Referring to the above petition for a variation from the requirements
of Section 7, para. 7.1, 7.2, 7.3 & Tbl. 2 of the Zoning Bylaw so as
to permit relief of 7,500 square feet of lot area where 12,500 SF is
required, relief of 50-feet for street frontage where 100 feet s
required, relief of 19.1 feet for the front setback where 30 fe t is
required and relief of 10.5 feet for the right side setback whe e 15
feet is required. The following reliefs are also requested for he new
addition: relief of 8.6 feet from the left side setback require ent of
15 feet and relief of 20 from the 30 foot rear setback requirem nt.
Applicant is also seeking a special permit under Sec. 9, para 9.2(1)
of the Zoning Bylaw so as to extend and alter a legal non-confo ming
stucture on a non -conforming lot as indicated on plans dated 4 -95 as
prepared by Registered Land Surveyor, Scott Giles.
After a public hearing given on the above date, the Board of A peals
voted to GRANT the Variance & Special Permit and hereby
authorize the Building Inspector to issue a permit to:

The Board finds that the petitioner has satisfied the provision of Sec.
10, para. 10.4 of the Zoning Bylaw and that the granting of the e variances
will not adversely affect the neighborhood or derogate from the intent and
purpose of the Zoning Bylaw.

The Board of Appeals held a regular meeting on Tuesday evening May 16, 1995 upon the
application of Karen and Roger Talbott requesting a variation under Section 7, Paragraph
7.1, 7.2, 7.3 and Table 2 of the Zoning Bylaw so as to permit relief of 7,500 square
feet(SF) of lot area where 12,500SF is required, relief of 50 feet for street frontage where
100 feet is required, relief of 19.1 feet for the front setback where 30 feet is required and
relief of 10.5 feet for the right side setback where 15 feet is required. All the above reliefs
are for the existing house. The following reliefs requested are for the construction of a
second apartment: relief of 8.6 feet on the left side setback for the handicap ramp where
15 feet is required and relief of 20 feet from rear setback requirement of 30 feet. Applican
is also seeking a Special Permit under Section 9, Paragraph 9.2(1) of the Zoning Bylaw s
as to alter and extend a legal non -conforming structure on a non -conforming lot located a
29 Columbia Road, Zoning District R-4 as shown on plans dated 4-3-95 as prepared by
Registered Land Surveyor, Scott Giles.
The following Board members were present and voting: Walter Soule, William Sullivan,
John Pallone, Scott Karpinski and Raymond Vivenzio.
The hearing was advertised in the North Andover Citizen on April 19 and 26, 1995 and a 1
abutters were notified by regular mail.
Upon a motion by Scott Karpinski and seconded by John Pallone, the Board voted
unanimously to GRANT the Variances and Special Permit as requested and displayed
on plans dated 4.3.95 as prepared by Registered Land Surveyor, Scott Giles.
The Board finds that the petitioner has satisfied the provisions of Section 10, Paragraph
10.4 of the Zoning Bylaw and that the granting of these variances will not adversely affec
the neighborhood or derogate from the intent and purpose of the Zoning Bylaw.
The Board finds that the applicant has satisfied the provisions of Section 9, Paragraph 9.
of the Zoning Bylaw and that such change, extension or alteration shall not be
substantially more detrimental than the existing non -conforming use to the neighborhood
