Minutes of Meeting of August 13, 1986

Oakwood Estates
Lot 9 - Jack Lindon motioned to ratify the Enforcement Order. C. Lowery second,
motion carries.
Meadows Property - Violation
Mr. Meadows was present, he has hired attorney of John J. Willis
who was his spokesmen, Problem: Filling of Wetlands going on for years.
Mr. Willis proceded to give a history of this area. It seems that way back
the Board of Health did give Mr. Meadows permission to dump (Not garbage) but
fill. In December 1985 the NACC issued a Cease and Desist Order. , .
In March of this year (1986) Mr. Meadows hired an
Engineer from. Merrimac Engineering, namely Mr. Steve Stapinskyp'
W. Vicens stated that this problem has existed since 1974, in violation of
G.L.c. 1.31, Chapter 40 of the Massachusetts Wetlands Protection Act.
Much discussion took place as to where the wetlands begin as the filling has
completely covered the area. Mr.Will..is does not agree ` with our
IEP wetlands maps. The NACC will review this situation at a future meeting.
Jerad Place I
Mr. Jeness attended meeting and presented the problem with Lot 10. J. Lindon
had inspected the dams and fabric fencing. T. Neve is working on the replacement
plans, he did not attend mtg. Mr.. Jeness requested to work on the utilities and
the burial. of stumps etc. The Board requested that placement of erosion control
be placedaround this area. J. Lindon motioned to allow the burial of stumps and
rocks with erosion control in place. A. Resca second, motion carried.
Holt Road/Clark Street - Public Hearing
Mr. Peter Samaris, architect of 40 Rogers Road, Haverhill., represented owner
attended meeting. The plan is to add to an already built building. He requested
input from the Board on wetland determination in the area. A site visit will be
made by the Board to establish wetlands. A letter of extension for time was
requested by the board . A letter to that effect will be corning into the office.

continuation of Holt Road/Clark Street - Public Hearing
Jack Lindon motioned to close public hearing on Holt Road and Clark Street
Determination. By Next Wednesday nite a determination will have been made
on this site. (August 20th)
203 Granville Lane - Swimming Pool - Determination
The applicant Mr. Manchini presented his request and the work to be done in
relation to the swimming pool at this site. A 17' x 34' x 8' deep pool and
at the farthest end of pool he is 60 feet from a wetland. A site visit will be
made. The Board requested that they put in erosion control around the area.
Jack Lindon motion to close public hearing, make a site visit in order to make
a determination. Catherine Lowry second, motion carried.
Trombly Buse Site - Town House Condominiums Public Hearing
On the Trombly Bus Site a complex of 39 townhouses complex. Jim Hyde their attorney
and Mike Juliano engineer presented the plan for T.M. Associates from Peabody, MA
They want to call the complex Abbott Village, but the Board requested another name
as North Andover already has an Abbott Village. They agreed to change the name.
The complex consists of 8.3 acres approximatly 3.5 acres are designated wetlands per
vegetation.
Beside the construction of the townhouses they propose driveways, swales, pipes,
headwalls, rip rap dissipator, vegetated cover and hydroseeding along with sewers.
Jack Lindon motion to close public hearing on Trombly Bus Site for the purpose
of construction of 39 townhouse condominiums for the purpose of issuing Order of
Conditions within 21 days. Lois Bruinooge second, motion carried.

Coventry Estates II,-A (South Bradford Street) Public Hearing
Scott Moorehead represented Beta International presented an over-view plan. The
plan is for 74 house lots, 28 of which would face South Bradford Street. A discussion
of great length took place. The Board requested from Beta an Agreement on Tree
Cutting, also a letter statingA of by lot. A request was also made for a letter
giving NACC one week extension on utilities due August 27th.
Jack Lindon motioned to continue public hearing for Phase 2A with an Order of
Condtions to be issued three weeks from August 27th, assuming we get the additional
information requested by 8/27. L. Bruinooge second, motion carried. An agreement
for land in the Green Belt was mentioned.
Tucker Farms
At last weeks meeting it was established that work could not go on in this area
without received from Forbes Realty a bond. We received a check for $23,000
that had not been certified by a bank, thus until this matter was straightened out
or Enforcement Orders would be going out from NACC on Tucker Farms.

Continuation of Tucker Farms
If the certified check is not in the office by 4:30 on Thursday, 8/14/86
an Enforcement Order on Lots 1-6 will be issued reading "Stop all work on
houses, until a bond is accepted and approved by the North Andover Treasurer!'
We also want a report on swales built but not finished on Lots 9, 10,11, 12 and 13.
Bi-weekly progress reports either verbal or in writing.
Also, to invite James Philbin and Thomas Laudani to our next board meeting.
AaI n�oostop all work that is non-swale, non-vegetation work, non-wetland
replacements. B.Mansour abstained, Motion carried.
Deerfield Lane
Phil Christiansen and Mr. Young attended meeting. B. Mansour motioned
to accept revised plans as presented to satisfy Conditions,Aft 4a., 14b,
14C and 18. A. Resca- opposed; C. Lowery second, motion carried.
North Andover Business Park
James Bourgois of Channel and Robert Webster attended meeting. Bayfield Circle
to be completed by October 15th. Lot 5 Acceptable plan for revegetating destroyed
wetland - future filing forthcoming extention onto building - replacement area
will not be constructed until a final plan is decided on by the NACC Lot 8 -
Plan accepted and replacement completed by September 15th. Jack Lindon motioned
to accept scheme subject to the wetland area be completed first and any other
work be completed by September 15th. C. Lowery second, motion carries.
Enforcement Order on Lot 5 was lifted.
Regarding Lot 8 - Roadway to be staked as filling of wetland is taking place.
J. Lindon motion to accept plans for the replacement area to be finished by Sept. 15 th-
The area is 3,000 square feet. A. Resca second, motion carries.
Chestnut Green DEQE 242-243
A Replacement Plan that had been turned down in the past. J. Lindon approved the
revised plan dated April 1986 with the provision that the wetland area by completed
by Oct. 15th. Total fill is 4,000. Jack Lindon to write letter. Arthur Resca
second, motion carried.
Great Pond Estates - Discussion
Order of Conditions issued next week. After a lot of discussion the Board came
to 3 options to what to do on this site: 1. Accept T. Neve's Plan-2.Prepare
detailed Order 'of. Conditions, and 3. Deny. 'A poll<of the members indicated:
4 for Conditions and 2 for Denial.

second, motion varied.
An extension request for one year for Osgood Street, General Store Realty Trust
File #242-182 a motion made by Bob Mansour. A. Resca second, motion carried.
