Thomson amd Williams ca~e in stating they were Jointly interested in a situation on Herriek Road with the desired intent that the By-laws did not per- tain to this lot. The lo% was recorded and they felt that the amaded By-law did not a,ply as the lot~s bean registered for a ~,mher of years. The lot in question is owned by the sa~e person who o~ns the adJo~-~-~ lot ~ But the gentlemen felt the %owaspeople did not intend that the By-law apply to a cow--on owner ~th segregated lots by separate deeds. The Board informed the gentlemen this was a problem that should be brought before the Boa rd of Appeals. The Board met with members of the Board of Assessors and Mr. John Blackwell to discuss mut~! problems ~with regard to the present zoning program, especially with regard to lot sizes. The meeting adjourned at 11=00 p.m. Signed~Clerk October 5, 1955 The meeting was called to Order by the chairman at 7:30 p.m. Members present were Messrs. Nicetta, Finck, GAlm.. and Osgoed. Mr Harold Stott, Bea~on Hill Blvd., ca~e in with a problem that the town cepted the street on the me, its of the plan he submitted. He said the selectmen siad they wox~ld go along with whatever the Planning Board agree~ to do. He said it is 34' to.the property line and 30' to the road which means Mr. Stott ~ust ge back ~0'. The road has been located incorrectly. Mr. Stott said he wishes te start building A~d therefore would like to have the matter cleared bp with regard to the road being incorrectly located. The Board infor~d Mr. Stott that the only advice they could give him would be fore him to discuss the matter with the abutters, work out a reasonable width, take the matter before the Selectmen who would then re, er the matter to the Board. The Board, under law, would h,nd a decision to the Selectmen wit_hq. 45 days and the Select, an would then act on his problem. Mr. ~ of the First Methodist Ohwch came in with regard to a propesad oha~e of the Church property from Educational and Heligioa to a B~sin®ss zone. The ~nd is located at the corners of Water and ~ain Streets. The Boa~ advised Mr. B~mFord that~this seen~d an unwise move as it is endangering the property for possibly the land would revert back to the heirs if this change was made. The proper procedure would be to go Before the Board of Appeals and ask for a variance when the time came that they would want to build an extension. A letter from Atty. Salisbur~was road by the seeretary with regard to the decision of Judge Kirk in the case of Arthar B, 0olgate against the Pla~-~ Board.
