Facts &Findings:
Wetland resource areas jurisdictional under the Massachusetts Wetland Protection Act(WPA) and/or the
North Andover Wetland Protection Bylaw(Bylaw)within the subject parcel include Bordering Vegetated
Wetland(BVW)and the associated 100-foot Buffer Zone and Ephemeral/Potential Vernal Pools.The wetland
resource areas were delineated by Norse Environmental Services,Inc. in October of 2014.Jennifer Hughes,
Conservation Administrator,reviewed the BVW delineation on April 25,2017. At that time,
Ephemeral/Potential Vernal Pools were identified. Norse Environmental delineated the extent of these pools
and reviewed therm with the Conservation Administrator on May 23, 2017.Wetland resource areas were
revised slightly and now include the following flags:
BVW Flags 6D through 49D connecting to Flags 1A and 2A.Wetland flags on the back side of the property and
those placed off-property were not confirmed. Ephemeral/Potential Vernal Pool flags include 1A through 13A
and 1 B through 11B including flags 3B1 and 3B2
The Conservation Commission notes that there is historic/unauthorized dumping of soil, trash and debris in
the area of Ephemeral Pool flag 113. Any future filing will require the removal of soil, trash and debris in the
BVW and the associated No-Disturbance Zone as well as a restoration planting plan for the impacted wetland
resource areas. The commission may require the removal and restoration of the area under an enforcement
action if no filing is received for the property prior to the November 29,2017 meeting of the North Andover
Conservation Commission.

MEMORANDUM IN SUPPORT OF PETITION FOR VARIANCES
I. INTRODUCTION
The Petitioners,Michael Donovan,Thomas Donovan and Cornelius Donovan
("Applicants"),are requesting a variance for certain properties (collectively,the
"Property") known as 460 Boxford Street,500 Boxford Street and 530 Boxford Street(ie,
Map 105.C,Parcels 41,42 and 43)which are owned Michael Donovan, Thomas
Donovan and Cornelius Donovan,respectively,as such land would be reconfigured,
and so as to allow for a lot line adjustment between the said properties to reconfigure
three (3) existing lots of record into two (2)new buildable lots of record. Specifically,the
Applicants are seeking relief from Section 7.1.1 of the Zoning Bylaw of the Town of
North Andover,as amended(the"Zoning Bylaw") in the form of variances for
contiguous buildable area.
The properties as they presently exist include three (3) parcels,of which two (2)
parcels are vacant land and one (1) parcel has been improved with an existing
residential dwelling structure,constructed circa 1920, as per North Andover Assessor
records (see Assessor Card attached hereto as Exhibit A.) Each of the lots as presently
configured complied with all dimensional requirements for purposes of zoning at the

time they were created in 1977,as reflected on Plan No. 7580 recorded with the Essex
North District Registry of Deeds (see copy of plan attached hereto as Exhibit B.)
Subsequent zoning changes,however, increased the minimum lot size such that the lots
became pre-existing nonconforming lots as to lot size. In addition,contiguous buildable
area (CBA) requirements,which did not exist when the lots were originally created in
1977,were also subsequently adopted.
There are some protections which might be afforded or available for
grandfathering protection of the lots,or at least certain of the lots,with respect to both
CBA and/or lot size under the Zoning Bylaw and other statutory law and case law. But,
regardless of any possible arguments for pre-existing lawful nonconforming status,
there are nonetheless other site constraints which would render the lots,or certain of
them,unbuildable in their present configuration,including wetlands constraints and the
need to site septic systems. (See Order of Resource Area Delineation and wetlands
flagging as delineated on Variance Plan submitted with this apphcation.)As a result,and
regardless of any possible grandfathering protections for the existing lots in their
present configuration,the Applicants have proposed and desire to combine the three (3)
existing lots into two (2) more conforming lots,which would each comply with all
current dimensional zoning requirements in the R-1 zoning district with the exception of
CBA,and to seek issuance of variances from CBA requirements for the two (2)newly
configured lots to allow for the razing of the existing structure and development of two
new single family homes.
11. BACKGROUND
Michael Donovan is the owner of land identified as 460 Boxford Street,which is
currently vacant land and is designated on the Town of North Andover Assessors Maps
as Map 105C, Lot 41. Michael Donovan acquired the land by a Deed, dated January 5,
1992,and recorded with the Essex North Registry of Deeds at Book 3651,Page 117.
Thomas Donovan is the owner of land identified as 500 Boxford Street,which is
presently improved with an existing residential structure and is designated on the Town
of North Andover Assessors Maps as Map 105C,Lot 42. Thomas Donovan acquired the
land by a Deed, dated January 5, 1992,and recorded with the Essex North Registry of
Deeds at Book 3651,Page 118. Cornelius Donovan is the owner of land identified as 530
Boxford Street,which is currently vacant land and is designated on the Town of North
Andover Assessors Maps as Map 105C,Lot 43. Cornelius Donovan acquired the land by
a Deed, dated January 5,1992, and recorded with the Essex North Registry of Deeds at
Book 3651, Page 119.A copy of the referenced deeds are included with flus application.

by: Andover Consultants Inc. (the "Plan') included with this application. The Plan is
intended to serve as both a so-called "ANR Plan" or"Approval Not Required Plan" to
be filed with the Planning Board, as well as a variance plan to accompany this variance
application. Upon obtaining approval of the proposed variance,the Plan would also
then be submitted to the Planning Board with a"Form A" Application to seek approval
of the lot line adjustment by the Planning Board.
The Property, as it presently exists and prior to the proposed lot line adjustment
as shown on the Plan,consists of: "Lot B" which is 58,200 square feet in size, "Lot C"
which is 78,420 square feet in size and"Lot D" which is 45,740 square feet in size. Upon
completing the proposed lot line adjustment and land swap as contemplated and shown
on the Plan,the Property would consist of: "Lot 1" which is 91,866 square feet in size
and"Lot 2" which is 90,641 square feet in size. The Property is located in the Residence
1 ("R-1") Zoning District and each of the two (2) proposed lots comply with or will
comply with all current dimensional zoning requirements,with the exception of
contiguous buildable area ("CBA"). It is noted that the CBA requirement may not apply
to the existing lots of record (presently configured as pre-existing nonconforming lots),
to the extent that they were created prior to 1986.Section 7.1.1 of the Zoning Bylaw
provides that for lots created as of April 28,1986,75% of the minimum lot area required
for zoning shall be contiguous buildable area (ie,exclusive of wetland resource areas.)
While this requirement may not apply to the three (3) existing lots of record to the extent
that they were pre-existing lots as of April 28,1986, as reconfigured new lots would be
created subsequent to 1986 and any grandfathering protection would be lost. As such,
variances would be required. Upon reconfiguration,the contiguous buildable area of
proposed new Lot 1 would be 33,891 square feet where 65,340 square feet would be
required (ie,51.86% CBA where 75%would be required),and the contiguous buildable
area of proposed new Lot 2 would be 30,079 square feet where 65,340 square feet would
be required (ie,46.03% CBA where 75%would be required).
It is noted that the Applicants have already obtained necessary approvals for
septic systems on each of the two (2) proposed new lots from the Board of Health.
Copies of the septic plans for both Lot 1 and Lot 2 are attached hereto as Exhibit C.
Assuming that the approval of the ZBA were obtained for necessary variances,the
Applicants would still then be required to obtain all other necessary approvals for the
proposed project,including without limitation Planning Board approval of the ANR
Plan for lot reconfiguration and all necessary Conservation Commission approvals and
orders of condition which will be required,as the Property and proposed project would
remain subject to jurisdiction of the Conservation Commission. Further,with respect to
drainage concerns,the Applicant would propose to add gutters and will construct
grading consistent with the approved septic plans. The Applicant will also be required
to construct the erosion controls as shown on the septic plans. As the project will remain
subject to Conservation Commission review,the Applicant would also complete any
other storm water or other drainage mitigation controls in accordance with and as might
be required by in connection with the issuance of any orders of condition for the project.

III. DISCUSSION
As noted above,the Petitioners are requesting dimensional variances for
contiguous buildable area for a new lot configuration which is proposed to be created as
a result of a proposed lot line adjustment. Specifically,variances are being requested
from Section 7.1.1 of the Zoning Bylaw.
With respect to contiguous buildable area (Section 7.1.1), a variance is being
requested of 23.14%for contiguous buildable area of Lot 1 and a variance of 28.97% for
contiguous buildable area of Lot 2. Whereas the minimum contiguous buildable area
required for a newly created lot is 75% of the required minimum lot area,the contiguous
buildable area of the proposed new lot would only be 51.86% of the required minimum
lot area for Lot 1 and only 46.03% of the required minimum lot area for Lot 2.
IV. BASIS FOR VARIANCE
The Petitioner's proposed variance meets all of the conditions for granting of a
variance,and each of the required elements A through F appearing in Section 9 of the
Variance Application are addressed in this application,including as follows:
A. Tly particular use proposed for the Iaiid or structure: The proposed use for the
land will be for single family residence which is an allowed use in the R-1
zone,and further,is the current and existing use of the property (or at least a
portion thereof to the extent there is currently one residential structure on a
portion of the Property.).
B. The circumstances relaft to soil conditions sha a or tWQgraphj1 of such land or
structures especially a clbig tlwe ro erh or which t1w Variance is sought 7vhich do
riot affect gewrally the zoning district in which the propeLh is located: There are
substantial wetlands on the Property which is a soil condition affecting
development opportunities. The Property when originally subdivided into
the existing three (3)lots of record was not as substantially wet as it is
presently. Subsequent filling on adjacent lands and development of abutting
properties,including development of Duncan Drive,resulted in further
impact to soils increasing the wetlands. The proposed lot configuration,in
addition to increasing lot sizes (ie,creating two larger lots from the three
smaller existing lots of record) and making the new lots more conforming
than the existing lots,the newly configured lots (with benefit of the
variances) would allow for razing an old existing structure which is close to
the street and to eliminate any existing front setback violations for the
existing structure (which would be grandfathered w1d protected as pre-
existing lawful nonconforming structure) and provide for compliance with
current setback requirements.

two landowners (Michael Donovan, Map 105C,Lot 41) and Cornelius
Donovan(Map 105C,Lot 43) to likely develop their properties which would
likely be rendered unbuildable,and thus create a substantial financial
hardship and near total economic loss. It is noted that each of the three
parcels has been historically assessed and taxed by the Town as a buildable
lot. In fact,since the death of their mother,Catherine Donovan,the
Applicants have paid a total of approximately$117,877.21 in taxes since 2003

Granting the variance will not derogate from the intent or purpose of the
Zoning Bylaw because the proposed use is a permitted use in the R-1 zone
and existing front setback nonconformities will be eliminated ant the parcels
will be made more conforming to zoning requirements than presently exists.
The pre-existing home on the lot which does not comply with current zoning
setbacks would be razed and a newer and more conforming homes,
consistent with other properties in the neighborhood,would be constructed.
