Executive Session
The PLANNING BOARD met in Executive Session with John J. Willis, Sr., Town
Counsel, on Monday evening, March 5, 1979 at 8:30 P.N. re Carleton Farms East &
West court case. The following members were present and voting: William N. Salemme,
Chairman; John J. Nonteiro, Vice-Chairman; William Chepulis; and Joyce A. DiTore,
Clerk.
Town Counsel informed the membership that he reviewed with the petitioner what this
Board acted on when denying the plan and suggested that a condition should be imposed
which would prevent seller from selling any of the lots prior to a test of suiSability
of the land for septics.
Town Counsel then stated that he had a conference with Cyr, the developer, and
engineer in afternoon regarding the connection with Carleton Lane - the developer
will redesign to meet Cyr's approval; there is an indication cf a road widening
easement on the plan; if it has legal standing then Bud Cyr has his easement, but
if not, they will give an easement on East &West (pertaining to Summer St.) in an
attempt to widen the road to accommodate the Highway ~urveyor.
He then advised and recom~ended that he proceed to conclude the suit by an approval
of the plans with these recommendations stated above. The developer will adjust
the plans to meet the conditions. The BOARD agreed with Town Counsel's suggestions
and authorized him to act in their behalf~in order to effect the best possible
solution.
Re Campion Hall (Ea~dtceurt) - Town Counsel expl~ed procedure of filing by the
developer with the Board of Health and the 45 day time frame in which they have to
make recommendation.
