Finck, seconded by Mr. Gilman the Board voted to take the matter under advisement. .At 8:15 p.m. a Public Hearing was~held on the petition of the Colgate Construction Co. with regard to land located on Chickering Road. After the notice of hearing was re~dby the secretary Mr. S~in explained to the Board that the land is located on the Westerly side of Chickering Road 500' south of junction of Prescott St. It is lan~ formerly of Henry Lund. The plans call for the ~aying out of two new streets, Alyce and Stafford. There will be 27 lots, the drainage for the project is designed to enter existing drains on Chickering Rd. At the present time grade of nominal rate is required and pipej manholes, etc. This project is being done after consultation with the town officials. On motion of Mr. Osgood seconded by Mr. Gilman, the Board voted to take this matter under advisement. There was no opposition to either of the above hearings. A letter was received from Atty. John Willis with regard to land on Main St. upon which he requested a public hearing. The letter was read by the secretary. The chairman instructed the clerk to write Mr. Willis requesting him to meet with the Board on this matter on. June 6, 1955 at 7:15 p.m. ~ The meeting adjourned at 9:30 p.m. Olerk June 6, 1955 The meeting ~s c~11ed to order by.the c~a~rman at 7:30 p.m Mr. John Will~s appeared with reference to his letter for ~,~blic hearing on a lot of land located on Saunders Street. On motion, of Mr. Finckj seconded by Mr. Gilman, the Board voted, to take this matter under advis ement. A public hearing was held on petition of Louis Breen to change a parcel of land located on Osgood Street from residential to business for the purpose of using the dwelling as a funeral hose. After the notice of hearing was read~y thesecretarythe chairman asked if anyone wished to object to Mr. Barman serving o~%the Board on this matter as he is ~n abutter to the land. There was no objection. SDeaking in favor of the petition was Mr. Donald Sullivan, attorney for the petitinner who stated Mr. Breen had contracted to purchase the land and has petitioned for a Town Meeting. He stated Mr. Breen contemplates using the structure as a funeral home and does not plan to make any changes in the contour or structure of the building. ~r. Sullivan said Mr. Breen intends to take up residence i~ North Andover ~ere he already has a brother living. He said if the permit is grated it will permit more service to the Tonw in this field and will prove to the health, convenienee~and welfare of the people. He said that the present time showed only one funeral home locked in North Andover whereas Methuen Eas six for 25 M people and Andover two for 13 M. Mr. Fred Oakes of 15 Merrimack St. stated he has lived in the town for 3 years and felt the propsed rezoning should be considered more in the nature of a service. William Shann, Osgood St., stated he has been a resident of the Town for 3 Y ars and felt that due to the growth of North Andover another funeral home is warranted. Also recorded in favor of the petition was Daniel Breen, l0 Lorraine Ave. H. Rogers, 580 Osgood St. stated that she felt a funeral home was more in the nature of a business and was opposed to it. Albert Weaver, 147 Chestnut St. said i~e has lived in'the Town for 25 years and was opposed to it as a town resident was refused a permit. Alfred McKee of Church St. stated he was in opposition to the petition being approved. Mr. A. Murray Howe, 440 Osgood St. registered in opposition to the petition. A1 Boynton, Osgood St. was opposed saying this was spot zoning. George Caron, a funeral director in North Andover said he felt this should be located in an already existing business area. John Davis, Park Street also stated he felt this should locate in a business zone. Also recorded a~ainst were Margaret Howe, Osgood St., A1 Jackson, Water St., Carolyn Rogers, 580 Osgood St., Rut~ Weaver, Chestnut St., H. Boynton, Osgood St., Margery Hyder, High St., Richard Hyder, High St., Florence Maguire, S~onington St., Alfred Soucy, S}~nington St., Fannie Gill, Harold St., Florence S6ucy, Stonington St., H.L. Bonny, Church St., all of NorthAndover. On motion of Mr. Barman, seconded by Mr. Gsgood, the Bo~ voted to take the matter under advisement. Mr. John Blackwell and his attorney appeared before the Boo~.d with matters concerning the pr~sent rezoning and planning progrmm.
