The Board of Appeals held a regular meeting on Tuesday evening,May 9, 2000 at 7:30 PM upon the
application of John Zaccari,Sr.,21 Patriot Street,North Andover,MA.. Petitioner is requesting a
Variance from the requirements of Section 7,Paragraph 7.3 for a rear setback,and for a Special Permit
from Section 9,Paragraph 9.2 in order to construct a Florida room on a pre-existing structure within the R-
4 Zoning District..
The following members were present: William J. Sullivan,Walter F. Soule,Raymond Vivenzio,Robert
Ford, John Pallone.
Upon a motion made by Raymond Vivenzio and 2d by John Pallone, the Board voted to GRANT
a Variance from the requirements of Section 7,Paragraph 7.3 for relief of a rear setback of 5 feet of the
East side of the premises on the condition that the addition of a Florida room belimited to a one story room
and on the basis that the petitioner has satisfied the provisions of Section 10,paragraph 10.4 of the Zoning
Bylaw and that the granting of these variances will not adversely affect the neighborhood or derogate from
the intent and purpose of the Zoning Bylaw. The Board voted to GRANT a Special Permit under Section
9,Paragraph 9.2 to construct a Florida room on the condition that it be limited to a one story room and on
the basis that the Board finds that the applicant has satisfied the provision of Section 9,Paragraph 9.2 of the
Zoning Bylaw and that such change,extension or alteration shall not be substantially more detrimental than
the existing non-conforming structure to the neighborhood. In accordance with the Plan of Land by:
Dante E.Bartolomeo,P.L.S.,#15309,dated March 17,2000. Voting in favor: William J. Sullivan,Walter
F. Soule,Raymond Vivenzio,Robert Ford,John Pallone.
Furthermore,if the rights authorized by the variance are not exercised within one(1)year of the date ofthe grant,they shall lapse,and
may be re-established only after notice,and a new hearing. Furthermore,if a Special Permit granted under the provisions contained
herein shall be deemed to have lapsed after a two(2)year period from the date on which the Special Permit was granted unless
substantial use of construction has commenced,they shall lapse and may be re-established only after notice,and a new hearing.
