10 Application for Wireless Facilities Special Permit—Site Plan Review under sections 8.9 and 8.3, 10.3 and 10.31 of
11 the North Andover Zoning Bylaw. Applicant proposes to construct, operate and maintain a 1.30 foot monopole
12 tower(135 feet to top of faux branches)with supporting equipment located in the Residential 1 (R-1)Zone.

15 CONTINUED PUBLIC HEARING: 21 Hi h Street(formerly known as 1 High Street RKG North
16 Andover LLC:
17 .Application for a Site Plan.Review Special Permit and a Planned Development District Special Permit under
18 sections 8.1, 8.3, 10.3, 10.31 and 11 of the North Andover Zoning Bylaw. The Applicant proposes to construct a
19 59,440 SF building containing 51 units of residential apartments, along with parking and associated
20 improvements.The properly is located in the I-S Zoning District.
21 J. Enright: A site visit was conducted December 8 to review the building location,access roadways,parking and
22 utilities. The applicant will provide the Board responses to town departments,residents and Board comments made
23 at the last meeting and review images of the original site plan and photos of the Davis &Furber which show
24 historic buildings of various materials and styles and other local building images that communicate the style the
25 applicant is striving to replicate. The Building Inspector contacted the Sutton Pond Condominium Association in
26 response to a complaint raised at the last meeting regarding a bright light mounted on the building and shining off
27 property.
28 Tania Hartford &David Steinberg, RCG: Fire access was redesigned and since approved by the NAFD. An access
29 point from the lower parking lot to the upper parking lot was added so that a truck may have in/out access.This
30 also provides better access from the lower garage to walk to the apartment complex. Snow storage locations have
31 been relocated.NAPD provided feedback on the dumpster advising commercial noise regulations be adhered to
32 and commented on leasing of parking spaces. The parking chart is being revised. Merrimack College leases spaces
33 on the upper level on a school year basis. We may revisit the lease agreement at some point,but for now we meet
34 the parking requirement with the lease in place. There was public comment regarding light coming from cars
35 driving up the ramp. There used to be plantings along the driveway which blocked the lights. This will be F
36 replaced in the spring and additional plantings will be added to deter cars from cutting across the lawn. There was
37 concern regarding traffic impact, but the traffic impact study,that the peer review consultant reviewed, indicates it
38 is minimal. Stormwater runoff from Walker Rd.has been reviewed and measures put in place with this project
39 that will help manage this. There was comment about clearing;however, it has always been maintained as a lawn
40 and it has been known for some time that a building was planned. Reviewed various materials for the building and
41 reviewed historic site photos. The color scheme is warm and dark gray, black trim around windows, red entry
42 doors.There has been one meeting with Machine Shop Village and a second meeting is scheduled on January 25,

46 J. Simons: This local group lives in the neighborhood and they have a good sense of the history of the area, etc.
47 T.Hartford: Described a relatively neutral, contextual historic color palette and materials.
48 J. Enright: The revised pian need final review by TEC and.DPW. If all concerns are satisfactorily a draft decision
49 may be prepared for the next meeting.
50 Linda Fucca, 4 E. Water Street: Submitted copy of 2015 Traffic Volume Report. Expressed concern for traffic and
51 safety in the area and noted concern for numerous food/beverage truck deliveries(double parking)that occur all
52 day long loading from High Street. Quality of current sidewalks is compromised.
53 J. Simons: The people who own the mills have worked to be good neighbors. We can advise the DPW and the
54 NAPD of your concerns and they can determine if any mitigation can be achieved.

57 DISCUSSIONS
58 1210 Osgood Street. Princeton Properties(residential)and Forgetta Development(commercial): Project status
59 update and Request for an Insubstantial Change for proposed revisions to the stormwater management design,
60 lowering of site grading, and lowering of building elevations.
61 J. Enright: The applicants were granted several special permits a year ago for 196 residential rental units contained
62 in 4 buildings and approximately 43K sf commercial space in 4 separate buildings. The applicant will provide a
63 project status update and request an Insubstantial. Change determination for proposed changes to site plans for
64 drainage design and site grading. The proposed design changes will require a filing with the Conservation
65 Commission and a preliminary review has been conducted by Eggleston Environmental,the peer review
66 consultant for this project.
67 Jeff Brown,Princeton Properties: This is a 14 acre mixed use site(4 acres commercial/1.0 acres residential)in the
68 B2 zoning district.There will be-a bank, combo of retail,restaurant and commercial buildings, shared parking lot
69 and four residential buildings with 192 apartment units. We share the access drive, public sewer and related
70 easements. both parcels received SPR and Parking.Reduction. Special Permit and a Special Permit for a Common
71 Drive. We have worked with MA DOT and residents regarding traffic and intersections. We coordinated with the
72 Town to submit a grant application through State NIA Works which was awarded in the amount of 2.7 million
73 dollars. We are working with DPW to develop sidewalks; 1,000 ft, long southerly to Butcher Boy and 300 ft.
74 northerly. We developed an ANR plan to divide the property as a condition of the permit. We addressed wetland
75 pockets on the south and west of the property with Conservation receiving a permit.When analyzing sewer flow
76 for the project there was approx. 270 ft. of failing sewer line; DPW noted adding flow to suspect pipes would be
77 problematic. We agreed to be a part of the replacement of that piping which is in a resource area and have a
78 separate order for that. We are working through the conditions of the permit prior to obtain our Building Permit
79 this spring.
80 J. Enright: The plans have not yet been endorsed yet nor the decisions. There are a number of conditions that have
81 to be met prior to the endorsement of the plans.
82 J. Brown: It became apparent to us that,to build this property efficiently,we are requesting to lower the elevations
83 across the property entirely by 2-3 ft. The buildings will remain the same height. We are researching how it will
84 effect drainage. The change will result in less fill,truck trips, lessening construction time by 3-4 months and
85 incorporating the natural topography of the site. There are no changes to other features on site.

87 J.Peznola Hancock Associates: There was an existing slope challenge on site. We have flat residential and
88 commercial buildings and want connectivity between thein. We wanted commercial visibility along Osgood St, f
89 and we have to adhere to ADA regulations. There is also fairly high ground water on site setting the elevations.
90 We have incorporated a totally different system to store the water. We now have fewer stormwater systems, a
91 reduction from 13 to 8 structures. We have full buy in from the commercial developer who believes the solution is
92 acceptable.There will be less fill and lower retaining walls. We are changing the type of product yet it is the same
93 approach to stormwater subsurface infiltration.
94 J. Simons: This is absolutely a substantial change. We can expedite the review; however,this has to go to a public
95 hearing. We appreciate the creative thought you've put into this.
96 P.P. Bap: I agree with John;I am delighted to see it.
97 Board: Consensus that this is not an Insubstantial.Change.

101 Framework for Recreational/Commercial Marijuana Zoning Bylaw:
1.02 S. Egan: Reviewed dram edits made since the last meeting. Will incorporate any additional comments and a
103 revised draft will be presented at the January 2, 2018 meeting.
104 Andrew Ma for Town Manaer: Discussed process and scheduling for the Special Town Meeting, There was a
105 Citizen Petition filed with requisite signatures(MA chapter 39 secl0)that compels the Selectmen to hold a
106 meeting within 45 calendar days. The Board of Selectmen(BOS) decided to set the date for the Special Town
107 Meeting on January 30`'. There is a requirement to provide 14 day notice of the warrant. The next BOS meeting is
108 January 8, 2018 when they will open, make amendments, accept the articles presented and close the Town
109 warrant. A couple of articles have been filed already with the requisite signatures. Discussed the status of the
110 bylaw the Board has been working on and the timing as it relates to zoning articles and the public hearing process.
111 Recommended that the Board,should they forward a Warrant article to the BOS in time for the January 8 meeting,
112 hold 3 public hearings consistent with past practice.Notice requirements could be met for public hearing dates of
113 January 9�, 16 and 23; however,those dates require the Planning Board to hold meetings in addition to their
114 regularly scheduled meetings.
115 J. Simons: We need to finalize this at our January 2,2018 meeting.
116 J. Luz: It's possible to work through this bylaw at successive meetings if we need to after publication?
117 Board: Yes, during the hearing process amendments can be made. Agreed to direct the Planner to post the Legal 1
118 Ad for a January 9 public hearing date for the zoning article already submitted as well as the anticipated Marijuana
119 Overlay District article and a Zoning Map amendment article.It is anticipated that the Board will discuss the draft
120 bylaw at the January 2 meeting and move the article to the BOS for inclusion on the Special.Town Meeting
121 warrant. Some Board members expressed they generally felt disappointed that they are subject to a compressed.
122 and heightened deadline.
123 Michael Rosen A &Dan Leary. 1600 Osgood St. LLC: We want to have our provisional RMD certificate of
124 registration by April 1, 2018. That allows priority review. This review accepts the majority of the Management
1.25 Operation Profile and the submissions to the DPH for an expedited review and allows for quicker entry to start
1.26 facility operations June 1, essentially selling July 1. We want tobe a first mover. The DPH has a time estimate of
127 approximately 8 weeks from a completed application, Our goal is to get it in 30 days or less. The Attorney General
12.8 has 90 days to review the certified warrant submitted by the Town Clerk. We suspect this will take 30 days or less
129 because this is a Special Town Meeting. Explained the timing of Attorney General Review and DHP review for

138 1, Enright: Provided an update on the process and presented the latest summary ofthe public forum document,
139 Master Plan Community Engagement-Vision&Goals: Summary of Results,to the Board. The summary will be
140 posted on the website. The next Master Plan Advisory Committee meetings are scheduled on January 4 and 18,
141 2018 at these meeting a Vision Statement will be discussed and recommendations will begin to be formed.
