Minutes of the North Andover Conservation Commission of December 18, 1985

1. Correspondence:
1. M. Kasabuski -- French Farm Village
He is not responsible for work at French Farm Village.
Re-direct our previous letters of Nov. 25 and Dec. 5 to B. Osgood of
Barker Street Trust. We want an answer to this letter and a schedule
by Jan. 6„ 1986.
2. Coventry Estates - draft copy of peak rates of discharge
3. T. Neve submittal to Planning Board - Jarad Place
T. Peter will send a letter to the Planning Board saying a Notice of Intent
must be filed.

4. Impact Assessment of Soil Overwash on a Wetland situated below the Town
Farm Hill Reservoir in-North Andover, MA., prepared by Frank D. Richardson
for Lally Assocaties. J. Lafond and T. Peter to review.
5. ABC Bus Co, - Overview of schedules submitted, put on Dec. 21st site visit
for field check
6. Planning Board Memo - Abbott Village - Salem Street connection to Nutmeg Lane
7. MVPC Meeting - T. Peter posted the press release
2. Old Business
1. Lot 36 Appleton Street - new plan submitted. Motion by J. Lindon to give this
new plan a negative revised determination, second H. Fink, motion carries.

2. Flagship Drive 242-215 - Mea i n o ratify what was voted at the Dec. 14th
site,visit and to grant a 3 month extension of the Order of Conditions, second
J. Lindon, motion carries.
3. Lot40 Salem Turnpike - Extension - T. Peter will call and ask Mr. Dalton why
he would need an extension if the Order of Conditions expires Nov. 1987.

4. Lot 1 Essex Street - J. Lafond prepared a letter accep. ting calculations per theA Conditior
Due to the fact that possible,wetland violations could have occured, 'the revision
will not be issued until after an inspectiorpf the site on Dec. 21st.
5. North Andover Business Park - T. Peter will ca'a T. Neve and ask him to
answer our letter before Jan. 9, 1986.
6. Lot 51 Salem Street - Plan change needs to be reviewed on Dec.. 21st site visit.
Motion by W. Vicens to empower the site visit team to issue a revised Determin-
ation at the site, second J. Lindon, motion carries.
3. Determination: Abbott Village
Motion by J. Lindon to issue a positive determination on Abbott Village, second
H. Fink, motion carries.
4. Determination': Lot A' Marbleridge Road
Motion by W. Vicens to make a determination tonight despite the fact that the searing
was not re-advertised, second H. Fink, motion carries.
Motion by H. Fink to give a negative determination based on submitted information,
second J. Lindon, motion carries.
5. Public Hearing: Lot 3 Salem Street
Lot' 2 Salem Street
Merrimack Engineering represented the applicant,
Lot 2 was submitted as lot 4. Motion by H. Fink to close the public hearing for
purposes of writing the Order of Conditions within 21 days, -second A . Resca,
motion carries.
6. Enforcement Orders
1. Tucker Farms ( Diversion & ditch)
Enforcement Order had been lifted on Dec. 14th site. visit. Members discussed
an increase of the bond to $17, 000.. 00 because the cost estimate submitted by
the applicant does not include labor for planting and clearing expenses. Loaming
and flow diversion estimates seem low.
A . Resca and H. Fink will draft an amendment to the Order of Conditions to be
voted on Jan, 8th.. This will include the bond amount and replacement schedule.
2, Teoma Estates - Motion by W, Vicens to reject the wetland replacement plan
submitted by Merrimack Engineering, second J. Lindon, motion carries. J.
La fond will send a letter to Merrimack Engineering explaing why it was rejected.

3. Village Woods - T. Peter will send Mr. Foresta a letter confirming that
the Enforcement Order has been lifted on the roadway only. The Enforce-
ment Order still holdsfor the individual lots and will be lifted after a
written decision is made by the Planning Board concerning the Watershed
District Bylaw (4. 133) as well as haybales being placed between all wetland
areas and construction areas, and once they have been approved by NACC,
4. Lot 2 Campbell Road - Motion by J. Lindon to lift the Enforcement Order
second A . Resca, motion carries.
5. Francis Estates - J. Lindon noted lack of erosion control measures at the
site.Work. had taken place before these erosion measures were in place
Motion by J. Lindon to issue an Enforcement Order to stop all work until the
Order of Conditons have been complied with; erosion control in place and
approved by the NACC, second A . Resca, motion carries.
7. Open Space Plan
Letter from T. Peter dated December 17, 1985 to the Steering Committee about
DEM's Bay Circuit Program. If Tracy does not get a response from Joel Szabat
by the New Year she will follow up on it.
8. Order Of Conditions; Lot 5 Berkeley Road
Lot 6 Berkeley Road
Motion by W. Vicens to accept the draft Order of Conditons as amended, second
J. Lindon, motion carries.
9. School Site
T. Peter and J. Lafond met with School Superintendent Dr. Bernal and Principal
Mr. Gabel of the Atkinson School.. J. Lafond requeste•dthat the School Committee
submit a plan to the NACC which shows the best location:. for a new school, 'once
this is submitted the NACC will research for the. best available land close to. this location
suitable forconstruction of a school. T. Peter and J. Lafond will meet with both ur. Bernal
and Mr. Gabel after the new year.
10. Oakwood
In response to a subdivision plan submitted to the Planning Board, -the NACC
is requesting that the ,Planning ,Board require the developer to fiie.for a request
for determination. T. Peter noted a wetland area on the site on Dec. 17, 1985.
11. Site Visit - Saturday December 21, 1985
