HomeMy WebLinkAboutWaiver - 500 GREAT POND ROAD 8/1/2017 The M6rin-Cameron August 1, 2017 Zoning Board of Appeals 120 Main Street North Andover, MA 01845 Re: Variance— Patio/Fire Pit and Retaining Wall 500 Great Pend Road (Assessors Map 63, Parcel 12) Owner/Applicant: North Andover Country Club Gear Board Members: On behalf of the Forth Andover Country Club our office has submitted a variance application for the construction of a patio/fire pit with associated landscaped areas and retaining wall within the Ikon-Disturbance Zone associated with Lake Cochichewick. This application is scheduled to be heard at your regularly scheduled meeting on Tuesday, August 8t". The property is located within the Residence 1 (R-1) Zoning district as well as the Watershed Protection District. The proposed patio is located within the non-disturbance zone associated with Lake Cochichewick, therefore, a Special Permit from the Planning Board is required. Usually a patio is not considered a structure, however, since a portion of the proposed patio is elevated the Building Inspector has ruled that it is considered a structure, therefore requiring a variance from the Zoning Board of Appeals for a new permanent structure within the non-disturbance zone pursuant to Section 4.136(3)(c)(ii)(3) of the Town of North Andover Zoning Bylaw. This project would be considered a Minor Project as outlined in the Procedure & Requirements for an Application for a Variance. One of the plan criteria is that the plan needs to be prepared in accordance with the Registry of Deeds standards so that the plan can be recorded at the Registry. In order to prepare a plan that meets the standards of the Registry of Deeds additional field work and plan work would be required from what is normally required for a project of this type. The variance is required because approximately half of the patio requires fill to level the patio area. At the highest point the fill is approximately 30 inches high. Based on the minor nature of the project we are requesting that the requirement for the recordable plan be waived. We would recommend that if the Board voted to grant the variance we would attach the design plan as an EXHIBIT to the decision so that when the decision is recorded the design plan would be recorded with it. The plan is then recorded with the decision achieving the same goal as a recordable plan would.
