Minutes of meeting : Wednesday, 23 January 1974.
Present : Members Trombly, Re sc:a, Lewis , Chepulis , La end.
Assoc ® Rember Worthen.
Absent : Members J) ' Angelo, Kittredge , Assoc . Members Turano, Fink.
1. Cala to Order at 7:35 PM
4 No minutes for previous meeting presented.
3. Voucher submitted by Mrs„ Trombly for 357. 24 accepted for
payment.
4. ,Sutton Mill fond
Presentation by Atty. Dom Scalise and an engineer for Charles
Matses of West :Boxford of preliminary data regarding a project
to fill Sutton Mill Pond. Intent is to partially fill the pond
.from Outon Street to the "Dizzy" bridge , providing new channel
for Cochichewick Brook. Diagram of new sluicegate shown„ Pond
no longer serves any mill, current gates in lack of repair.
The engineer was lent a copy of the Steven' s Pond Townhouse Notice
of Intent , the NACC form of information to file , and a Notice
of Intent farm. 1:t was also requested that the engineer try to
obtain a copy of a Camp, Dresser, McKee; study recently done on
Cochichewick Brook (done for the state in connection with place-
ment of a culvert downstream) . Additional.. information requested
included a cross-section of completed pond fill area, cross-
section of new proposed channel , and a cross—section of brook
downstream on property of ,same developer.
3. Steven' s Fond Townhouse Order of Conditions .
In that neither Hr. D 'Anl elo nor Mr. Turano were present , a.
motion was made to delay drawing up the final Orders until Tues. ,
9 January when one or both of these members could attend .
6. Self—help Applications. Mr. Resca will present applications
for land acquisition on Salem and forest Streets at the next
meeting®
7. Dr. Donaldson - Button Place .
MEmbers felt that this problem was not clear-cut; and probably
would not fall under the Wetlands Act. Ifowever, it was decided
to request a determination from the DNR regional representative .
8. Salem Gardens Chester Sullivans
New plans and calculations were sent with a letter from Atty.
:David Bart advising that DNR had informed them that this property
did not come under_, the Batch Act. It was decided to contact
DNR regarding this matter, reiterating the many irregularities

of the case up to date . Included among these irregularities
were to be the following : Plans incently submitted as copies of
official Planning Board plans (approved) did not agree with
those on file with the Planning Board ; no notification was given
NACC by DNR regarding the Wetlands deteinination ; althougli
percolation test data was submitted to NACC , Mr. Gelinas informed
NACC that no septic permits had been issued for the back lots .
