Town of North Andover 120 MainStreet North Andover, MA 01845 Re: 56-58 Church Street, North Andover, MA Dear Mr. Belanger: Reference is made to your letter of May 3, 2017, to my client (copy enclosed), in which you make the following allegation regarding the above-referenced property: The expansion of a Legal Nonconforming use (Two (2) family to a Three (3) family) would require a variance from the Zoning Board of Appeals (ZBA). I enclose a copy of the variance granted by the Zoning Board of Appeals, as evidenced by the meeting minutes of the Board dated July 19, 1971. Contrary to your assertion, the ZBA granted a variance for this properly. Therefore, there is no factual or legal basis for your assertion, or the Cease and Desist Order. Based on the foregoing, we formally request that you rescind or withdraw this Order immediately, failing which my client will consider his legal options, against the Town for violations of his civil rights.
