February 14, 2018

Meeting came to Order at: 7:05 pm Quorum Present.

A motion to approve the January 24, 2018 minutes is made by Ms. Feltovic and seconded by
Sean McDonough

Trails and Open Space
Rolling Ridge Trails Kiosk -Eagle Scout Project
Assistant Scout Master Mark Rodgers, 19 Trinity Court, presents the proposed Eagle Scout
Project which is to install a kiosk in the buffer zone to the BVW and a potential Vernal Pool.
Eagle Scout Robert Rodgers, 19 Trinity Court, presents the Power Point presentation for the
informational Kiosk at the Rolling Ridge Trail. This Kiosk would provide information on
the ecosystem, animals and flora in the area.
The Kiosk would be constructed of pressure treated lumber, cedar shingles with a Lexan
Shield over the printed material, in concrete sonotubes.
Mr. Mc Donough asks who will be assisting with the construction of this project.
Mr. Robert Rodgers states that friends and family along with Scout troop 87 would assist
with the construction.
Mr. Mc Donough asks where the materials for the project would come from.
Mr. Robert Rodgers states that the materials would come from donations.
Ms. Feltovic asks if Mr. Robert Rodgers has had experience with this time of construction.
Mr. Robert Rodgers has done some minor work in the past which includes helping to install a
fence.
Mr. Napoli would like to make sure they stay away from the wetlands and the Vernal Pool
during and after construction.
The Administrator has concerns about the proposed location of the kiosk and recommends
that the informational kiosk be placed more than 50 feet from the Vernal Pool with wording
and placement to be approved by the Conservation Department. Further recommending that
this be issued as a small project L, with conditions for approval of language and location
prior to installation and well as a post construction inspection.
A motion to accept this as a small project L as conditioned is made by Mr. Mc Donough and
seconded by Ms. Feltovic.

The Administrator speaks about the project and the changes that were made regarding the
-Disturb Zone and follows the tree line along the existing cleared yard to
line. Markers should also be added along the driveway. A dewatering detail and stockpile
location have also been added. The Administrator recommends approving the waiver of the
NDZ and the NBZ associated with the Ephemeral Pool Habitat.
T.J Melvin, Christiansen & Sergi is here on behalf of the applicant Mr. Patel. Mr. Melvin
presents the plan and states that the 2x2 fieldstone wall, soil stockpile and the dewatering
have been added.
A Motion to approve the waiver requests is made by Mr.
McDonough and seconded by Ms. Feltovic.

Maureen Herald, Norse Environmental, on behalf of the applicant Ptarmigan. Ms. Herald
states that this filing request is to demolish an existing house, pool, patio, fence, and abandon
the existing septic tank in order to construct a new single family home, deck, patio, and
driveway.

Mr. McDonough asks the Administrator about monumentation of the BVW and what is being
recommended.

The Administrator states that the standard stone wall would be strange since it would not be
continuous due to the fact that the Wetland is mostly off property. Currently there is a falling
down fence at the Wetland line with a pool fence on the adjacent property.
Mr. McDonough is inquiring about the A Series Wetland which is where the existing
driveway that is to be removed and the restoration plan for the A Series buffer zone.
The Administrator would like to see a denser planting plan.
Ms. Herald states that the driveway will be removed, plantings, posts
NDZ.
Mr. McDonough asks if the same will be done for the B Series.

The Administrator has a couple of other notes regarding the plan, such as soil stockpiling, a
construction entrance, and dewatering due to the high water table.
Mr. McDonough asks if the Administrator has any other comments or concerns.
The Administrator states that the house will be further away from the Wetlands, the old
driveway will be removed, and the current area around the Wetlands is not in good shape due
to dumping.
Mr. Napoli asks if there is a house behind this property, the property next door that did some
four wheeling it the Wetlands and about the tree cutting on the property adjacent to 404
Summer Street.
The Administrator clarifies that there is a pool located behind the current house but confirms
that both properties in question have been contacted and the owner of the property that did
the tree cutting will be working with the Conservation Department on a replanting plan.
Mr. Napoli states that the plan will be to be revised to include, soil stockpiling, a construction
entrance, dewatering due to the high water table.
The Administrator also notes that the plan calls for straw waddle with the plastic netting the
Commission does not allow those and would require the larger bark mulch waddle, compost
or silt socks.
Mr. McDonough asks if fill needed is needed for the pool and if it is it will be provided from
on-property or off property.
There is some discussion amongst the Commission and the Administrator as to the in-ground
pool and the need for fill for the various proposed projects new home, patio and septic
system.
Ms. Herald states the soil will need to be trucked in and the pool is an in-ground pool with a
liner that will be removed.
Carole Loughran, 427 Summer Street, asks if the lot be raised and how large will the new
structure be.
Ms. Herald states that the lot is relatively flat so there will be some grading but it will not be
raised the new structure will be comparable in size to the current home.
Ms. Loughran asks about the square footage of the proposed home, style and how many
bedrooms it will have.
Ms. Herald states that she does not have the square footage of the new home but that it will
be comparable in size although larger.

The Administrator reviews the filing history with regards to the questions of the mean high
water line and the riverfront area. A sight walk with Greg Hochmuth was done at that time
addition flagging was done and added to the plans you have before you tonight.
Greg Hochmuth, Williams & Sparages is here to present on behalf of the applicant Messina
Development, Mr. Hochmuth states that a continuance was requested at the January 24, 2018
meeting is order to take a closer look at the methodology used to delineate the mean annual
high water for the two streams that effect this property. Aerial photographs were used for
most of it and flags were only hung on a portion, approximately 12 flags. So a site walk with
the Conservation Administrator was done at which time additional flags were hung. The
mean annual high water line was very obvious so approximately 24 new additional flags
were hung and were located by survey which are accurately represented on the plan.
Mr. Hochmuth states that he and the Administrator were able to walk the site and hang new
MAHW flags to the site and submit a revised plan.
Mr. Hochmuth presents new MAHW delineation plan and states that the original application
came in with a request for the Commission to also approve the BLSF the 100 year flood plain
that request has since been withdrawn noting that if anything is proposed for this property it
would required a Notice of Intent to be filed, and that that time it would need to be shown on
the plans. So at this time the BLSF approval request is not being asked.
The Administrator recommends issuing the Resource Area Delineation there would be a
finding of accurate flags and a note under the inaccurate for a flood plain is present on site,
but not determined. Then an accurate delineation for BVW (flags A1-A41 and Mean Annual
High Water flags MA1-Bordering Lang Subject to
Flooding which was originally shown on the plan but removed.
Mr. McDonough asks if this is normally done.
The Administrator states that yes it has been done in the past and give a couple of examples
for the Commission.
A motion to approve an accurate delineation for BVW (flags A1-A41 and Mean Annual High
Water flags MA1-MA28 is made by Mr. McDonough and seconded by Ms. Feltovic.

The Administrator states that it is a request for a one year extension and that a site visit was
conducted during which time it was noted that the project is largely finished but the erosion
controls are still in place, the flagging is still up, some stabilization is still to do.

The Administrator states that the West Mill Order of Conditions expired this month and was
mistakenly not extended. The majority of the work is complete with the exception of the
invasive species management and the site stabilization. The applicant is working on the As-
Built now.
The Administrator recommends issuing an enforcement order due to the fact that the work is
mostly done.
