According to the Town of North Andover Bylaws(the"Bylaws") the Pond Pasture Parcel(the"Parcel") is a buildable RI lot, Based on the dimensions presented in Plan 43 827 (a copy of which is enclosed), the Parcel is a buildable R-I lot because the Parcel meets the dimensional requirements set forth in both the Bylaws and M,G.L Ch. 40A, Section 6 ("Section 6")(collectively the"Grandfather Clauses"). The Grandfather Clauses both require a minimum of 50 feet of street frontage and a MininILLED lot area of 5,000 square feet, Here,the Lane to Pond Pasture easement(the"Lane") provides 60 feet of street frontage and the parcel is approximately 20 acres;thereby satisfying the dimensional requirements of the Grandfather Clauses,Also note that the lot existed prior to January 9, 1957 pursuant to a deed recorded with the Middlesex County North District Registry of Deeds in Book 671,Page 284 dated as of 1944.It is also important to note that the applicant anticipates combining the Parcel with the adjacent parcel owned by Edgewood Retirement Community as a condition to the issuance of the Special Permit.
