. 41 for definition of subdivision and
roads. Motion made by Mr. Monteiro to refer plan to subdivision'control subcommittee
for comment at next meeting. Mr. Roberts seconded and vote was unanim6us.
7. GRk~.~OOD ASSOCIATES - Greenwood West: there are some easements along dhestnut St.
for drainage and road widening which the developer has promised to the Town. This plan
is for land court action and they do not have to certify as 125 ft. frontage~because
land court does not get involved with zoning. A reference to the subdivision shall be
noted on the PNRA to be returned at April 18 meeting. This was agreed to by Scott Giles.
8. RICHARD PERKINS - Winter St.: plan dated March 28, 1977 for N. A. Assoc. including
lots t-9, showing road widening easement. Er. Monteiro commented that there will be
some drainage ~roblems in this area. He made a motion to deny the application because
there is not enough information presented, r~r. Salemme seconded. Mr. Chepulis voiced
opinion that he would like to see a notation of locus and future plans for the land.
Salemme withdrew his second. Mr. Chepulis then made a motion to endorse the plan as not
requiring approval under subdivision control law, notwithstanding the fact that something
might be lacking as to the location. Mr. Salemme seconded. During discussion that
followed ~,~. Monteiro stated that he would vote "no" because of the lack of information
regarding the vacant behind this which could develop difficulty for the frontage lots
due to a potential drainage hazard. VOTE: in favor - Chepulis, Lamprey; opposed -
Monteiro, Salemme, Roberts. Reasons: potential drainage problems, against the best
interests of the Town in future; lack of information on plan.
9. RICMI~RD P~INS - Salem St.: plan dated ~rch 30, 1977 showing 9 lots with a 50 ft.
right of way and N. E. Power Co. easement running through the lots; located near Foster
St. I motion was made by Mr. Monteiro to deny the plan because more information is
needed as to what could or could not be done about the easements. Mr. Salemme seconded
~ud vote as follows: favor - Monteir~ Salemme; Roberts, Chepulis and Lamprey opposed.
Upon motion made by Mr. Chepulis and seconded byMr. Lamprey (stepped dorm to second)
to endorse the plan as not requiring approval under subdivision control law the vote was
as follows: favor - Chepulis, Lamprey, Roberts; opposed Monteiro, Salemme. Motion
carried.
GEORGE CHONCRIS - Forest St.: Board had requested locus notation on plan which was done.
Plan dated Feb. 17, 1977 showing 5 lots.~ Mr. Monteiro mentioned that the roadway, in
certain areas, is only passable by one car; a portion conveyed to the Town because 1/2
the traveled way has been on private land. Mr. Chepulis made a motion to deny the p~an
because plan number is missing on the plan for record purposes and questioned the intent
as far as changing the portion of the traveled way as shovm on the plan. Mr. Monteiro
seconded. Unanimous vote. Secretary to send letter with above.
Greenwood West Covenant referred to Town Counsel Salisbury for approval.
Stonecleave Estates Definitive Plan - set up public hearing for May 2, 1977.
