HomeMy WebLinkAboutMiscellaneous - 37 COLUMBIA ROAD r `07F ()YCE BRADSHAW f AORTN TOWN CLERK FORTH ANDOVER O DW • z � � C" TOWN OF NORTH ANDOVER MASSACHUSETTS BOARD OF APPEALS Any appeal shall be filed within(20)days after the NOTICE OF DECISION date of filing of this Notice in the Office of the Town Clerk NAME:Donna Whipple DATE: 1/25/99 ADDRESS:37 Columbia Road PETITION:028-98 North Andover,MA 01845 HEARINGS: 1/12/99 The Board of Appeals held a regular meeting on Tuesday evening,October 13, 1998,upon the application of Una Whipple,37 Columbia Road requesting a Variance from the requirements of the Zoning By-Law section , paragraph 7.1,7.2,7.3,of table 2.The relief requested is from lot area,all yard setbacks and street frontage.In accordance with the plan titled;Plan of Land prepared for Everett&Donna Whipple;dated June 15, 1998;dra by Appleton Land Surveying, The following members were present: William J.Sullivan, Walter F.Soule,Raymond Vivenzio,Scott Karpi ki, John Pallone,George Earley,Ellen McIntyre,Robert Ford, The hearing was advertised in the Lawrence Tribune on 7/28/98&8/4/99 and all abutters were notified by re ar mail.This application was continued to the final hearing on 1/12/99. Upon a motion made by William Sullivan, and seconded by Walter Soule,the Board voted to deny the appli is request for a variance and zoning relief as follows; 1. No evidence was presented to show that there were unique conditions affecting the lot that would w a variance such as soil conditions,shape or topography of the land. 2. The Board found that the request would cause undue congestion in the area by creating two substandard ots. 3. The Board found that parking and other vehicular impacts would be substantially detrimental to the area and as such violate the purpose and intent of the zoning by-law. The motion passed as follows:The following members voted in favor of denial:Walter F.Soule,William J.St Ilivan, Ellen McIntyre,Robert Ford.One member voted against the motion to deny Scott Karpinski,.
