Simons, Chairman: The Planning Board meeting for Tuesday,June 20, 2017 was called to order at'7 p.m. 7 8 ANR: 9 271 ,Stevens Street: 10 R. Oldham: This Applicant is seeking to split one lot into two in the R-3 District. They have been before the ZBA 1.1 and received the appropriate variances to make two conforming lots. The Applicant is before the Conservation 12 Commission for an NOI and has not yet been heard. 1.3 E. Goldberg Is there anything the Conservation Commission may do that may affect frontage or access? ' 14 R. Oldham: It may involve moving the actual structures to be located further away from the wetland. 15 J. Simons: It's a legitimate lot,they received a variance; the other lot has the 25K sq. ft. and frontage;they will. 16 have access over the frontage. Our practice is to recommend the Planner sign the form A; let's hold off to the nest 17 meeting to make a decision and Conservation has opened their hearing. 18 (P. Baynton recused himself as an abutter of the property.) 19 [Continued to Jody 11, 2017 Planning Board meeting) 20 21 BOND RELEASE: 22 Mathews Way,288 Sutton Street: Roadway Bond Reduction 23 R. Oldham: On July 5,2011 the Planning Board approved a Definitive Subdivision(5 lots)on 288 Sutton Street 24 called Mathews Way. Per the recommendation of DPW,the Applicant was required to post a$44,250 Roadway 25 band; the Applicant has completed part of that work and is now asking for a reduction of that bond. The request 26 and the project have been reviewed by DPW and a recommendation was made to release $29,950 and to retain 27 $1.4,300 until all the work is completed. 28 MOTION: E. Goldberg made a motion to release the Roadway Bond reduction for 288 Sutton 'Street,retaining 29 $14,300. L. Rudnicki seconded the motion. The vote was 5-0, unanimous in favor. 30 j 31 PUBLIC HEARINGS 32 CONTINUED PUBLIC HEARING: 58 Country Club Circle: Application for a Watershed Special Permit { 33 under Sections 4.136, 1.0.3 and 10.31 of the North Andover Zoning Bylaw. The Applicant proposes to construct a 34 retaining wall, in ground pool, spa,walkway, patio, fence and associated grading and landscaping in the Non- 35 Discharge Zone and Non-Disturbance Zone. The project is located within the Residential 1 (R-1)Zoning District. 36 R. Oldham: The Applicant has updated the plan and moved the pool out of the Non-Disturbance Zone per ZBA 37 recommendation.They have closed out with the ZBA. however, a wetland delineation had not yet been confirmed 38 and the pool's edge is still within the Non-Disturbance Zone, The ZBA has since discussed the issue and finding it 39 was still further out of the Non-Disturbance Zone than originally proposed, issued an Insubstantial.Change. The 40 wetland has now been delineated.and confirmed by the Conservation Agent.The Stormwater Review consultant 41 has reviewed the updated plans and design and has signed off on the application with the recommendation that the 42 Board condition, soil testing be done at the time of installation to make sure that the Cultee unit is not sitting in 43 groundwater. Rudnicki made a motion to approve the Watershed Special Permit for 58 Country Club Circle, as 48 amended. P. Boynton seconded the motion. The vote was 4-0, J. Simons, L. Rudnicki,P. Boynton and A. Preston 49 voted unanimous in favor. 50 51 CONTINUED PUBLIC HEARING: 1975 Salem Street(aka 0 Salem Street),Phil Christiansen:_Application 52 for a Land Disturbance Permit in connection with proposed construction of three detached single-family homes 53 with site grading, driveways, and service utilities.The property is located in the Residential 2 (R-2)zoning district. 54 [Continued to July 11, 2017 Planning Board rrreeting]No evidence heard 55 56 NEW PUBLIC HEARING: 175 Salem Street Peter and Arlene Devlin: Application for a Watershed Special 57 Permit tinder Sections 4.136, 10.3 and 10.31 of the North Andover Zoning Bylaw, The Applicant proposes to 58 construct a 576 square foot garage and small extension of the existing paved driveway within the Non-Discharge 59 Zone. The project is located within the Residential 3 (R-3) Zoning District. 60 R. Oldham: This application has been reviewed by the stormwater consultant;we are waiting for the Applicant's 61 engineer to respond to those comments and make plan updates;nothing substantial,just a few plan details showing 62 the limit of work, drainage connections, etc. TheTown Engineer has provided comments stating the Applicant will 63 require a Driveway Permit. Wetland delineation has been confirmed by the Conservation Agent. Additionally,we 64 received a letter from the Ridgewood Cemetery Association expressing their support for the project. 65 J. Sullivan, Sullivan Engineering Group: The review agent wanted to see the limit of work clearly delineated and a 66 detail schematic and invert elevations on the roof drain. The project is a 24 x 24 attached garage. The lot was 67 divided and created in 1984; the existing house is over 2,500 sq. ft. in gross floor area; according to the bylaw they 68 are allowed to increase by 25%putting them at 643 square feet of allowable expansion;thus the 576 square feet 69 car garage is within that threshold. Pesticides and sealants will be placed under deed restrictions; we are matching 70 into the grading on site;the wetland line is clearly defined. 71 L. Rudnicki: The driveway extension places snow storage to the right of the garage into the 100 foot buffer zone; 72 is there any buffering you can place there for when snow is stockpiled? Can you provide a landscaping buffering, 73 i.e. a raised mulch bed to stop salt and snow? 74 J. Sullivan: The existing driveway is within the 100 foot;the extension will not be; grass will exist there,which 75 you would want for snow storage melting. We can look into a landscape buffer. 76 E. Goldberg: Has the driveway permit discussion taken place?Have you taken into consideration the comments of 77 the engineer regarding the easement and whether the other owner will be involved? 78 R. Oldham: Typically,they apply for the driveway permit after they receive the permit to do the work. The part of 79 the work proposed is on the Applicant's property and not on the easement portion. It is my understanding they will 80 only be doing the driveway at the upper portion and will not be touching the driveway further down. 81 J. Sullivan: They would have to apply for that permit for the extension for the 250 square feet of the driveway, 82 only. They will not be doing any work to the existing driveway. 83 P. The Conservation.Commission has issued a Cease and 91 Desist Order against this company to ensure proper permitting is in place before moving forward.The 92 Conservation Commission has also issued Enforcement Orders to the homeowners and in some cases required 93 supplemental replanting. Planning has been reaching out to those homeowners who.are in violation, informing 94 them of the Watershed Protection District and the North Andover Zoning Bylaw requirements. We inform them 95 that in some cases it's just a call and a confirmation that the trees can be removed and do not require permitting 96 with the Planning Board or simple erosion control measures that would need to be in place prior to tree removal. 97 We wanted to bring this issue to the Board's attention because there were multiple violations and wanted to be 98 sure the Board approved of the Planning Departments approach. It is important to note that any violation where 99 there is clear clearing to the Lake or a wetland in the Watershed would be brought to the Board. 100 L. Rudnicki: The NAPD requires solicitation permits and they should notify the Planning Board prior to this 101 occurring in the future. 102 P. Bion: The guidelines drafted provide consistency and protection for the future. I believe the procedure in 103 place is adequate. 104 105 Planning Board List and Signature Authorization: The Board approved and signed a letter granting the Staff 106 Planner,Rebecca Oldham, authorization to sign drawings on behalf of the"Town for the North Essex District 107 Registry of Deeds. 108 MINUTES APPROVAL 109 MOTION: L. Rudnicki made a motion to approve the June 6, 2017 minutes. E. Goldberg seconded the motion. 1.10 The vote was 5-0, unanimous in favor. 111 112 ADJOURNMENT 113 MOTION: L. Rudnicki made a motion to adjourn the meeting. The motion was seconded by P. Boynton. The 114 vote was 5-0, unanimous in favor.
