Notice of Decision Year 2017 Property at: 1503 Osgood Street(Map 034.0,Parcel 007),North Andover,MA 01845 NAME: Hera Development Corporation HEARING(S): November 14,2017, December 12,2017 ADDRESS: 1503 Osgood Street(Map PETITION: 2017-01 034.0,Parcel 007),North Andover,MA 101845 The North Andover Board of Appeals held a public hearing at the Town Hall, 120 Main Street, North Andover, MA on Tuesday, December 12, 2017 at 7:30 PM upon the appeal of Hera Development Corporation located at 1503 Osgood Street(Map 034.0,Parcel 007) North Andover,MA 01845. This is an appeal of the Building Inspector's determination that a self-storage facility is not an allowed use in the CDD3 District. Legal notices were sent to all the certified abutters provided by the Town of North Andover, Assessors Office, and were published in the Eagle-Tribune, a newspaper of general circulation in the Town of North Andover, October 31, 2017, and November 7, 2017. The applicant has requested from the Board to make a Finding as a Party Aggrieved from the Inspector of Buildings also known as the Zoning Enforcement officer determination that a self- storage is not an allowed use in a CDD3. The Board opened a public Hearing on November 14,2017 no evidence presented by the parties. The matter was continued to the December 12,2017 meeting. The Board held a public Hearing on December 12, 2017, and heard evidence presented by the Aggrieved Party Hera Development Corporation by and through their counsel of record and subsequently closed the public hearing. The exhibits of record noted within the filed are incorporated by reference herein. The Board took the following action: Upon a motion by D.Paul Koch, seconded by Allan Cuscia. the Board voted unanimously to overturn the Inspector of Building's determination that a self- storage facility is not allowed in the CDD3 District pursuant to the October 19, 2017 Page 1 of 2 PETMON:2015-003 determination. The Board finds self-storage is an allowed use in the CDD3 District pursuant and subject to the zoning bylaw. The Chairman declared the vote unanimously approved. The following regular voting members were present: Albert P. Manzi III;Ellen McIntyre, Doug Ludgin, D. Paul Koch Jr., and Allan Cuscia. The following Associate member was present Alexandria Jacobs.
