Septic System Replacement
Conservation Conditions of Approval,NACC #25
Pursuant to section 4.4.2 (D) of the North Andover Wetlands Protection Regulations, Merrimack
Engineering Services, Inc. (representative) filed for a small project review on behalf of the
homeowner / applicant of 23 Forest Street,North Andover. The proposed work includes the
abandonment of the existing septic system,in order to install a new system within the Buffer Zone
to an adjacent Bordering Vegetated Wetland (BVW). The new septic tank will be placed
approximately 96-feet from the edge of the delineated wetland resource area at it closest point.
Additionally, the leach field is proposed 102-feet from the edge of the delineated wetland resource
area,with the limit of work at 52-feet from the wetland at it closest point. The North Andover
Conservation Department agrees with the location of the wetland boundary.
During the December 27,2006 public meeting, the North Andover Conservation Commission
(NACC) unanimously voted (4-0) to approve this project. The following conditions are hereby
mandated:

CONDITIONS:
1. A row of staked hay bales backed by trenched siltation fence shall be placed between all
construction areas and wetlands, as shown on the above refernced plan. The erosion
control barrier will be properly installed and placed as shown on the plans approved and
referenced herein and shall be inspected and approved by the NACC prior to the start of
construction and shall remain intact until all disturbed areas have been permanently stabilized to
prevent erosion.All erosion prevention and sedimentation protection measures found necessary
during construction shall be implemented at the direction of the NACC. The NACC reserves

the right to impose additional conditions on portions of this project to mitigate any impacts
which could result from site erosion, or any noticeable degradation of surface water quality
discharging from the site. For example,installation of erosion control measures may be required
in areas not shown on the plan(s) referenced in this Order of Conditions. Should such
installation be required by the NACC, they shall be installed within 48 hours of the
Commission's request.
2. Once the above-mentioned requirement is complete,the applicant shall contact the
Conservation Department prior to any site preparation or construction to arrange an on-
site conference. The contractor and the applicant shall attend this meeting to ensure that
all of the conditions are understood. These conditions shall be included in all construction
contracts, subcontracts, and specifications dealing with the work proposed and shall supersede
any conflicting contract requirements. The applicant shall assure that all contractors,
subcontractors and other personnel performing the permitted work are fully aware of the
permit's terms and conditions. Thereafter, the contractor will be held jointly liable for any
violations resulting from failure to comply with its conditions.A reasonable period of time
shall be provided as notice of the pre-construction meeting (e.g. 72 hours).
3. Accepted engineering and construction standards and procedures shall be followed in the
completion of the project.
4. Upon completion of the approved project and site stabilization (germination of grass),
please contact the Conservation Department for a final inspection.
5. Upon approved site stabilization, erosion controls shall be removed and properly disposed
of as determined by the Conservation Department. All exposed areas under the erosion
controls shall be immediately seeded for permanent stabilization.
6. This permit shall expire on December 1,2007.
