26 Acting Chairman Simons called the meeting to order at approximately 6:15 pm. The
27 Board would not hear Article 50—Omnibus Street Acceptance tonight as they are waiting
28 for Attorney McGravey to advise if all of the pertinent paperwork has been submitted and
29 reviewed accordingly relative to Article 50.

34 1. Article 50 - Omnibus Street Acceptance. To see if the Town will vote to accept
35 Bayfield Drive, Flagship Drive, Willow Street, and Willow Street (South) Extension as
36 public ways and to authorize the Board of Selectmen to acquire by eminent domain, gift,
37 purchase or otherwise any fee, easement or other interest in the above listed streets and
38 any easements. Petition of North Andover Board of Selectmen. Lincoln recommended
39 that article 50 be tabled. To be continued until tomorrow.

43 2. Article 34 — Petition the General Court — Enact General Bylaw, Machine Shop Village
44 Neighborhood Conservation District Bylaw Chapter 134, Neighborhood Conservation

I PB asked how does this warrant article impact the High Street (former Davis & Furber
2 mill buildings)? Chair is going on record as not supporting this article.
3 PB wants to take the time to read this article. Table this until the PB meeting of May 14,
4 Liz Fennessey to present to the PB.

6 Liz Fennessey was present tonight. Wants this proposed bylaw enforced, as it's less
7 restrictive then the"Old Center Bylaw".

9 Liz conducted neighborhood meetings in order to inform citizens of the intention of
10 the proposed bylaw relative to Machine Shop Village on September of 05,
11 November of 06 and February of 07. Liz also distributed over 300+packets door-
12 to-door containing what the intention of Article 34 is and asking for feedback for
13 her committee. The wording in the proposed bylaw is pertinent relative to the
14 feedback discussions.

16 The Board discussed issues relative to exchanging exterior doors, windows, vinyl
17 siding, hedges, etc. and what would be subject to a formal review by the
18 Community Development management staff and the Planning Board and what
19 would be exempt from the zoning review process.

21 Liz stated that her committee wants to stop the big changes that occur, however,
22 wants this bylaw to be user friendly. Liz stated that her committee couldn't govern
23 use; this bylaw is all about appearance.

25 It was noted that Attorney John Smolak is representing the owner's of the property
26 located at High Street.

28 PB thinks it's a good idea to protect the historical aspect that the Town has now.
29 However, the PB feels that Machine Shop Village Committee should not have the
30 ability to overrule various things that are controlled by law such as a handicapped
31 ramp, etc. (See the Warrant for more explanation of Article 34. ) Motion by
32 Richard Rowen, 2"`l by John Simons to recommend favorable action on Article 34,
33 vote was unanimous 5-0.

37 3. Article 38—Amend General Bylaw Insert New Chapter—Chapter 82---Demolition
38 Delay. This article would allow for delays of demolition up to 15 months to buildings
39 such as 75 years old. PB is to read this bylaw, because as the bylaw is written Chair
40 would not support it. SOS recommended unfavorable action on this bylaw. Table
41 this until the PB meeting on May 14. Kathleen Szyska to present to the PB.

43 Kathleen stated that the intent of Article 38 is to protect the architecture in the
44 Town of North Andover. Kathleen informed the PB of various structures that were
45 slated for demolition such as the Holt house formerly located on Marbleridge Road;
46 the farmhouse located on Rte 11.4 next to the nursing home property should not be

I demolished. It was written into the original deed that the owner would keep the
2 exterior the same, however, the owner came to the PB asking to demolish this
3 particular house. French Farm house and barn next door to Treadwell's (1003
4 Osgood St.) she heard that Joe Levis was going to demolish the house and save the
5 barn.

7 The BOS voted not to support this bylaw. They said they didn't like the long time
8 period and the houses were too young. Kathy did change the wording on the
9 warrant; it now reads that it's for homes which are 100 years or older and
10 demolition delay is down to 12 months. Homes have to be 100 years old and listed on
11 national register of historic places, and buildings are found to be eligible for
12 national register, or building is associated with social history of our Town (see
13 Warrant for more information).

15 In order for the process to work Kathy would submit a list of homes of certain age
16 to Gerry Brown, Building Commissioner, if a demolition request comes in he has 7
17 days to notify Kathy. The committee has 30 days to determine if this is a historic
18 house. They need 30 days to schedule a public hearing, after 30 days is up the
19 committee has 14 days to make a decision. Almost 75 days can transpire to trigger
20 this demolition permit. Committee cannot veto the process. 120 cities and town's
21 throughout the Commonwealth have this type of bylaw. Template is molded after
22 100-year-old houses. Kathy has a list of homes of a certain architectural style over
23 100+years old the homes are inventoried and listed on a "Form B". Ellis Court off
24 Main Street was built in approximately the 1800 they are earlier than Machine Shop
25 Village houses; they were in terrible condition, so the Committee would have signed
26 off on a demolition permit on them. Linda Trombley was present and in favor of
27 this bylaw.

29 PB thinks these are good planning tools to keep in place and should be included in
30 our Master Plan. Motion by Alberto Angles, 2`1 by Richard Rowen to recommend
31 favorable action as amended tonight, such as 100 years and 12 months, vote was
32 unanimous 5-0.

34 Motion by Richard Rowen, 2'"'' by Jennifer Kusek to adjourn tonight meeting at
35 approximately 7:00 pm, vote was unanimous 5-0.
