Board of Appeals 0 � JEC Li 15 # n ON Arlo �,SS1C11USE�� TOWN OF NORTH ANDOVER MASSACHUSETTS BOARD OF APPEALS Gary Laurendeau 13 Belmont Street North Andover, MA 01845 The Board of Appeals held a regular meeting on Tuesday evening, December 13, 1994 upon the application of Gary Laurendeau requesting a variation of Section 7, Paragraph 7.3 and Table 2 of the Zoning Bylaw to allow construction of a deck which would require ten feet of relief from the 30-foot rear setback on the premises at 13 Belmont Street. The following members were present and voting: Mr. Sullivan, Mr. Soule, Mr.Vivenzio, Mr. Pallone and Mr. Karpinski. The hearing was advertised in the North Andover Citizen on November 23 and 30, 1994 and all abutters were notified by regular mail. Upon a motion by S. Karpinski and seconded by R. Vivenzio the Board voted unanimously to GRANT the variance as requested as shown on the plan with the condition that 6-foot high fencing or shrubs be planted providing screening along Laurendeau's property line, whichever the homeowner prefers. The Board finds that the petitioner has satisfied the provisions of Section 10, Paragraph 10.4 of the Zoning Bylaw and that this variance may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Bylaw. CHUSE� TOWN OF NORTH ANDOVER MASSACHUSETTS BOARD OF APPEALS * Gary Laurendeau * DECISION 13 Belmont Street North Andover, MA 01845 * Petition #029-94 * The Board of Appeals held a regular meeting on Tuesday evening August 9, and then a special meeting on August 30, 1994 upon the application of Gary Laurendeau requesting a Special Permit under , Section 9, Paragraph 9.2 (l) of the Zoning Bylaw so as to permit construction of an addition to ,a non-conforming structure on the premises located at 13 Belmont Street. The following members were present and voting: Walter Soule, Vice-chairman, Robert Ford, Clerk, John Pallone and Scott Karpinski. The hearing was advertised in the North Andover Citizen on July 20 and 27, 1994 and all abutters were notified by regular mail. Upon a motion by Mr. Pallone and seconded by Mr. Karpinski, the Board voted unanimously to GRANT the Special Permit as requested. The Board finds that the applicant has satisfied the provisions of Section 10, Paragraph 10.3 of the Zoning Bylaw and that such change, extension or alteration shall not be substantially more detrimental than the existing non-conforming use to the neighborhood.
