The North Andover Board of Appeals held a public hearing at its regular meeting in the Town Hall top floor
meeting room, 120 Main Street,North Andover,MA on Tuesday,June 15,2007 at 7:30 PM upon the application of

With the following conditions:
1. The Mylar shad be updated to shove the infiltration trench along the west side lot tine abutting 33
Third Street,(Map 30,Parcel 21)with infiltration trench detail.

The Board finds that the applicant has complied with the conditions,as referenced above as points 1.and 2.
The Board finds that the petitioner has satisfied the conditions of a Special Permit from 4.122.14.1 in that the second
unit will have negligible impact on the Third Street&Maple Avenue neighborhood,will provide an additional
modest-sized housing unit,and will the preserve the existing structure,which is consistent with the existing
neighborhood. The Board finds that the petitioner has satisfied the conditions of 10.31 in that 23 Third Street is an
appropriate location for a two-family unit and a second unit will no adversely affect the neighborhood of single,
two,and multi-family units because the second unit shall be,constructed within the footprint and height of the
existing structure. The Board finds that there will be no nuisance or serious hazard to vehicles or pedestrians from
the proposed enclosed front porch,interior re-configuration,or new driveway and 4-bar parking area. The Board
finds that the petitioner stated that a two-foot by two-foot infiltration trench between the proposed new driveway and
the west lot line abutting 33 Third Street shall be provided. The Board finds that 23 Third Street has existing
adequate and appropriate facilities(water,sewer,and power)for the proper operation of the proposed use. The
Board finds that the second unit granted by this Special Permit for 23 Third Street is in harmony with the general
purpose and intent of 4.122.14.1 and 9.2 and that this extension shhall not be substantially more detrimental than the
existing single-family structure to the neighborhood.
Note: 1.This decision shall not be in effect until a copy of this decision is recorded at the Essex County Registry of
Deeds,Northern District at the petitioner's expense. 2.The granting of the Variance and/or Special Permit as
requested by the petitioner does not necessarily ensure the granting of a building permit as the petitioner must abide
by all applicable local,state,and federal building codes and regulations,prior to the issuance of a building permit as
required by the Inspector of Buildings.
Furthermore,if the rights authorized by the Variance are not exercised within one(1)year of the date of the grant,
it shall lapse,and may be re-established only after notice,and a new hearing. Furthermore,if a Spatial Permit
granted under the provisions contained herein shall be deemed to have lapsed after a two(2)year period from the
date on which the Spatial Permit was granted unless substantial use or construction has commenced,it shall lapse
and may be re-established only after notice,and a new hearing.
