PETITION #028-99 North Andover, MAO 1845_ HEARING: 11/9199 The Board of Appeals held a regular meeting on Tuesday evening, November 9, 1999 upon the application of John&Linda Schoonmaker, 28 Elm Street, North Andover,MA. Petitioner is requesting a Variance from the requirements of Section 7, Paragraph 7.3 of Table 2 for relief of side and rear setback for proposed addition of storage space to enlarge an existing family room and proposed addition of a deck and for a Special Permit under Section 9, Paragraph 9.1 &9.2 in order to enlarge a non-conforming residence. Property is within the R-4 Zoning District. The following members were present: William J. Sullivan,Walter F. Soule,John Pallone, Scott Karpinski. Upon a motion made by John Pallone, and 2nd by Scott Karpinski,the Board voted to GRANT a Variance (dimensional relief)from the requirements of Section 7,P7.3 for a rear setback of 3',and a side setback of 9'on West side of building in order to allow for addition of storage space and to enlarge an existing family room and addition of a deck, and to GRANT a Special Permit under Section 9, P9.1 &9.2 in order to enlarge a non-conforming residence. In accordance with the Plan of Land by: Scott L. Giles, R.P.L.S.,#13972,revision date of 1113199. Voting in favor: William J. Sullivan,Walter F._Soule, John Pallone, Scott Karpinski. VARIANCE: The Board finds that the petitioner has satisfied the provisions of Section 10,paragraph 10.4 of the Zoning Bylaw and that such change,extension or alteration shall not be substantially more detrimental than the existing non-conforming structure to the neighborhood. SPECIAL PERMIT The Board finds that the applicant has satisfied the provision of Section 9,paragraph 9.2 of the Zoning Bylaw and that such change,extension or alteration shall not be more detrimental than the existing non-conforming structure to the neighborhood. Furthermore,if the rights authorized by the variance are not exercised within one(1)year of the date of the grant,they shall lapse, and may be re-established only after notice,and a new hearing. Furthermore,if a Special Permit granted under the provisions contained herein shall be deemed to have lapsed after a two(2)year period from the date on which the Special Permit was granted unless substantial use or construction has commenced,they shall lapse and may be re-established only after notice,and a new hearing. We are a growing family living in a small house. The modest addition we propose will give us much needed storage and a family room large enough for us to utilize. We have worked hard over the past seven years renovating this home. We want to continue to live in the house and the community and are therefore submitting this application to slightly increase the storage and living space while maintaining the scale of the house and grounds. The proposed use is in harmony with the general purpose and intent of the by-law. A literal enforcement of the by-law would involve substantial hardship to the petitioner and desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the zoning by-law.
