The North Andover Board of Appeals held a public hearing at its regular meeting in the Town Hall top floor meeting
room, 120 Main Street,North Andover,MA on Monday,May 12,2008 at 7:30 PM upon the application of Carolina
Properties,LLC,Gerald E.Welch—Manager, 130 Middlesex Street,North Andover,MA,for property at: 10
Concord Street(Map 85,Parcel 52),North Andover,MA requesting a Special Permit from Section 4,Paragraphs
4.122.14.A.b,4.122.14.D,and Section 10,Paragraph 10.3 of the Zoning Bylaw in order to construct a two-family
dwelling on a conforming lot Said premise affected is property with frontage on the East side of Concord Street
within the R-4 zoning district. Legal notices were sent to all names on the abutter's list and were published in the
Eagle-Tribune,a newspaper of general circulation in the Town of North Andover,on January 21 &January 28,2008.
Richard J.Byers read the legal notice during the regular February 12,2008 meeting of the Zoning Board of Appeals.
The applicant requested that the hearing be continued without presenting evidence.
The following voting members were present: Ellen P.McIntyre,Joseph D. LaGrasse,Thomas D.Ippolito,Richard M.
Vaillancourt,and Daniel S.Braese.
Upon a motion by Joseph D.LaGrasse and 2nd by Richard M. Vaillancourt,the Board voted to GRANT a Special
Permit from Section 4,Paragraphs 4.122.14.A.b,4.122.14.1),and Section 10,Paragraph 10.3 of the Zoning Bylaw in
order to construct a two-family dwelling on a conforming lot per:

The Board finds that Concord Street is in the Residential Four Zoning District and that the Zoning Bylaw allows two,
three,four,and five dwelling units by Special Permit The Board finds that there are multi-family dwellings on
Concord Street,and on neighboring Camden,Osgood,and Bunker Hill Streets. The use,as developed,will not
adversely affect the neighborhood because the proposed two-family dwelling,as designed,,will conform to the
character of the neighborhood in size, structure,and appearance,per the applicant's presentation titled"House Photos
of Concord Street,North Andover Mass"submitted during the May 12,2008 meeting. The Board finds that the
applicant submitted signatures of abutters that have reviewed the plans and are not opposed to the proposed two-family
dwelling and that there were no adverse spoken comments during the hearing. The Board finds that there will be no
nuisance or serious hazard to vehicles or pedestrians because the lot can accommodate the required 4 off-street parking
spaces. Adequate and appropriate facilities,electricity,phone,Town water,and Town sewer lines are provided to
Concord Street lots. The applicant stated during the May 12,2008 meeting that the Town Engineer reviewed the"Site
Plan Showing Proposed Sewer Service and Proposed Lot Grading"during the March 26,2008 Technical Review
Committee and was satisfied with the plan information. The Board finds that the applicant has satisfied the provisions
of Section 4,Paragraphs 4.122.14.A-b,4.122.14.1),and Section 10,Paragraph 10.3 of the Zoning Bylaw in order to
construct a two-family dwelling on a conforming lot and that the granting of this Special Permit for a two family
dwelling unit at 10 Concord Street,Map 85,Parcel 52 is an appropriate location because there are other two-family
dwellings on Concord Street. The Board finds that this Special Permit is in harmony with the general purpose and
intent of the above-cited bylaws,and this two-family dwelling unit shall not be substantially more detrimental than the
existing single and two-family dwellings in the Concord,Bunker Hill,Camden,and Osgood Street neighborhood.
Note: 1.This decision shall not be in effect until a copy of this decision is recorded at the Essex County Registry of
Deeds,Northern District at the applicant's expense. 2.The granting of the Variance and/or Special Permit as
requested by the applicant does not necessarily ensure the granting of a building permit as the applicant must abide by
all applicable local,state,and federal building codes and regulations,prior to the issuance of a building permit as
required by the Inspector of Buildings.
Furthermore,if the rights authorized by the Variance are not exercised within one(1)year of the date of the grant,it
shall lapse,and may be re-established only after notice,and a new hearing. Furthermore,if a Special Permit granted
under the provisions contained herein shall be deemed to have lapsed after a two(2)year period from the date on
which the Special Permit was granted unless substantial use or construction has commenced,it shall lapse and may be
re-established only after notice,and a new hearing.

The Applicant, Carolina Properties, LLC, seeks a Special Permit from the Zoning Board
of Appeals in order to construct a two-family residential dwelling on a vacant lot of land located
at 10 Concord Street, North Andover, MA.
The specific site is an appropriate location-for a two-family dwelling since it is an
allowed use in an R-4 zoning district, by Special Permit from the Zoning Board of Appeals
(Section 4.122, Subsections 14.A,B and 14.D.
The proposed building will be in a residential area consisting of single family and multi-
family dwellings.
The proposed two family structure will be in conformity with the dimensional
requirements of the Zoning By-Law.

Notice is hereby given that the North Andover Zoning Board of Appeals will hold a public
hearing in the Meeting Room of Town Hall, 120 Main Street,North Andover,MA on Tuesday
the 12 of February, 2008 at 7:30 PM to all parties interested in the application of Carolina
Properties, LLC, Gerald E. Welch—Manager, 130 Middlesex Street,North Andover,MA, for
property at: 10 Concord Street(Map 85, Parcel 52), North Andover, MA requesting a Special
Permit from Section 4, Paragraphs 4.122.14.A.b, 4.122.14.1), and Section 10,Paragraph 10.3 of
