The meeting was calked to order by ~he Chairman at 8:00
P.M. in the Selectmen,s~Office, Town Building.
Members present: Chairman, Gregory Mooradkanian, Secretary,
Harold C. Kay, Peter Ritchie, Charles ~. Trembly and James T.
~oor.
Mr. Beauchesne of 17 Massachusetts Avenue, North Andover,
came before the Board to inquire as'to the procedure he
should follow in order that he might apply to the Board
to have his property re-zoned into a business district.
He was given this information as well as a copy of the
rules and regulations for such an application.
The Board held a Public Hearing on the application of
Ethel M. Freeman, for an amendment of the Zoning Ordinance
of North Andover, to change the classification of property
owned by Ethel M. Freeman, from a Residential to a Business
District. The application and the notice of the Public Hearing
which were published in the Evening T~ibune were read by the
Chairman.
Nfs. Ethel N. Freeman, Leslie Freeman and Daniel Shine were
present and Mr. Shine represented the applicant. Mr. Shine
stated that the applicant wished to finish building a loading
platform at the rear of the "Furniture Barn!' so that the trucks
could unload under cover and also provide storage space for the
truck. He stated that there would be no unsightliness about
this and all the unloading would be done muder cover. ~hen
asked by the Board as to what the difference there was in the
present plan as compared with the plans as presented to the
Board some weeks previously, Mr. Shine explained that the area
now in question was outlined by the heavy lines on the plans
and did not include Thompson's Restaurant or any of the lots
on peters Street, which are also owned by the applicant. Mrs.
Freeman stated that the business had been there for at least
ten years and was a going concern before the Zoning Laws became
effective.
Mr. Milliken, who is an abutter, was present and spoke in favor
of granting or approving the plan as presented. He also stated
that in his opinion, the Freemans have excellent taste and he
felt sure that anything that they would build would not be un-
sightly.
Mr. Frederick De Fusco, also present stated that he owned property
near the "Barn" and that he would not like to have any building
~that would be unsightly to be put up in this vicinity and that
therefore he objected to any further construction. He was
assured by Mr. Shine that this construction would not be a shack
but a cement block garage-like loading platfo~, and that no further
construction is being planned for the future. This loading plat-
form has been an open one and that it was to improve the appearance
as well as the unloading facilities that this application had
been made. '
Upon motion duly made and seconded, it was unanimously VOTED to
take this matter under consideration and the applicant would be
notified as ~to the decision of the Board.
After discussing the above matter, a motion was duly made and
seconded and it was unanimously VOTED to approve the plans as
sub_mitted by Ethel M. Freeman, said plans having date'd January
1949, a copy of which is on file with the Planning Board and
it was also VOTED to send a letter to the Board of SeleCtmen
recommending that approval be granted at the a~nual Town Meeting
to be held on March 19, 1949.
Mr. Francis Kittredge, representing the North ~ndover Housing
Authority was before the Board to inquire and gather infox-mation
for making an application to the Planning Board to have a parcel
of land owned by the Village Land Company reclassfied f~om a
General Residential to a Business District. This parcel of
land ~is located in the westerly half of the block bounded by
Baldwin Street, Francis Street, ~Gilbert Street and Patriot
Street and wh~h the North andover Housing Authority are p~anning
to purchase from the Village Land Company to erect multiple
dewlling units for Veterans. Mr. Kittredge presented a letter to
the Board which was in effect an informal application and he was
informed as to the procedure which should be followed. A date
was set for the Public Hearing on this application for February 21,
5949 and this Public Hearing was duly advertised in the Evening
Tribune on the nights of February 8 and February 19, 1949. Mr.
~ttredge stated that an application was already in the hands of
the Board of appeals asking for a variance of the Zoning By-Laws
but since this application had been made, he had been infoPmed
that this Board had no juristication over this matter and it
should be presente~ before the FZanning Board. He was also ad-
vised to go before the Board of Selectmen and ask them t o set a
date for a special Town Meeting to take care of this matter.
Motion was made and seconded and it was VOTED to set February 21,
1949 as the date for a special meeting which would also.be a
Public Hearing on this matter.
Mr. Klttredge thanked the Board for their courtesy and assured them
that a formal application woudl be sent to the BoaPd within a few
days.
At the request of Atty. Charles W. Trombly, the Board Voted to
instruct the clerk to send copies of the Board's letter to Atty.
Arthur M. Thomson dated 6/21/48 and 11/30/48 as well as a copy of
the letter which was sent to the Planning Board from ~e Board
of Health regarding "Btanleyville~ These copies were sent to
Atty. John McDonnell~ as there is to be litigation in this matter
and Atty McDonnell requested these copies from Atty. Trombly.
The Chairm~-n informed the Board that he had been be~re the Advisory
Board during the previous week and that he was asked to explain how
the extra $800.00 asked for in the 1949 ~udget would be expended.
·hen informed that this was to be used toward the starting of a
master plan for North ~ndover, the Advisory Board asked that
Planning Board set up some definite plans as to how this was to
be done. This will be discusseda t a later meeting.
Motion was made and seconded and it was VOTED to adjourn.
Meeting adjourned at 10:O0 P.M.
February 21, 1949
The,, Meeting was called to order by the Chairman at 8:15
o'clock P.M. which was held in the Old Age Assistance
Office in the Town Building.
Members present: Chairman, Gregory Mooradkanian, Secretary,
Harold C. Kay, Peter Ritchie, Charles W. Trombiy and James
T. Poor.
Mr. Francis Kittredge, representing the North Andover Housing
Authority was present at this meeting and formally presented
his application for an amendment of the Zoning By-Laws of
North Andover, requesting that the classification of a parcel
of property owned by the Village Land Company, be changed from
a General Rmsidential to a Business District.
The Chairman read the fo~,.~l application and the notice of
the Public Hearing, which had been published in the Evening
Tribune on the nights of February 8 and February 19, 1949.
Mr. Kittredge explained to the Board the reasons for this
application and presented plans showing the layout.
There was no objection made to this application by any of
the abutters. All had been notified by letter of this
Public Hearing.
Motion was duly made and seconded and it was VOTED to take
this matter under consideration.
Mr. Kittredge thanked the Board for its co-operation in this
matter and he was advised that he would be info~med as to the
decision of the Board within a f~w days.
The above matter and the plans submitted to the Board were
discussed and a motion was made and seconded and it was
Unanimously VOTED to approve the plans as presented and
that a letter was to be sent to the Board of Selectmen
recommending that the change of classification be granted
at the Special Town Meeting to be held on February ES, 1949.
A copy of the vote of the Board as wellas a copy of the
plans as submitted were sent to the Town Clerk, the Board of
Assessors and the Board of Public Works.
