Dear Members of The North Andover Zoning Board of Appeals, q("YARD OF APPEALS
The meeting on 3/14/17 provided a great deal of information related to proposed design of 2 homes. There were
professionals and family members there discussing this lot as 2 separate lots. We now understand that part of the process
is to present designs to explain why there is a need for a variance.
Our continued concern is why 271 Stevens Street would be considered 2 separate buildable lots.
Mr.Brecher discusses the1963 variance in his application. Yet his present design does not fall into the parameters of the
approved Variance plan from 1963.
How is this non-recorded variance relevant at this point when new borders are being proposed?
The town map shows this as a single lot at.96 acres.
The public notice states requesting to subdivide one lot Into two. It becomes confusing when there is discussion that
implies this already exists as 2 lots.
We have not seen any written proof of 2 separate lots only an approved variance that was not recorded or acted on.
The documentation in the Registry of deeds Book 983 page 258 is reflective of the original 1957 purchase recorded in
1963.
A key point of the application is the hardship involved:
Mr.Brecher's application refers to a decrease in property value for Mr. Melvin if the property is not considered 2 separate
lots. The home was not listed for sale as 2 separate lots. It was listed as a single family home. Please see attached.
A second point of hardship is related to the design and preservation of an older home that to our knowledge has not been
registered as a historical home by the town. If this is a significant concern it Is possible to complete the renovation to the
existing home and preserve and control the aesthetics without subdividing the lot
Since Mr Brecher does not own the property and any expense he has encored at this point have been of his own choice we
do not see any specific hardship to the applicant based on the North Andover Zoning Board By Laws.
Based on our present laws and town requirements the present request involves
substantial modification to the zoning bylaws for residential 3 area.
Lot 1 does not meet the 25,000 sf min lot size.
The present location of the existing home does not meet the front or side yard requirements.
The 75%CBA is not obtained on either proposed lot.
Proposed lot 2 now requesting variance for front setback for 21 feet.
Lot I only becomes nonconforming with the approval of a subdivision.
It is possible to maintain the appropriate lot size and CBA maintaining this property as a single family lot and renovating
the existing home.
We again do not approve this project as 2 lots and hope the Zoning laws will be
maintained as recommended for our residential area.
