Minutes of Conservation Commission Meeting on 'Thursday evening, April 24, 1975
Present and voting, Mrs. Patricia C. Trembly, Chairperson; William Chepulis; Vincent
Turano; Joseph D'Angelo- Marjorie V. Kittredge.; Arthur Resca; Leo Lafond; Asso. Member,

The meeting was called to order at 7:�45 P-M-
Pers. Trembly rioted -the following items on the Town Warrant.#
Item 10 is the Advisory Board's Budget — which they almost doubled,
The Conservation Commission Budget was out down to $500 for salaries and $1300 for
expenses,
Article 14. and Article 15 dealing with the Environmental. Control District and Cluster
Dwelling — Mr. Chepulis asked for any discussion pertaining to these — there was no
discussions
Article 17 (by Con. Com.) to acquire Campion Hall or any part of it, Gayton Osgood
and Mrs. Trembly spoke with the Selectmen, The Selectmen suggested withdrawing the
Article and waiting to see what Thomas Construction does rather than putting in a
figure* From the standpoint of the Commission, if we put in too low a figure and the
judge awarded a higher figure we would have to pay the difference and it would put the
Town in a bad light. J'. Cushing thought it should be tabled rather than withdrawn
because anc.e it is withdrawn we can never recoup it, Mrs. Kittredge agreed that tabling
the Article would be a good idea. Mr. Resoa felt it should be held until the end.,
Neredith & Grew advised that, if, for some reason, the articles were not acted upon on
April 26, 1975 they would extend the option past the April 30th deadline until, such
time as they are acted upon* Mr. Chepulis' opinion was that there would be no advan—
tage to tabling the matter.
Mr. Turano made a motion that -the Chairman request Town Meeting totable the matter
until after Article 85 and Mrs. Kittredge seconded. The vote was unanimous.
Article 18 has to be amended to exclude eminent domain and include easement, 50, right
of way to be left -to the original owner. This parcel was recommended in all regional
and local plans for acquisition. Mr. DOAngelo to speak on this. Joseph Cushing made
the observation 'that the Commission should play heavily on the fact that obtaining this
land is to protect the Lake inasmuch as Ray's Pond is contiguous with it.
Article 19 — Globe Property. Mrs, Kittredge said that the Cora. Como in Boxford will

,work with us as much as they can, but they cannot put it in their Warrant at this time.
Mr. Turano made a motion to withdraw the Article and state that our intention is to
pursue the acquisition of the property. Much discussion ensued as to whether or not to
withdraw. Mar. Resca thought the Commission was backing down. The motion received a
second from h1r. D'Angelo and the vote was unanimous.
Article 20 Conservation Fund; being able to have money available on short notice is useful.
.Article 61 Scenic Roads — Ted Leland, 254 Great Pond Rd., requested the support of the
Commission. Mr. Chepulis questioned what could be done under this law. Mr. Leland said
that many of the normal things can be done but they would Like the road to stay rough
not straightened or flattened or widened. Keep it rural and discourage- commercial
traffic.
Mrs. Manzi, 440 Great Pond Rd., commented that these roads have true historic value and
are worth preserving.
Mr. D'Angelo stated that any improvement on a State Aid road, which Great Pond Rd. is,
must have approval of the Dept. of Public Works. The landowners are notified and have
all kinds of opportunity for input. He mentioned that he was giving this information as
an individual, road builder and engineer.
Mr. Turano said that, for the most part, he goes along with Scenic Roads but Great Pond
Rd. has a number of safety problems and wondered if they had looked into the number of
accidents. Mr. Leland said there have been no fatalities and approximately 3 accidents
at the corner near his house? this was not a documented figure from the Police Dept.,
however.
Mr. Turano made a motion that the Commission direct the Chairman to voice support for
this article at Town Meeting, Votes Mr. Chepulis abstained, all other members were
in favor.
Earth Removal -- Article 30: a motion was made by Mr. Turano that the Chairman recommend
passage of the new By- Law at Town Meeting. Mr. D'Angelo seconded and the vote was
unanimous.
Sanitary Landfill — Article 50; Mr. Cyr has agreed to work with the Commission in
developing plans for the land. The landfill will be used for the overflow from the
Greater Lawrence Sanitary Distract. It is on tom owned land and will be worked out so
that the ConCom can step in and gradually use it for recreation purposes. A motion was
made by Mr. Turano that the Commission has no objection to this site for a sanitary
landfill and commend Mr. Cyr with a letter for his efforts in working with a committee
for this purpose. Mr. D'Angelo seconded and the vote was unanimous.
WETLANDS CASES:
Letter from Mrs. Armitage Re Appledore was received and portions were read. This type of
community interest should be encouraged, said Mrs. Trombly. The letter is on file in the
Commission office.
Greenwood East — Request from Philip Busby, Sr. regarding the drainage in the whole area
and would like to discuss the project with the Commission. He, also, expressed a desire
to serve on the board after the Greenwood East project is over.
Mr. Turano voiced his feeling that the developer should be requested to come in and explain
how this particular parcel fits into their entire land holding. Letter to be sent to the

owners and Commission members to be notified for review of the site.
Archdiocese Letter: Mrs. Trombly related that they did not have too many objections on
our Orden of Conditions. They were told what we had done on Millpond in extending the
20—day appeal period. Messers. Turano and D'Angelo and Pers. Trombly met with their
engineers and instead of what they had proposed an alternative could be to take the addi—
tional water through the wide area on Waverly Rd. and pipe it down. through DeMoulas. The
idea is being investigated. The Archdiocese is going to appeal just to keep their rights
alive, but they are going to keep working with the Commission. The above letter was dated
April 16, 9975•
HUD HOUSING -- Prescott & Chickering Rd. : Mr. Chepulis stated that he had viewed the site
and feels that it does come under the Wetlands Act. There is a holding pond with water
draining from it and a stream that goes in back of the elderly housing project adjacent
to this piece of land, it is almost like an inland wetland. He suggested notifying them
that there is a portion of the property that comes under the Wetlands Act. The motion
made by Mr. Chepulis to notify them of such was seconded by Mr. D'Angelo and the vote was
unanimous.
Lectures and Workshops:
The Ipswich River Wildlife Sanctuary is holding a series of lectures on Thursday, May 8
and Mrs. Trombly told the members that it would be helpful if someone could attend. A
motion was made by Mr. Chepulis that the ConCom budget be used for mileage costs. Mr.
D'Angelo seconded and the vote was unanimous.
Workshop in Marlboro which takes place during the week. Upon Mr. Turano's motion that
the Budget pay for anyone who wants to attend and second by Mr. D'Angelo, the members voted
unanimously in favor.
HABITAT: A flyer was received denoting that this organization conducts surveys, etc. on
Wetlands Protection.
MISCELLANEOUS MATTERS:
Mrs. Trombly stated that it was suggested that the Commission take Frank Lewis out to
dinner. All members agreed to this sometime after Town Meeting. To ask Mr. Lewis when
it would be convenient for him.
Mrs. Kittredge brought up the subject of the land on the other end of Forest St. and asked
if the railroad bed is or is not privately owned. Mr. D'Angelo said he had obtained a
plan which he showed to the Building Inspector who in turn advised showing it to Town
Counsel. Mr. Turano stated that he knows that some of it is privately owned. Mrs. Kitt—
redge made a motion to :request Town Counsel to do a title search. The motion did not
receive a second. The Commission then decided to ask Mr. Foster if he has any further
information and to respond to the Commission on the matter.
Mr. Turano commented that everything done on this Commission is left up to the Chairman and
expressed his ideas about setting up sub«-oommi.ttees to divide the responsibilities. Nothing
is done in between meetings, he said, and no one is held accountable. His feelings were
that at .least a Wetlands Committee and a Land Acquisition Committee is needed.
