Nom: Carlo Dello Russo DATE:12/19/2000 ADDRESS; 12 Elmwood Street PETITION: 031-2040 North Andover,MA 01845 HEARING: 9/12/2000, 10/10/2000, 12/12/2000 The Board of Appeals held a regular meeting on Tuesday,December 12,2000,at 7:30 PM upon the application of Carlo Dello Russo, 12 Elmwood Street,North Andover,MA for a'Variance from the requirements of S7,P7.3,for dimensional relief,and for a Special Permit from S9,P 9.1,9.2 to allow construction of a 2nd story addition consisting of 4 bedrooms to alter a pre-existing non-conforming structure on a non-conforming lot within the R-4 Zoning District, The following members were present:William J.Sullivan,Walter F.Soule,Robert Ford.,John Pallone Ellen McIntyre. Upon a motion made by John Panone,and 2nd by Walter F. Soule,the Board voted to GRANT a dimensional VARIANCE for relief of a front setback of 7.5'and relief of a side setback of 3'and to GRANT a Special Permit to allow for the addition of a 2'd story consisting of 4 bedrooms and to alter a pre-existing,non-conforming structure on a non-conforming lot. On the condition that the mylar be updated to reflect that the proposed floor area is not to exceed 2028 s,f. in accordance with the bylaw. In accordance with the Plan of Land by: Scott Giles,PLS,#13972,50 Deer Meadow Road,North Andover, MA. dated 10/24/2000. Voting in favor: William J. Sulllivan,Walter F, Soule,Robert Ford,John Pallone, Ellen Mclutyrre, 10.4 Variances and Appeals The Zoning Board of Appeals shall have power upon appeal to grant variances from the terms ofthis Zoning Bylaw where the Board finds that owing to circumstances relating to soil conditions,shape,or topography ofthe land or structure and especially affecting suds land or structures but not affecting generally the zoning district in general,a literal enforcement sboftuc provisions ofthI bylaw will involve substantial hardship,financial or otherwise,to the petitioner or applicant,and that desirable relief may be granted without substantially detriment to the public good and without nullifying or substantially derogating from the intent or purpose of this Bylaw. Furthermore,if the rights authorized by the variance are not exercised within one(1)year ofthe date ofthe grant,they shall lapse,and may be re-established only after notice,and a new hearing. Our home is a small 5 room ranch and although we are very happy with our neighborhood, school system, and the Town of North Andover our house has become quite crowded. After inquiring into other residential properties in the area we have come to the conclusion that it would be too difficult for us to purchase a new home which would be large enough for our family. It would prove to be a financial burden as well as an emotional strain. Currently, we work alternating shifts in order to provide for our family and to ensure that the children are never without supervision. We strongly believe that it is in the children's and our best interest to stay at our current location and add more living space to our home. This addition would consist of a second level and would not change the footprint of the current house. Therefore, relief from the zoning ordinance as stated on our application would be greatly appreciated. Thanks in advance.
