The meeting was called to order by the chairman at 7:30 p.m. Members
oresent were Nicholas F. Nicetta, Howard Gilman, Raloh E Finck, Raymond
Bor~dhead, Frank Driscoll.
Mrs. Pauline Blood and Messrs. Breen of the Breen Funeral Home in
Lawrence aopeared before the Board requesging information with regard
to the po~sSbility of conducting a funeral home at 1~-20 Wa,erly Road.
Mr. Nicetta outlined the necessary procedure.
g letter was received from Mr. Dewey Dyer regarding bis inability to
aid in the planning and rezoning program due to the press of business.
The chairman directed the clerk to send a letter to the Board of Trade
asking them if they wished to appointed a replacement for Mr. Dyer.
The Public . Hearing scheduled for 8:00 p.m. on petition of Mr. Charles
Melamed was withdrawn by the petitioner. The chairman directed the clerk
to send a letter to Mr. Melamed's attorney requesting reason, in writing,
for the withdrawal.
Several members of the Merrimack Valley Construction Co., Inc. appeared
before the Board requesting information with regard to land upon which
they wish to build. 2he chairman outlined the requirements for these men.
The meeting adjourned at 9:30 p.m.

The meeting was called to order by the chairman at 7:30 p.m. Members present
were Mr. Nicholas F. Nicetta, Howard Gilman, Ralph E. Finck, Raymond Broadhead
and Frank Driscoll. ,
A PUBLIC ~A~!~G was held on the petition of Mr. Leo Murphy. The notice of
public hearing as published in the Evening Tribune was read by the secretary.
The chairman asked if anyone wished to speak in favor of the petition. Mr.
Murphy (the petitioner) stated the reason for his reouesting the change in
classification of his property is that the are&aurrounding his land is zoned
for business. Mr Murphy cited the Red School House as an example.
As there were no other proponents, the chairman then asked if anyone wished to
speak As being opposed to the petition. Mr. John Osgood, Osgood Street, stated
he was against the petition being approved and also said that with regard to

the Red School House as referred to by Mr. Murphy, this land was used for
business before zoning went into effect and therefore could not be closed.
Mr. John E. Walvius, 17 Pleasant Street, stated he was in opposition to the
proposed change and was opposed to business on every highway.
Mrs. John Griffin, 841 Chicering Road was also recorded as being in opposition
to the petition.
Mr. Broadhead moved the matter be taken under advisement. The motion was seconded
by Mr. Finck and unanimously agreed to by the Board.
A Public Heari. ng was held on the application of Paul Desrosiers of Mass. Ave~Ae for
a proposed change in his prsperty from general residential to business. After the
secretary read the notice of public hearing as published in the Evening Tribune, the
chair~man asked if anyone wished to speak in favor of the petition being approved.
Atty. John J. Willis, 301 Essex Street~ Lawrence informed the Board he represented
Mr. Desrosiers in this matter. He stated the petition could rest on its merits and
gave the following reasons for the request for reclassification:
Most ~f the land in the immediate area is zoned for'business including the land
directly in front of the area in question. Access to the land in question is only
over land directly in front which faces Mass. Avenue. This land'i~ owned by Mr.
Desrosiers and only of use to him. The land up to this time has been used as a
dump. None of the neighbors objected to this reclassification inc~ding the immed-
iate abutters~ Mr. &Mrs. Calabre~e.
At this pointMr. Willis called on Mr. Benjamin Hollins who conducts a business
directly across the street from M~. Desrosiers property. Mr. Hollins stated that
he is most interested in the traffic hazard, which is caused by Mr. Desrosiers'
having to back his trucks around in the street, being eliminated by this classification
change. With this reclassification, all turning around and backing up will be done on
the property and not in the street.
Mr. Finck asked Mr. Willis if the petitioner was a lumber dealer. Mr. Willis answered
he was not. This statement was questioned by Mr. G.J. Dimario, 386 Sutton Street. Mr.
Willis again stated Mr. Desrosiers was not a lumber dealer as he does not resell the
lumber he bm~s but uses it for his business.
There were no opponents to the petition.
Mr. Finck moved the matter be taken under advisement. This motion was seconded by Mr.
Broadhead and unanimously agreed to by the~ Board.
A Pu0 ic ttearing was held on the petition of Daniel Olenio for the approval of the
Board regarding the reclassification of~nd from Agricultural to Business on Osgood
Street.
After the notice of public hearing as published in the Evening Tribune was read by
the secretary, the chairman aske~ if anyone wished to speak in favor of thei petition.

Mr. Olenio (the petitioner) stated the land is located directly across from land
owned byWestern Electric and that no one in the immediate vicinity is against the
petition. He said no more of a traffic hazard'would be created than will be present
~en W.E. is in operation. The reason he wishes the land reclassified is that he
hopes to erect a restaurant on the premises. With regard to the present planning pro-
gram, Mr. Oler~o stated the planning advisor would not want the town to stand in the
way of progress be felt quite sure.
Mr. Driscoll asked Mr. Olenio if Mr. Dudley was against the petition. Mr. Olenio
answered that albhough Mr. Dudley had not wished to sign the petition~ he was not
against it. (Mr. Dudley owns land adjoining that in question).
On question of Mr. Finck, Mr. Olenio stated he did not have plans of his proposed
restaurant and believed plans were not necessary when requesting the land be rezoned.
Mr. Herman Arlit, 1503 Osgood Street registered as being in favor of the petition.
The chairman then asked if anyone wished tq speak in opposition to the petition. Mr.
John Walvius stated he does not believe in businesses on highways and therefore was
against the petition..
Mrs. John Grifftn of Chickering Road stated there will be a greater traffic problem
andWestern Electric will have its own restaurants.
Mr. John OSgood of Osgood Street stated he felt the benefits brought in by Western
Electric should not be jeopardized by creating a hazard. He stated Mr. Olenio's ~tight
not prove to be a hazard but once we let in one~ we must grant others and one of these
~ght prove to be a hazard. Until we can find out what is best for the whole town
through the planning study N~. Osgood felt there should be no spot zoning anywhere.
On motion of Mr. Gilman, seconded by Mr. Broadhead, the Board unanimously voted to
take the matter under ad¥isement.
After consideration of the application of Mr. Paul Desrosiers requesting a reclassification
of land on Mass. Ave. as described in the notice pf public hearing published in the
Evening Tribune, Mr. Driscoll moved the Board approve the petition of Mr. Desrosiers.
~qis motion was seconded by Mr. Finck and the Board unanimously voted to approve the
petition for the following reasons:
1. Most of the land in the immediate area is zoned for business.
Access to the land is only possible over land owned by the petitioner
which is ~lready zoned for business and therefore the land is of no
use to anyone but the petitioner. The land at the present time is being
used as a dump.
There was not oppositioh registered against this petition at the public
hearing.
