The Board of Appeals held a regular meeting on Tuesday evening April 11, 1995 upon the
application of Neil and Lisa Rosenburg requesting a variation of Section 7, Paragraph 7.3,
Table 2 of the Zoning Bylaw so as to permit relief of 7 feet from the required 20 foot side
setback in order to construct a cabana on the premises located at 70 Court Street. The
following members were present and voting: Walter Soule, Acting Chairman, Raymond
Vivenzio, Clerk, John Pallone, and Joseph Faris.
The hearing was advertised in the North Andover Citizen on March 22 & 29, 1995 and all
abutters were notified by regular mail.
Upon a motion by John Pallone and seconded by Joe Faris, the Board unanimously voted
to GRANT the variance so as to permit relief of 7 feet from the side setback requirement
of 20 feet.
The Board finds that the petitioner has satisfied the provisions of Section 10, Paragraph
10.4 of the Zoning Bylaw and that the granting of these variances will not adversely affect
the neighborhood or derogate from the intent and purpose of the Zoning Bylaw.

The Board of Appeals held a regular meeting on Tuesday. November
10, 1992 at 7 :45 p.m. in the Library Conference Room at Town
Hall. The following members were present and voting: William
Sullivan, Vice-chairman, Raymond Vivenzio, John Pallone, and
Walter Soule arrived at 8:15.

Because there wasn't a quorum present, this hearing had to be
CONTINUED to December 8, 1992.
PUBLIC HEARINGS
Rita Gonsalves Variance Great Pond Road
Mr. Soule did not sit-in on this hearing. The Legal Notice was
read by Mr. Vivenzio'. Thomas Neve, Civil and Environmental
Engineer, represented the applicants requesting a variance to
construct a single family home within 100' of the high water mark
of Lake Cochichewick.
Ms. Gonsalves and Mr. Matthews will join their lots creating one
two acre lot. The plan shows that the house will be built 90'
from Lake Cochichewick. The house will be placed so that the
wetlands at the rear of the property will not be disturbed.
Planning to install three new sewer manholes to handle the
dwelling. Bob Nicetta questioned if Mr. Neve needed a Special
Permit from the Planning Board. Mr. Neve said he was to be heard
by the Planning Board who was meeting across the hall at 8: 00
p.m. Mr. Vivenzio asked what evidence he had as to hardship.
Mr. Neve stated this was a buildable lot before the watershed
moratorium. Because of the shape, size, topo and wetlands this
property is unbuildable where it was buildable prior to the bylaw
being adopted. A lengthy discussion as to where the house could
be placed on the lot ensued.
No correspondence or anyone present in opposition to this
request.
Mr. Neve stated if anyone has a legal question that * the Board
continue the public hearing to allow him to ask Ms. Gonsalves and
Mr. Matthews to contact .a lawyer to address these issues. This
was agreeable to the Board. Mr. Vivenzio also suggested the plan
show where the houses are located to both right and left of the
above mentioned lot. Mr. Sullivan also asked that Mr. Neve show
where the wetlands appear going up Great Pond Road toward Rea's
Pond. Mr. Vivenzio also suggested that Mr. Neve submit am
amended application with Mr. Matthews name added to the
application and the description should be changed to show that
Mr. Matthews lot is also involved. The information gathered from

the lawyer should include legal evidence showing where the
hardship is.
Motion by Mr. Vivenzio and seconded by Mr. Pallone to Continue
the Public Hearing to December 8, 1992. Vote was unanimous.
Mr. Neve was told that any correspondence from an attorney should
be submitted to the office before Friday, December 4, 1992.
Elm Service Corp Variance Chestnut Street_
The Legal Notice was read by Mr. Soule, Clerk. Mr. John Nolan
represented Elm Service Corp requesting a variance from the
Phased Development Bylaw for a 42 lot sub-division.
Mr. Vivenzio asked if any of the lots are under agreement. Mr.
Nolan stated none are under agreement. Mr. Vivenzio stated that
the only time that this would be granted is if at least half of
the houses were under agreement. Mr. Nolan stated that the
contract he holds with the builder states that he will have to
have twenty houses sold within the first year. Mr. Sullivan
asked Mr. Nolan if he wanted a variance for all 42 lots. Mr.
Nolan stated he has a contract to sell 20 lots per year. He
stated he wanted to be able to build according to how fast these
houses sell. Mr. Sullivan suggested that this request is a
little premature. He suggEsted that Mr. Nolan wait until the
model home is built, see how the houses are going to sell and
then if he has to he can come back to the Board. Mr. Sullivan
said he would like to suggest at this stage that Mr. Nolan
Withdraw Without Prejudice and, if needed, come back to the
Board. Mr. Nolan stated that he wanted to WITHDRAW WITHOUT
PREJUDICE. Motion by Mr. Vivenzio and seconded by Mr. Pallone to
WITHDRAW WITHOUT PREJUDICE. Vote was unanimous.
The meeting was adjourned at 9: 00 p.m.
