The North Andover Board of Appeals held a public hearing at its regular meeting on Tuesday,June 8,2004
at 7:30 PM in the Senior Center, 120R Main Street,North Andover,Massachusetts upon the application of
Paula Porten,47 Brightwood Avenue,requesting a Variance from Section 7,Paragraph 7.3 and Table 2
of the Zoning Bylaw for a rear setback to the proposed addition;and a Special Permit from Section 9,
Paragraph 9.2 of the Zoning Bylaw for the extension of a pre-existing,non-conforming structure on a pre-
existing,non-conforming lot in order to allow for the addition of a bedroom and a family room.The said
premise affected is property with frontage on the North side of Brightwood Avenue within the R-4 zoning
district. The legal notices were published in the Eagle Tribune on March 29&April 5,2004.
The following members were present: John M.Pallone,Ellen P.McIntyre,Joseph D.LaGrasse,and
Richard D.Byers.
The following non-voting member was present: Walter F.Soule,Vice Chairman.
Upon a motion made by Joseph D.LaGrasse and 2nd by Richard J.Byers,the Board voted to GRANT the
applicant's letter requesting that the Variance and Special Permit petitions be WITHDRAWN WITHOUT
PREJUDICE. Voting in favor:John M.Pallone,Ellen P.McIntyre,Joseph D.LaGrasse and Richard J.

Notice is hereby given that the Board of Appeals will hold a public hearing at the Senior
Center, 120R Main Street,North Andover, MA on Tuesday the 13`'of April, 2004 at
7:30 PM to all parties interested in the appeal of Paula Porten, 47 Brightwood Avenue,
requesting a Variance from Section 7, Paragraph 7.3 and Table 2 of the Zoning Bylaw for
a rear setback to the proposed addition;and a Special Permit from Section 9, Paragraph
9.2 of the Zoning Bylaw for the extension of a pre-existing, non-conforming structure on

To Whom it May Concern:
RE: Special Permit Written Documentation:
1. The particular use proposed for the land or structure:
We are requesting a variance on the side and rear set back and lot dimensional
requirements to build a rear addition. The rooms will be used as a family room(ground
floor) and bedroom(2`d floor).
2. The specific site is an appropriate location for such use,structure or condition.
We are desirous of adding a two-story rear addition located at the east side of the
structure. The structure falls within the definition of pre-existing and non-conforming.
Our Iand is long and narrow and there would be issues constructing the rooms at any of
the other three sides of the structure. Construction on south side is impractical and
would extend onto our neighbor's lot. North side is impractical as our parking would be
interfered with and subject to some side setbacks.
3.There will be no nuisance or serious hazard to vehicles or pedestrians.
This addition is set back in the rear of the structure and site will be taken care of and
cleaned daily.
4.Adequate facilities will be provided for the proper operation of the proposed
used.
The structure shall not be extended by way of any sewer,water,paving or any other
public facilities and are not_proposed with this proposed lot and dwelling.
Utilities for the room are currently in place. There is no additional bathroom space to be
added as part of the new addition. There is no additional people using or living in the
house as a result. Therefore,there will no additional stress on sewer or water system.
5. The use is in harmony with the purpose and intent of the zoning by-laws.
It is our understanding that the intent of the side setback requirement is to provide
sufficient distance between dwellings in the zoning district. The relief we are seeking
(18.2,+10+4.6 feet)will not substantially denigrate or impose upon our neighbors,who
border us with their driveways. Further, given the underdeveloped land behind our house
that our neighbors possess,there is enough natural open space.
6. Specific reference and response to the criteria required by the particular special
permit for which this application is made.
The house was originally built to comply with zoning requirements. Since the time of
those side setback requirements have been increased, such that our rear falls within the
30feet setback, current structure north side is impractical because of parking and
driveway. Current structure is insufficient for current family needs, with 2 young girls,
the extra living space. The new rear addition would solve these issues.

A.The particular use proposed for the land or structure:
We are requesting a variance on the front right side B and rear setback dimensional
requirement for the purpose of constructing"an addition. The addition will be used for a
family room(I"floor)and a bedroom(2nd floor).
B. The circumstances relating to-conditions-affecting the property for which the
variance is sought which do not affect generally the zoning district in which the
property is located.
We are desirous of building an addition. Our,land is ling and narrow,with restrictions in
the narrow direction. The land to the north is used for our parking,the land to the west if
front entrance and porch and abuts our neighbor's land. The land south of our structure
abuts our neighbor's land and will not be affected. The land to the east is most suitable
for an addition,however it is close to the side and rear setbacks.
C. Facts,which make up for the substantial hardship,financial or otherwise,which
results from literal enforcement of the applicable,zoning restrictions...
The town requires 12,500 square feet for a lot in a R4 district. Lot and structure is pre-
existing,non-conforming.Zoning requires 100 feet of frontage. 45 feet exists for
frontage, and land modification requires meeting current zoning by-laws. It is not
possible to meet frontage and minimum lot area.
D. Facts relied upon to support a finding that relief sought will be desirable and
without substantial detriment to the public good
Our east side of structure is located in our rear yard. Structure is set back 30.4 feet. With
the proposed addition in rear of house,it would be 25.4 feet and would have no impact on
any family nor would it be derogatory to the integrity of the neighborhood.

nullifying or substantially derogating from the intent or purpose of the zoning
bylaws.
It is our understanding that the intent of side and rear setbacks is to provide sufficient
distance in the zoning district. In our case, sides will not extend past existing structure
and will have no affect,which is not there today. New addition to rear yard setback only
requires 4.6 feet and distance between next dwelling will still meet requirement intent ,
and not deter neighborhood.
