6 J. Simons, Chairman: The Planning Board meeting for Tuesday,November 7, 2017 was called to order at 7 p.m.

8 Master~Plan/Regional Housing Plan/tonin Diagnostic Update:
9 E.Halvorsen RING Associates: Over the last two months the Master flan committee has been finishing the existing
10 conditions report.The draft report is available on the town website. We had our first public meeting on November 2. Nearly
11 200 people attended the meeting which is a terrific turnout. Next step is to craft a vision statement and goals for the
1.2 individual chapters. The Master flan Advisory Committee has scheduled 2 follow up meetings in the next couple of weeks for
13 those who may not have been available.on November 2 and/or for those who may want to add additional comments.
14 A.Vincent,MVPC: 13 community workshops have been completed and hundreds of comments on needs region wide around
15 senior housing, starter homes,renovating older homes and disabilities have been collected.A needs assessment will be
16 generated resulting in data on who is living in North Andover,where they are living,their incomes, affordability versus
17 median home sale prices.We will present this next Wednesday Nov. 15,2017 at 7 p.m. at the NA Senior Center.At this
18 meeting we will start to develop housing strategies and goals for the town. We encourage everyone to participate via our
19 website(coUrb.colmvhousing).
20 .1,Barrett: The NA Bylaw needs significant work. Short term goals can address administrative housekeeping to help organize
21 and eliminate inconsistencies creating a document that will be easier to amend. Where the town is in the midst of a Master
22 Plan redevelopment,policy issues can be dealt with at a later date due to expected need for zoning changes.

26 J. Simons requested the discussion portion related to the Board of Health attendees be taken out of order.
27 P. Boynton:Advised the Board that he attended the past Board of Health meeting and provided a brief overview of the
28 recreational marijuana discussion.
29 Larry Fixler,Chairman of the BOH and Francis P.MacMillan,PhD.. &Town Ph, sry 'ciart offered their thoughts and perspective
30 on the public health elements of recreational marijuana.Provided a brief summary of some of the data in the Colorado report:
31 Executive Summary Monitoring Health Concerns. Summarized some statistical data stated in the report.The literature can
32 help to guide policy and mitigate damage.Expressed the need, form a public health standpoint,to manage the down sides of
33 the drug's misuse and addiction.
34 E. Goldberg: I think we agree drags and children aren't a good mix,but if we had a legal retail store;how would that affect
35 the public health? Would it decrease the black market?Is that a good or bad thing?If we zone for marijuana,are there public
36 health benefits to limiting sales to one area or spreading out access to the drug?These are the kinds of questions and issues we
37 are thinking about.
38 F.MacMillan: I would approach it like liquor licenses;you have a certain number of licenses then you look at the downside
39 effects.If you increase access you may increase drunk driving episodes,for example,
40 E. Goldber : Does it help to'limit access to 21+age groups;this has worked with tobacco and alcohol. 2
41 F.MacMillan: One of the results of the Colorado report mentioned 18 %of parents who use, don't secure it in the home;
42 therefore children result in being exposed to it at a potentially young age either in bud form or edibles. Second hand marijuana
43 smoke is also a risk to young children;the use will increase. The human brain is more susceptible between the ages of 12-25;
44 if you are going to start designing regulations you need to take that into account to delay that first use and design
45 interventions,We now have a body of evidence we can reference.

46 C.Allen: Going forward,the BOS has to put together the community host agreement for 1.600 Osgood,we might suggest
47 through the BOH to include financing toward public education. That would be a wonderful way to spend dollars since it
48 doesn't seem to be coming from the state at this point;an educational program is a must.
49 L.Fixler: The Colorado report reflects the years 2014-2016 and it is pure statistics as to what happened prior and when it was
50 legalized statewide;the report will be updated.
51 F.MacMillan: Odor and noise are legitimate concerns for the health department.

53 CONTINUED PUBLIC HEARING: 122 Foster Street,North Andover,Varsity Wireless,Brian Grossman:
54 Application for Wireless Facilities Special Permit—Site flan Review under sections 8.9 and 8.3, 10.3 and 10.31 of the North
55 Andover Zoning Bylaw. Applicant proposes to construct,operate and maintain a 130 foot monopole tower(135 feet to top of
56 faux branches)with supporting equipment located in the Residential 1 (R-1)Zone.
57 J. Enright: The town engineer has submitted response comments for stormwater review;all comments have been addressed
58 and be has now asked for minor changes to the plans. Over the course of this week several communications were received in
59 the form of fliers, entails,video links,newspaper article links and letters.The communications received after the Board packet
60 was sent have been provided in hard copy to the applicant and the Board.The proposed location for the wireless facility is on
61 Chapter 6 1 A land. The applicant submitted Supplement#2,which includes revised site plans.The Board has 150 days on this
62 application to take final action, The application was submitted on August 17,2017. 1.50 days from that date brings us to
63 roughly early January. The applicant is also before the ZBA. They have held one hearing and one site visit. If you would like
64 our wireless consultant at the next meeting I can arrange for that.
65 S. Egan,"Town Counsel:Explained that the important thing to consider is that any decision the Board makes has to be made
66 on what is in the record before them and that should be the basis of the decision making process. The Telecommunications
67 Act prohibits towns from prohibiting a wireless tower if that would then prohibit completely any wireless coverage in that
68 area. The applicant is showing there is a need for coverage. The Board can look at the zoning bylaw and the concerns under
69 the zoning bylaw. Expressed that the Board is within its authority to ask for alternative locations and to have that established.
70 E. Goldberg*: If the ZBA allows the variances how much can we consider the same criteria if they've granted, for example the
71 height variance?
72 S.Egan: You have certain considerations within the special permit bylaw;that's discretionary to this Board,
73 J. Sitnons: We won't approve this until the ZBA hears this. (The Board agreed.)
74 Brian Grossman Varsity Wireless representative& Stephen Kelleher Developer for Varsity Wireless: We have revised the
75 height of the pole to reflect total 115 ft.to the top of the faux branches;revised photo simulations have also been submitted;
76 this is our Orr'hearing;,third substantive. Described predicted visibility of the pole and showed revised simulations.
77 J. Simons:These don't feel right?That looks like a lot more than 15 feet ofr.
78 B. Grossman: There is a Typographical error,the tower is lowered by 20 feet, One of the questions at the last meeting had to
79 do with comparing this height to other towers in North Andover;the existing Chestnut Street tower is 152 feet tall;95 ft.to
80 220 ft.property setbacks with significantly more density of hoaxes surrounding it.
81 J. Simons:That tower existed prior to our bylaws;it's considered a legacy structure,
82 B. Grossman,: The existing tower at 691 Johnson Street is 185 ft.tall;it is closer to the existing property lines;approx.200 ft.
83 to the nearest residence.
84 B Grossman: The site does not work for Verizon at 57ft, We've revised the plan from 5 to 3 co-location spots.
85 1. B�oynto: Your interest in having four arrays is driving the height of this antenna.What is the bylaw requirement for co-
86 location on the antenna?
87 S.S.Egan: There isn't a requirement but perhaps an expectation of co-location.
88 E.E. Goldberg: (Read the Wireless bylaw section 8.9.6.a)The point is we want less towers; I don't think that means every tower
89 has to have co-location. I also think it's somewhat disingenuous to say our bylaw requires it when you're asking for 8
90 different waivers or variances from the bylaw. Generally,the more you can get on the tower the less towers you need.
91 B. Grossman: We came to the Board at 135 ft. originally to provide for greater co-location.Now we have a potential of three.
92 N.Boynton: Theoretically, it would work at 97 ft. and still have two arrays.
93 B. Grossman: Vertical separation is necessary and Verizon and AT&T only work at 97'-107' and Verizon can only take 97 ft.

94 P.Boynton: 1 have a hard time agreeing with your logic.We asked that you inform the Board if telephone pale toppers could 1
95 replace this tower.How many would you need to make it work at that lower height?
96 B. Grossman: The pole toppers only provide capacity not coverage-you won't get more coverage from them;also the
97 telephone poles are below the tree line,they're not tall enough.
9$ E. Goldberg: Part of the bylaw states this shouldn't be located within 300 ft. of a scenic road.Is there a definition in our bylaw
99 for this?
100 J.Enright: There is not a definition in the bylaw. I will look into history of scenic roads in town.I do not believe any have
101 been designated as such.
102 J. Simons:Tell us what other options you considered and tell us why you chose this location.
103 B. Grossman: We looked at the existing stanchions and the existing National Grid Sub Station area.
104 S.Kelleher: We had challenges with this area;wetlands limitations,public,private and state designated Conservation land,
105 open space(soccer fields),topography.I did a tremendous amount of work to find a site to meet the bylaw and avoid.
106 variances. The properties by utility lines were not ideal as they were further away from the objective.Obviously there are no
107 commercial or industrial areas in this location which are always a preference. We thought we could maintain tree cover in this
108 area. When I met Mr. Young a couple of years ago we walked the site. This is the only site available that meets the objective
109 and was available to There were some concerns that you'd see the tower from Foster Street so we added arborvitacs along the
110 street 10-15 ft,tall and another row of similar trees to disguise the monopole:
111 A.Preston,: You've been working on this for a couple of years now;who defined the problem,the carriers?
112 S.Kelleher: The carriers define the need;we build and lease to them.AT&T bad been looking and ultimately we found the
113 site. Subsequent to our application in Boxford we were approached by Verizon.
114 J.Luz: The white circle on your diagram is defined as being inadequate coverage; why not shift the center further east away
115 from conservation land.How did it come to be located in that position?
116 S.Kelleher. The carriers define what their needs are. If you shift it five miles,you won't get adequate coverage.With AT&T
117 you are covering Vest Way and Bridges Lane as well as the busy roads covering the traffic on Boxford and Salem Streets.
118 B, Grossman: The coverage objective here is Foster St,Boxford St., Salem St., Vest Way and Bridges Lane.
119 P.Boynton: You mentioned busy roads;we heard a carrier recently for a permit to install the telephone pole top antennas and
120 they told us that was to service needs on busy roads.I'm hearing two different things here. Why can't part of the need be
121 covered by telephone pole top antennas?Is there a combination solution relative to busy roads?
122 B. Grossman: The coverage objective includes roads and primarily in-building coverage in this area.Because of the way the
123 signal propagates it provides coverage on the road because the road is near the site. A.Preston: Verizon is concerned about
124 serving homeowners;the residual is the travelers benefit as well.
125 P.Boynton:As 4G evolves into 5G will we need the tower?
126 B. Grossman: Demand will increase not decrease.
127 E. Goldberg: Can tower heights be increased?Under our bylaw can you come back and increase the height?
128 B.Grossman: If you plan in advance and design the foundation and structure to accommodate for it up front that is possible.
129 E.Goldberg: Is it feasible to increase the height of old towers?
130 B. Grossman: Generally,you cannot go back to old towers;they are old and maximized in height.
131 J. Simons: Can you tell us more about the 61A restriction?
132 B.Grossman: The site has a 61A restriction on it.There is a process under 6 1 A to remove the property involving paying back
133 taxes,putting forward a plan to define the area to be removed and notifying the Town of its first right of refusal. It does not
134 preclude the grant of a special permit or variance for a project. It is preferable to remove it after the fact in the event the
135 project is not approved.
136 J. Simons: How do you value the right of first refusal?
137 B.Grossman,: The Town values the property v.the landowner seeking to remove it.An appraisal is done of the best use of the
138 property;where this is a piece of the property it becomes more difficult. The landowner can accept or challenge the appraisal.
139 S.Egan: Recently,this Board considered a 61 A notice to convert;the landowner provided the purchase and sales agreement.
140 In this instance,this landowner would provide the lease;it would be a right of first refusal on the same terms and conditions
141 and then you would value it; it is not a simple process.

142 P. Boyntotr: Have you done a comparison of what the pole looks like at 97 ft.?
143 B. Grossman:No,Varsity has a lease with AT&T and Verizon;using the 97 and l07 ft.
144 B. Grossman: We included in our revised supplement(dated 11-7-17)a report from Real Estate Consultants of N.E.,Inc. This
145 impact study concluded the tower,at this location, will have no measurable impact on surrounding property values. (Mark
146 Correnti, SRA&Andrew G.LeMay, CNHA)
147 Lisa Roberts,. 31 Bridges Lane: Requested more photos of the pole. Commented that two recent offers on neighboring homes
148 were retracted due to knowledge of this project.doted the obvious opposition in the room. The majority of neighbors are not
149 excited about this project. This is a residential neighborhood and potentially a scenic roadway;health issues have not been
1.501 mentioned;coverage/capacity is not an issue and challenged the distance of coverage of a monopole v. canisters telephone
151 poles.
152 Elaine Finbury, 160 Foster Street: Focused on land use;master plan;zoning bylaws and responsibility of the Planning Board
153 in protecting the land for agriculture and farming. Reviewed historical legacy of the property dating from 1650. Described the
154 sense of place on Foster Street that is still intact.Distributed the Farm Legacy Project brochures to Board members.
155 E. Goldberg: Are there any historic preservation restrictions on this property?
156 B. Grossman:Not that we are aware of
157 E.E.Finbury:The property is likely to be eligible for inclusion on the National Historic Register which takes time and
1.58 resources. Should that be granted,it would take time for actual nomination.
159 Jared Arnuan 242 Foster Street: Referenced the coverage map presented by Varsity Wireless noting the topography of the
1.60 proposed site suggesting alternate more elevated areas nearby;noting this site is situated in a depression surrounded by three
161 large hills. Mentioned the recent telephone canisters on Boxford Street that are not online yet,noting areas not covered. Stated
162 this pole is only covering approx.200 homes and missing swaths of others, it seems contrary to erecting this large tower.
163 Alternatively,suggested a direct antenna system similar to what Andover,Wellesley,Lynn, and Peabody are installing v.
164 relying on canisters.American Towers a competitor,designs a high broadband DAS systems plan, The Town owns the
165 antennas in a private partnership leasing back the capacity to the carriers.
166 Tom Baird 75 Foster Street: Resident and professional retired real estate agent for 50 years;predicts property values will
167 decrease$25-50K.Noted the photos only depict the view with leaves on the trees.Mentioned FAA regulations requiring
168 lighting strobes on the monopole and site lighting;application doesn't mention the noise factor of 58 decibels which will be
169 loud;Fire access is limited in the event of a fire;U.S Fish&Wildlife warns 16 migratory birds including eagles will be
170 affected.Read the beginning of the Wireless Facilities bylaw Sec. 8.9.,referencing how the Planning Board makes their
171 decision.Another location needs to be considered.
172. Richard Stanley,65 Bridges Lane: Questioned the attorney as to the relationship with the real estate consultants.Are they
173 under contract with Verizon or any of its subsidiaries;what is your relationship with them?
174 B. Grossman: We have used them in the past and Varsity Wireless pays for their independent services.
175 Justin Owens 193 Foster Street: The argument of telephone poke toppers is disingenuous; street poles are near all our homes.
176 have you studied how much capacity our neighborhood needs and uses?There is no demonstrable evidence.
177 Mark Johnson 440 Foster Street: Stated real estate values will be affected. Questioned the intended population for this tower.
178 Expressed that he has never had a cell coverage problem at home or driving the area. Ecologically speaking,Mosquito Brook
179 nearby is a natural habitat for mosquitos,bats and birds who will all be affected by this. Stated that this process was not very
180 transparent and that he is discouraged more people weren't noticed.
181 Pam Rivet 67 Foster Street Abutter: Our real estate values will be affected. Does a new NEPA notice need to be updated
182 from 2014 and sent out to residents as part of a new process?The EBI Consulting states a pre-historic archeological survey
183 report is necessary;was that work completed?Are there any specifications in the application of how the monopine will be
184 constructed for details,i.e. size and quantity of branches?Requested the Board ask for detailed specifications;end results may
185 look very different from the renditions we've seen. There is nothing in the document about the minimum height analysis for
186 AT&T;everything references Verizon;I'm not convinced that a 115 ft.tower is necessary when all the documentation
187 references 97 ft. The carrier and tower builder can build anything;this Board has the power to adhere to the bylaws pushing
188 them to be built differently. We have full cell coverage driving and in our home,The existing towers referenced are not
189 obtrusive;earlier towers are hidden;I didn't even know their whereabouts.

190 B. Grossman:The primary focus for the data is for homes is within 1,0110 ft,;Homes over a 1,000 ft.are not impacted.NEPA
191 is a long process that started for this project in 2014;it is still valid and does not need to be restarted; it concludes after
192 permitting.The archeological work is invasive and wouldn't be done in the context of an application that isn't approved.

195 B. Grossman:The data is a result of Verizon's network drive test data demonstrating real world scientific testing.The white i

197 Gerry Margolycz,46 Foster Street: I am concerned about the noise emitted from this tower residing three houses away.Is it a
198 constant drone or does power go on as needed?
199 B. Grossman:The tower doesn't emit noise;HVAC units generate noise, in a power outage generators may generate noise for
200 several hours and then intermittently.(Ince a week the generator may run 45 minutes to an hour and the time can be set. They
201 comply with noise requirements at the property line; we submitted a noise study.
202 Julie Ross, 104 Bridges Lane: I live on Bridges Lane and we have terrible coverage;we work from home and it is an issue. Of
203 the 10.5 acres of 6 1 A land,how much is being sacrificed for 61A?
204 B. Grossman: The vast majority of the property will remain within 61A; only approx.1.5 acres;the leased area and access
205 road will be dedicated to this project.
206 P.Boynton: Referenced the real estate report noting that none of the analysis in the report compares the value of a home near
207 an antenna before the antenna was built compared to after the antenna. If you have a 4K sq. ft,home near an existing antenna,
208 the sale price is being compared to similar homes elsewhere. This report is just a basic comp analysis.I didn't see anything
209 comparing the value of a home before an antenna went up to after an antenna.
210 Mark Correnti Real Estate Appraiser Commonwealth of MA&NH: I've been appraising for 20 years and have been a broker
211 for over ten years,You would need to sell twice and none of that before and after methodology is in this report. In order for a.
212 match pair analysis,you'd need to have a sale within 1,000ft.; we have some examples where it's less than 300.
213 P.Boynton: Has there been any analysis of relocating the tower to a different spot within this parcel?What difference would
214 that make on impact of the tower on all the concerns we have heard tonight?
215 B.Grossman:No,the middle part of the property is a deep depression.Tower heights would change. We felt this was the best
216 spot.
217 J. Simons: We have a 150 day clock on this,we don't have an enormous amount of time. We prefer to wait for the ZBA to
218 make a decision. Would you entertain an extension?
219 B.Grossman: Generally Varsity Wireless is cooperative.We need to see where we are when we get there. The ZBA has a
220 little more time;we are aware and understand your position.
221 J. Simons: We should meet again in two weeks.
222 P.Boynton: I'd like to hear more about distributed antenna systems at our next meeting.It sounded like it was successfully
223 utilized in local communities.Perhaps a further reduction in tower height with a partial distributed antenna system.
224 B.Grossman: We would like to continue to the December 5,2017 meeting.

228 Special Permit under sections 8.3, 10.3„ 10.31 and 16 of the North Andover Zoning Bylaw, The Applicant proposes to allow
229 a contractors yard and outside storage of landscape products and landscape/contractors equipment located within the Corridor
230 Development District 3 (CDD3)Zoning District.
231 J,Enright:The applicant has made minor site plan adjustments to the site plan placing additional tree screening in a staggered
232 placement,the NAFIJ and DPW have confirmed all concerns have been addressed.The BOH approved the design providing
233 no additional flow is added to the existing septic,This is conditioned in the draft decision. The applicant met with some of
234 the neighbors after the last meeting.
235 MOTION: E. Goldberg made a motion to close the public hearing for Site Plan Review Special.Permit for 1679 Osgood

237 MOTION: A.Preston made a motion to approve the Site Plan Review Special Permit for 1579 Osgood Street,North
238 Andover,MA,as amended, P.Boynton seconded the motion. The vote was 5-0,unanimous in favor.

241 440 Great Pond Road,Ralph Hancock-Hancock Landscaping: Violation of Zoning Bylaw Section 4.136,Watershed
242 Protection District,
243 J.Enright: On September 9,2017. there was a Watershed Protection District violation on this property. A landscaping crew
244 working at the site cut down several trees along the shoreline and within the Non-Disturbance Zone, The Conservation
245 Commission has issued an Enforcement Order. They are before Conservation on.November 29,2017,. A wetlands scientist has
246 been hired to delineate and demark the 100 ft. line and create a restoration plan, The plan will need to be approved by the
247 Conservation Commission and this Board.

253 Framework for Recreational/Commercial Marijuana Zoning Bylaw
254 J.Enright: Since the last meeting the BOS unanimously voted to bawl two of the five licenses allowed by the state;the
255 marijuana craft cultivation and marijuana retailer. Town.Counsel is crafting a general bylaw with the Town Manager,
256 E.E. Goldberg: How do we reflect the guidance of the BOS in drafting our bylaw that may or may not pass at Town.Meeting?
257 S. You can asterisk an appendix in the warrant which bans the two licenses.If that fails,you have the asterisk and the
258 alternative zoning bylaw addressing those issues. We would have that framework ready to go.
259 BOARD: Discussed having an alternative plan B in place for Town Meeting;particularly if the BOS recommendation is voted
260 down.Board agreed to focus on this at the December 5,2017 meeting.
