NAME: Thomas&Jean H.Kooken DATE: 3/16/2000 ADDRESS: 37 Bradstreet Road PETITION: 005-2000 North Andover,MA 01845 HEARING: 3/14/2000 The Board of Appeals held a regular meeting on Tuesday evening,March 14,2000,at 7:30 PM upon the application of Thomas&Jean H.Kooken, 37 Bradstreet Road,North Andover,MA. Petitioner is requesting a variance from the requirements of Section 7,paragraph 7.3,for a side and rear setback and for a Special Permit from Section 9,paragraph 9.2 of Table 2,R-4 Zoning District,in order to construct an addition of a family room,laundry room,and porch and bedroom on a pre-existing non-conforming lot. The following members were present: Raymond Vivenzio,Robert Ford,John Pallone,Scott Karpinski& Ellen McIntyre. Upon a motion made by John Pallone and seconded by Scott Karpinski,the Board voted to GRANT a dimensional variance for relief of a side setback of 4'for the addition,and for relief of a rear setback of 17'and 24'for an existing garage and for a Special Permit in order to construct an addition of a family room,laundry room, porch and bedroom on a pre-existing,non-conforming lot. In accordance with the Plan of Land by: Scott M. Giles,P.L.S.,#13972,50 Deer Meadow Road,North Andover,MA 01845,dated 2/l/2000. Voting in favor: Raymond Vivenzio,Robert Ford,John Pallone, Scott Karpinski and Ellen McIntyre. 10.4 Variances and Appeals: The Zoning Board of Appeals shall have power upon appeal to grant variances from the terms of this Zoning Bylaw where the Board finds that owning to circumstances relating to soil conditions,shape,or topography of the land or structure and especially affecting such land or structures but not affecting generally the zoning district.in general,a literal enforcement of the provisions of this Bylaw will involve substantial hardship,financial or otherwise,to the petitioner or applicant,and that desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of this Bylaw. SpecialTermit: The Board finds that the applicant has satisfied the provision of Section 9,paragraph 9.1 of the Zoning Bylaw and that such change,extension or alteration shall not be substantially more detrimental than the existing non-conforming structure to the neighborhood. Furthermore,if the rights authorized by the variance are not exercised within one(1)year ofthe date ofthe grant,they shall lapse,and may be re-established only after notice,and a new hearing. Furthermore,if a Special Permit granted under the provisions contained herein shall be deemed to have lapsed after a two(2)year period from the date on which the Special Permit was granted unless substantial use or construction has commenced,they shall lapse and may be re-established only after notice,and a new hearing.
