The North Andover Board of Appeals held.a public hearing at its regular meeting in the Town Hail top floor
meeting room, 120 Main Street,North Andover,MA on Tuesday,December 9,2008 at 7:30 PM upon the
application of Sandra M.Beland,16 Meadow Lane(Map 45.G,Parcel 44),North Andover,MA requesting a
Special Permit from Section 4,Paragraph 4.122.22 of the Zoning Bylaw in order to allow a Family Suite within the
existing footprint of a conforming single family dwelling on a conforming lot. Said premise affected is property
with frontage on the South side of Meadow Lane within the R4 zoning district. Legal notices were sent to all
names on the abutter's list and were published in the Eagle-Tribune,a newspaper of general circulation in the Town
of North Andover,on November 24&December 1,2008.
The following voting members were present: Ellen P.McIntyre,Joseph D.LaGrasse,Richard J.Byers;Richard M.
Vaillancourt,and Thomas D.Ippolito. The following non-voting members were present: Daniel S.Braese and
Michael P.Liporto.
Upon a motion by Joseph D.LaGrasse and 2nd by Thomas D.Ippolito,the Board voted to GRANT a Special
Permit from Section 4,Paragraph 4.122.22 of the Zoning Bylaw in order to allow a Family Suite within the existing
footprint of a conforming single family dwelling on a conforming lot per:

With the following conditions:
1. The Family Suite shall not be occupied by anyone except Christopher P.Cesati or Kimberly A.
Cesati,granddaughter of Merinda A.and Samuel P.Caliento,the residing life owners of the dwelling
unit;
2. The Special Permit shall expire at the time that Christopher P.Cesati or Kimberly A.Cesati cease to
occupy the Family Suite;
3. The Special Permit shall expire at the time the premises are conveyed to any person,
partnership,trust,corporation or other entity;
4. The applicant,by acceptance of the,Certificate of Occupancy issued pursuant to the Special Permit,
grants the Building Inspector or his lawful designee the right to inspect the premises annually;
5. The applicant shall maintain the existing footprint and the existing floor-plan of 16 Meadow Lane,
approved by Building Permit#109 issued on 8/11/08 for the demolition of an existing garage in order
to construct an addition of a 2-stall garage,2 bedrooms,a living area,and one,full bathroom to an
existing single-family dwelling with the addition of the full kitchen as shown on Proposed Family
Suite/Secon Kitchen,S.Beland,16 Meadow;
6. The Special Permit may be modified to accept other family members per the Bylaw with Board
approval.

Ippolito.
The Board fords that the applicant has satisfied the provisions of Section 4,Paragraph 4.122.22 of the Zoning Bylaw
and that the granting of this Special Permit for Family Suite usage at 16 Meadow Lane(Map 45.G;Parcel 44)within
the footprint of an existing conforming single-family dwelling on a conforming lot is an appropriate location for a
Family Suite. The Board fords that this use of part of the existing 16 Meadow Lane,as developed by installing the
proposed full kitchen per the above building&site plan,will not adversely affect the neighborhood. There will be
no nuisance or serious hazard to vehicles or pedestrians since there is provision for the required four off-street
parking spaces. Adequate and appropriate facilities are provided to the existing residential dwelling by existing
utilities,Town water,and Town sewer and for the proper operation of a Family Suite. The Board finds that the
proposed addition of a second full kitchen for the Family Suite use will not be substantially more detrimental than
the existing single-family dwelling to the neighborhood.
Note: 1.This decision shall not be in effect until a copy of this decision is recorded at the Essex County Registry of
Deeds,Northern District at the applicant's expense. 2.The granting of the Variance and/or Special Permit as
requested by the applicant does not necessarily ensure the granting of a building permit as the applicant must abide
by all applicable local,state,and federal building codes and regulations,prior to the issuance of abuilding permit as
required by the Inspector of Buildings.

1. The Particular use proposed for the land or structure:
We are requesting a variance for a family suite.The suite will be in a recently built single-level addition which
is 1,100 square feet of living space.We would like to add a kitchen to this existing addition.
2. The specific site is an appropriate location for such use,structure or condition.
We are desirous of adding a kitchen to a recently built addition.The addition is conforming,but the kitchen
would create a family suite.
s. 1 here will lie no nuisance or serious hazard to vehicles or pedestrians.
There will be no change to the footprint of the existing structure.Proper care and clean up of the site will take
place daily.
4. Adequate facilities will be provided for the proper operation of the proposed use.
The proposed kitchen will add minimal stress onto the existing sewer and water systems.
5. The use is in harmony with the purpose and intent of the zoning by-law.
It is our understanding that a family suite will be created by adding a separate dwelling(kitchen)within the
existing dwelling. We also understand that this family suite is for the sole purpose of housing a family member.
The immediate use will be for grandparents, followed by parents.
6. Specific reference and response to the criteria required by the particular special permit for which this
application is made.
The criteria for this special permit being requested for the creation of a family suite is based upon a hardship to
help care for our elderly grandparents who desire to live out their lives in their private residence.The house
was originally built to comp with zoning requirements. Since the time construction began on the addition the
zoning in R4 has changed to allow family suites via special permit. Our grandparents are 86 and 92 years young
and would like to retain their independence, but have family close by for assistance when needed.We are a
young couple with two young children ages 7 and 8 who are currently attending the Atkinson Elementary
school with permission from the superintendent.We as a family have chosen to pursue the family suite as a way
to pelf;care ur our grandparents as needed.We look forward to many years of residency at 16 Meadow Lane,
and have no intentions to alter from the requirements of the family suite by-laws.When our grandparents have
passed on, their daughter,my mother will move in.
We would like to gain approval of this family suite to allow both my grandparents to live the remainder of their
years in&.c it.`orac dhcy custom built 44 years ago.,10c also understand that once my grandparents or mother arc
no longer living their or if we choose to sell the property at anytime in the future,we will return the dwelling
to a traditional single family home.
