Legal notices were sent to all names on the abutter's list and were published in the Eagle-Tribune,a newspaper of general circulation in the Town of North Andover,on December 23,2006&January 1,2007. The following voting members were present: Ellen P.McIntyre,Albert P.Manzi,III,David R.Webster, Thomas D. Ippolito,and Richard M. Vaillancourt. Upon a motion by Richard M. The Board finds that Micro Ice Training Centers of America has satisfied the provisions of Section 4, Paragraph 4.132.9 and Section 10,Paragraph 10.31 of the zoning bylaw and that the Board may grant a Special Permit for a private,for profit hockey school at 65 Flagship Drive in the Industrial 1(I-1)zoning district. The Board finds that 65 Flagship Drive is an appropriate location for a private,for profit hockey school and that this use may be allowed by Special Permit in the 1-1 zoning district. This use of the middle unit at 65 Flagship Drive,as developed,will not adversely affect the neighborhood since the lot and structure conform to the 1-1 requirements,interior renovation only is required,and that there was no written or spoken opposition. The Board finds that there will be no nuisance or serious hazard to vehicles or pedestrians since 65 Flagship Drive has existing sidewalks,driveway,lighting,and 100-6pace parking lot. This unit's previous occupant,Yang's Fitness Center,was allocated 40 parking spaces;Micro Ice Training Centers of America will require 36 spaces per the Zoning Bylaw's Section 8.1 (Off-Street Parking),which states"I space per 4 persons for Auditoriums,theaters....and other places of assembly". The Board finds that adequate and appropriate facilities will be provided for the proper operation of the private,for profit hockey school and that the existing lot and building have municipal water and sewer,power and telephone utilities in place;that this ice system will use approximately 15 gallons of water. The Board finds that Micro Ice Training Centers of America's written documentation states,"The space is currently sprinkled and has an updated fire alarm system....anything not meeting current code will be brought up to code.... We as the new tenants,will be installing a dehumidification system in the area of the ice surface as needed.... The average standard ice rink surface is anywhere from 17,000 to 20,000 square feet in area. Our surface is more than eight times smaller than that" The Board finds that a private,for profit hockey school is in harmony with the general purpose and intent of Section 4,Paragraph 132.9 of the Zoning Bylaw and that this use at 65 Flagship Drive shall not be substantially more detrimental than the previous tenant to the neighborhood. The facility will provide tenancy for a currently vacant portion of 65 Flagship Drive while providing employment for approximately 4 people and increasing Town tax revenues. Note: 1.This decision shall not be in effect until a copy of this decision is recorded at the Essex County Registry of Deeds,Northern District at the applicant's expense. 2.The granting of the Variance and/or Special Permit as requested by the applicant does not necessarily ensure the granting of a building permit as the applicant must abide by all applicable local,state,and federal building codes and regulations,prior to the issuance of a building permit as required by the Inspector of Buildings. Furthermore,if the rights authorized by the Variance are not exercised within one(1)year of the date of the grant,it shall lapse,and may be re-established only after notice,and a new hearing. Furthermore,if a Special Permit granted under the provisions contained herein shall be deemed to have lapsed after a two(2) year period from the date on which the Special Permit was granted unless substantial use or construction has commenced,it shall lapse and may be re-established only after notice,and a new hearing. The particular use proposed for the land or structure: We consider ourselves to be a"Private School for Profit", specializing in teaching and training of ice skating on a real frozen ice surface. Because the zoning bylaw does not have an exact definition of a"Private School for Profit", the building department felt that the best fit was to classify us as a"Indoor Ice Skating Facility",thus requiring a Special Permit in this zone listed as Industrial—I. We will use this facility for specialized teaching and training of ice skating and the normal skills associated with the sport of ice skating. 2. The specific site is an appropriate location for such use,structure or condition. We feel that this site and our leased space are appropriate for our described use. This is also confirmed by the previous tenant of the space, Yang's Fitness Center,which operated in this same space for the past five years until they out grew the space and needed to relocate to a larger facility. Yang's use and our use are exactly the same in that we both specialize in teaching and training,with the difference being their business is Martial Arts,which requires carpeting and hardwood floors and ours is ice skating, which requires a frozen ice surface. Our density use will be much,much less than Yang's was, or for that matter, any other fitness use in the fact that Yang's space was set up with three large training rooms and a small area to support the training rooms. The actual space is 6,000 square feet and the ice surface is less than 2,000 square feet, so in the fact that most of our training is 2 to 4 skaters to a trainer, our use will be significantly less than the previous tenant. Based on my findings, Yang's operated out of this building very successfully allowing them to grow into a 12,000 square foot facility. 2 Micro Ice—Documentation—Continued-Page 2. 3. There will be no nuisance or serious hazard to vehicles or pedestrians. There will be absolutely no nuisance or any hazard to vehicles or any pedestrians based on our use of this site. Our actual use will be much less than what could be allowed in that,based on 6,000 square feet of area, thirty six parking spaces are required to support this space. We have provided at least thirty six parking spaces, satisfying the requirement,but on average,we will be only utilizing approximately four to eight parking spaces,thus from a traffic standpoint, much less than what the site was designed for. The building does have the necessary handicap assessable ramp to gain entrance to our space. 4. Adequate facilities will be provided for the proper operation of the proposed use. The building footprint and the existing site will not be altered in any way and we have shown that all necessary parking requirements have been met. In addition,we have shown that there is proper handicap accessibility to our space. The interior space now has one women's and one men's handicap bathroom. Based on our use of this space, these facilities meet the plumbing requirements to support our use. These handicap bathrooms will remain as is. The previous tenant had completed significant improvements to both the HVAC system and the electrical which will be reused by us. The space is currently sprinkled and has an updated fire alarm system which was also installed by the previous tenant. These systems should still be up to code,but anything not meeting current code will be brought up to code per the building and fire departments requirements. We as the new tenants,will be installing a dehumidification system in the area of the ice surface as needed. The two changing rooms will have the proper ventilation installed. The use is in harmony with the purpose and intent of the zoning by-law. We feel our use is in every way in harmony with the intent of the zoning by-law. As I stated above in number one, we have been characterized as an indoor ice skating facility. When one thinks of an indoor ice skating facility, one may think of the Merrimack College Ice Rink, or the Brooks School Ice Rink,where high school and college games are played attracting large crowds and a significant amount of traffic. The average standard ice rink surface is anywhere from 17,000 to 20,000 square feet in area. Our surface is more than eight times smaller than that. Based on that, needing a Special Permit to operate a standard, so called, indoor ice skating facility makes sense because it would impact the public zone in which the rink was located. We do not feel that the zoning bylaw was created to address an operation such as ours, for the simple reason that there are many more uses for this property which are"Allowed by Right", and which are much more intense than our proposed use.
