August 23,2017

• A motion to accept the meeting minutes of 08/09/2017 as drafted and reviewed is made by Mi.
Manzi, seconded by Ms. Feltovic.

Small Project
NACC# 198, 128 Dale Street,(Steven Mason)
• Steven Mason is giving a brief overview of the proposed project which is to remove an old deck and
concrete patio and replace it with a paver patio.
• The Administrator gives a brief description of the project,showing the Commission historic aerials of
the site. The Administrator states that everything that is currently there has been there since the 90's
but it does not fall neatly into the Small Project category because the proposed project is larger than
300 square foot limit,but it would be on what is an already existing developed area. The subzones on
the Plan are incorrect,that it is a Vernal Pool off to the right,which is actually a 75 foot no build
setback, so this would be in the no build zone, but it is legal existing structure.Also there will be
some landscaping which the impervious will pitch to so there will be plenty of area for the water to
ga.
• Mr. Lynch asks for the setbacks to be noted in the plan
• A motion to consider the proposal as a small project L is made by Mr. Manzi and seconded by Mr.
Lynch
• Vote unanimous
• A motion to approve the project as proposed with conditions for pre and post construction
inspections,no stockpiling in the 100 foot buffer zone and that the flan reflect the Vernal Pool with
75 foot setback locations is made by Mx. Manzi and seconded by Mr. Lynch.

Request far Determination of Applicability
695 Massachusetts Avenue(Sullivan Engineering)
• The Administrator gives a brief explanation of the proposed project which is to crush and fill an
existing septic tank, and extend and connect to sewer. The Administrator has been to the site and
confirms the location of the wetland lines.
• Jack Sullivan,states that Norse Environmental did the Wetland Delineation and that the proposed
project is for the old house on the corner of the Old Common. This project is also for an extension of
the Towns Sewer line where there is a gap in the line. The idea is that the current septic leaves the
house to the back and the lichen field is possibly near the Wetlands;there are no records to show
exactly where it is on the property. The proposed project will re-plumb the house and have it now
exit out the front of the house.
• A motion to issue a negative #3 with conditions for pre and post construction inspection is made by
Ms. Feltovic and seconded by Mr. Manzi.

• The Administrator gives a brief explanation of the proposed project and about the concerns expressed
at the last meeting regarding the proposed paver and their stability in a possible flood.
• Mr. Sullivan is handing out information on the stone that is now being proposed,he is also explaining
that the previously proposed pavers were a tough track paver which could support traffic load even
though we are not looking to use this ramp for traffic,this ramp will be used by the Fire Department
to access the Merrimack River in emergency situations. There was concern for the type of paver;it is
only 1 `/2' deep and directs the installer to place pea stone or a small diameter stone into the crevices;
there was a concern about the velocity and tidal action of the River and that it could wash the stone
away. The applicant decided to go back to the drawing board. The Administrator gave me some
information from the DEP website of pavers that have been used along banks,in particular,the one I
just handed out DuraGreen,which are an open faced concrete paver that you can put crushed stone or
loam,seed and/or rock in.
• Mr. Sullivan states the new pavers are open 3'x3' and 3%"inch deep that allows for loam and sand
below. The plan itself is the basically the same as before with the grading and the footprint.
• The Administrator clarifies that the paver information she provided to Jack was not from DEP but
from other ramp construction projects. However she would like to know the size of the stone that they
are proposing to put in.
• Mr. Sullivan states that right now the site is all boulders and that they would try to reuse the boulders
that were excavated on the site and reuse them on the side of the proposed project.

• Mr.Napoli asks what the pavers will be filled with.
• Mr. Sullivan states that they will be filled with loam and grass and that it is above the high water
median line.
• Commission is discussing the type of grass and the timing of the project in regard to erosion and the
possibility of using sod.
• Ms. Feltovic states she is concerned with the maintenance
• Mr. Lynch states that the Fire Department or DPW will have to maintain the tamp.
• Mr. Manzi asks where these types of pavers are being used and whether they are currently used for
steep grades.
• Mr. Sullivan states that he has not used them on ramps before but has used them in Commercial
applications.
• A motion to continue the public hearing at the request of the applicant is made by Mr. Lynch and
seconded by Mr. Saal.

• Mr. Manzi and Mr.Napoli enacted their rights under the"Mullin Rule"by watching the videotape of
the prior hearing.
• Curt Young-Wetlands Preservation-all work is within the buffer zone the Conservation Commission
asked for a deed restriction and a copy has been provided to the Conservation Commission. They are
proposing to install a drain under the driveway. We are proposing to a vegetation barrier,we have
also changed the design of the wall to a continuous 2x2 wall.
• Mr.Manzi has a question on lot 2 regarding the culvert and the drainage for the site.
• Mr.Young states that there is a grade difference between the two sites
• Mr. Manzi is inquiring about the location of the driveway and his recollection was to have it in the
front of the house and away from the buffer zone
• Mr.Young states that the negative impact of having the driveway in the front was pronounced and
dangerous.
• Mr.Napoli asks how large is the driveway and what the turn radius is?
• Mr.Young states about 28x22
• Mr.Napoli asks how far the house is from the street.
• Mr.Young 22 feet from the street
• The Administrator states could the house be moved
• Mr. Christiansen is at the podium to speak to the ZBA's approval of the lot.
• Attorney Borenstein is at the podium to speak regarding the ZBA's decision,Attorney Borenstein is
also speaking about the different options for the driveway location, and he states that they are also
doing a lot of planting on the site to help with mitigation
• Mr. Young is speaking about the proposed drainage options that have been submitted to the
Conservation Commission and that the other option calls for a lot of site work and terracing.
• Mr. Manzi asks if they are open to a third party stormwater review.
• The Administrator asks why there is such a grading difference if the driveway is reversed to the other
side of the home.
• Mr. Christiansen states that
• The Administrator states this plan has never been submitted to the commission for hard copy review
and analysis
• Mr. Lynch question if storm water review might be negligible.

• Mr.Napoli does question if this is the best option in regard to the site for the driveway.
• Mr. Lynch moves to close the hearing and issue a decision
• Vote 2-3,the no's have it,hearing is still open.
• The waiver is for a the work(behind the stone wall)not the driveway
• There is discussion among the commission as to the different driveway options provided by the
applicant and taking into account the Wetland Regulations and location.
• Attorney Borenstein is asking for the public hearing to close.
• A motion to close the public hearing and issue a decision in 21 days is made by Mr. Manzi and
seconded by Ms. Feltovic
