I,,ot 2223 Forest. Street - Notice of Enforcement Order Violation
Phil Christiansen represented owner and stated that a vegetated
wetland had been altered. Bob Mansour motioned to rescind the
Notice of Enforcement Order Violation for the purpose of going
back to our original Enforcement Order, C. Lowery second,
motion carried. A. Resca oposed. (Wetland replacement Calan
coning before 'nerd meeting.

Possible shut down because of a long delay.
Plaza 1060 - Enforcement Order

Mark Henry a representative, appeared before the board, utterly
astounded at our Enforcement Order. The Board explained to him the
reason why it was necessary. He thoughthe had a grandfather situation.
I.,. Bruinooge motioned to have staked hay bales installed and approved
by T. Peter. Once hay bales are installed and inspected, the work can
commence inside the building only but Enforcement Order on the site will
remain until Order of Conditions Aave been issued. B. Maneour second,
motion carries.
Osgood Dill - Determination,
Tori Neve represented client, Osgood Mill Associates. T. Neve presented
plans regarding watermain installation with no work in waterway or
enbankment. Members spoke of this Determination as needing Conditions.
Bob Mansour motion to close public hearing and take matter under advisement.
Lot 47A - Salem street - Determination
Mr. & Mrs. Norman Farr appeared before the board. (Property is owned by
Farr Better Homes) Board suggested to the Farr's that a Notice of Intent
be filed for the driveway and house together rather than separately.
L. Bruinooge motioned to close public �earing and take matter under
advisement. Bob Mansour second, motion carried.

Lots 34A-1 and 34B-1 Carlton Lane - Public Hearinas
Tom Neve represented General Store Trust, B. Osgood trustee. The
project consists of building two homes and driveways. Detailed wetland
replacement was presented as required by the NACC. The IEP has been
hired regarding altering of wetlands and wetland replacement. T. Peter
to write letter to Board of Health for waiver Title 5 set back. An
abuttor Jeffrey Vol maims there are more wetlands on site than shown
on the plan. C. Lowery motion to Close public hearing and take matter
under advisement and issue Order of Conditions within twenty-one days.
To be placed on Board of Health's Agenda for July 31st;. Time is of
the essence to us and to have them notify us in writing of their decision.
The matter is urgent.
Lot 3 Mill Road - Public Hearing
This is an old house built in 1725 of Colonial Style'. located on Clark
Street to be moved to a new location on Mill Street. Nathan Benotes
of Essex Realty Trust in Newburyport presented plans. C. Lowery motioned
to close public hearing on Lot 3 Mill Road and issue Order of Conditions
within twenty-one days. L. Bruinooge second, motion carried.
Yellow Maize - Public Hearing
Tom Neve again represented applicant, John Tuttle and presented plans
showing sewer easement through a wetland and for the purpose of building
six homes. Bob Mansour motion to close public hearing on Yellow Maize
take matter under advisement and issue Order of Conditions within twenty-
one days. A. Resca secon4 motion carried.
Lot 3 Marblerid a Road

B. Mansour motioned to accept erosion control plan and reference it in
the negative determination. A. Resca second, motion carried.
Lot 33-Greenwood East Enforcement Order
B. Mansour motioned to lift Enforcement Order. C. Lowery second, A.Resca
opposed - J. Lindon approved. Motion carried.
Lot 2 Carlton Farms/29 Johnnycake
Enforcement Order sent out July 19th, as yet no reply. To be put on
next week' s Agenda.
926 Forest Street - Site Visit
During site visit Mr. Lon�,Lreil, owner, agreed to hire an engineer to help
restore wetlands. Catherine Lowery to write letter to" that effect.

Request to waiver of the 5,000 square feet compensatory wetland area

motioned to ask Mr. Janusz to stop all work until Condtions #130 149
16 and 18 have been complied with. A. Resca second, motion carried. T.
Peter to write to Janusz.
Meadows-Site Visit
By far this is the worst occurrance of an -encroachment of a wetland in
North Andover. The filling that took place is of the worst type-old
cement structures. In a quandary as to where to begin. The wetland
connection will be replaced. Want fill pulled back, regraded and wetlands
replaced. Refer to IEP Wetland Map #108C. Jack Lindon will send letter
to Mr. Meadows with carbon copies to Keith Bergman, Executive Secretary,
Town Counsel, MerrimackEngineer, Steve Stapinski of Merrimack.
Lot 1 Berry Street - Order of Conditions #242-356
Worked on this Order of Conditions which was a denial.
Blue Ride Road - Compliance Request
A. Resca motioned that approval of Lot Line change on Blue Ridge Road
from 26B to 26C Blue Ridge Road is insignificant and therefore, the
Compliance issued on Dec. 16, 1985 should be re-written as 26C Blue
Ridge Road. C. Lowery second, motion carries.
