The North Andover Board of Appeals held a public hearing at its regular meeting on Tuesday,December 9,

The following members were present: John M.Pallone,Ellen P.McIntyre,Joseph D.LaGrasse,Joe E.
Smith,and Richard J.Byers. William J. Sullivan chaired but did not vote.
Upon a motion by Joe E. Smith and 2"d by Richard J.Byers,the Board voted to GRANT a Variance from
Section 7,Paragraph 7.3 and Table 2 of the Zoning Bylaw for relief of 12' from the north side setback for
the existing detached garage and 7.4'from the south side setback for the proposed addition per Plan of
Land in North Andover,Mass.,owned by Maureen Weir,date 11/5.2003 [by] Scott L.Giles,R-P.L.S.,
#13972, Scoot L. Giles,R.P.L.S.Frank S.Giles R.P.L.S.,50 Deer Meadow Road,North Andover,Mass.,

Upon a motion by John M.Pallone and 2nd by Ellen P.McIntyre,the Board voted to GRANT the Special
Permit from Section 9,Paragraph 9.2 of the Zoning Bylaw in order to construct a mudroom,enlarge an
existing 2nd floor bedroom and a covered landing on a pre-existing,non-conforming structure per Plan of
Land in North Andover,Mass.,owned by Maureen Weir,date 11/5.2003 [by] Scott L.Giles,R-P.L.S.,

intent and purpose of the Zoning Bylaw,and satisfied the provisions of Section 9,Paragraph 9.2 of

To Whom It May Concern,
RE: Request for Variance,
A. The particular use proposed for the land or structure.
We are requesting a variance for the set-back dimensional requirement for the purpose of constructing an
addition. The addition is to be used as a mud room on the first floor with a bedroom on the second floor to
be enlarged.
B. The circumstances relating to soil conditions,shape,or topography of such land or structures
especially affecting the property for which the variance is sought which do not affect generally
the zoning district in which the property is located.
Our home was built on a small parcel of land prior to the current zoning limitations. We have a narrow lot
and,as such,have been classified legal non-conforming. The rear of our house meets the setbacks for the
R-4 District and it is in this direction that most of our proposed addition would be built.
C. Facts which make up the substantial hardship,financial or otherwise,which results from literal
enforcement of the applicable zoning restrictions with respect to the land or building for which
the variance is sought.
With our growing family,we find ourselves short for space. We have very little closet space and
insufficient bedroom space for our 3 girls. Our family has owned this property for over 50 years and we
are well established in the neighborhood and,as such,do not desire to relocate our family. The small
addition proposed would greatly improve the livability of our home.
D. Facts relied upon to support a finding that relief sought will be desirable and without substantial
detriment to the public good.
Our street is composed primarily of small lots of 1-2 family dwellings. These lots were all small frontage
lots prior to the current zoning laws. Our proposed addition would be;as previously stated,at the rear of
our home continuing the roof lines,dormered design,and overall style of the existing house. From the
North,the addition would be unable to be viewed from the street. From the Southern exposure,the changes
would be visible through the back yard of our neighbor's house but would blend in with the existing side
profile. The improved rear elevation of our home(visible from I ighlandview Ave.)to the East would be
an esthetic benefit to the neighborhood.
E. Facts relied upon to support a finding that relief sought may be given without nullifying or
substantially derogating from the intent or purpose of the zoning bylaw.
It is our understanding,that the intent of the setback requirement is to provide sufficient distance between
dwellings in the zoning district. Our proposed addition will be 21'from the nearest structure to the North
and to the South there is currently no existing dwelling on the parol of land to the rear of our neighbor on
Highlandview Ave. Our proposed addition would not encroach on any other homes on either side of our
house.

RE: Request for Special Permit;
1. The particular use proposed for the land or structure.
We are requesting a variance for the set-lack dimensional requirement for the purpose of constructing an
addition. The addition is to be used as a mud room on the first floor with a bedroom on the second floor to
be enlarged.
2. The specific site is an appropriate location for such use,structure or condition.
The specific site for our proposed addition is to the rear of our home. We have a narrow non-conforming
pre-existing lot. We are in need of a mud room and closet space for our family. The primary entrance we
use is the rear entrance near our garage. As such,expanding back out the rear of our home(where we meet
all the necessary set-backs)is our plan. Above the mud room we would like to expand the existing small
bedroom to accommodate our 3 daughters.
3. There will be no nuisance or serious hazard to vehicles or pedestrians.
The proposed work will in no way effect vehicle or pedestrian traffic.
4. Adequate and appropriate facilities will be provided for the proper operation of the proposed
use.
The proposed changes to our home will require no additional utility services beyond those existing now.
5. The use is in harmony with the purpose and intent of the zoning by-law.
The proposed addition does not encroach on the other dwellings abutting our home. The architectural
designs were drawn to extend existing lines and style of the existing structure so as not to adversely effect
the neighborhood

Notice is hereby given that the Board of Appeals will hold a public hearing at the Senior
Center, 120R Main Street,North Andover,MA on Tuesday the 91h of December 2003 at
7:30 PM to all parties interested in the appeal of Maureen E. Weir,39 Brightwood
Street,North Andover, MA,requesting a Variance from Section 7, Paragraph 7.3 and
Table 2 for both side setbacks, and a Special Permit from Section 9, Paragraph 9.2 of the
Zoning Bylaw to enlarge a non-conforming,pre-existing structure on a non-conforming
lot in order to add a mud room and cover a porch on the 1'floor and enlarge a bedroom
on the 2nd floor.
The said premise affected is property with frontage on the East side of Brightwood Street
within the R-4 zoning district.
