The North Andover Board of Appeals held a public hearing at its regular meeting in the Senior Center,

37.A,Parcel 26),North Andover requesting a Special Permit from Section 4,Paragraph 4.121.17 of the
Zoning Bylaw for a Family Suite. Said premise affected is property with frontage on the West side of
Coachman's Lane within the R-1 zoning district. Legal notices were sent to all names on the abutter's list
and were published in the Eagle-Tn'lwne,a aper of general circulation in the Town of North
Andover,on March 27&April 3,2006.
The following voting members were present: Ellen P.McIntyre,Joseph D.LaGrasse,Richard J.Byers,
Albert P.Manzi,III,and David R.Webster.
The fallowing non-voting members were present: Thomas D.Ippolito,Richard M.Vaillancon't,and
Daniel S.Braese.
Upon a motion by Richard J.Byers and 2"d by David R.Webster the Board voted to GRANT a Special
Permit from Section 4,Paragraph 4.121.17 of the Zoning Bylaw for a Family Suite per:

With the following conditions:
1. The Family Suite shall not be occupied by anyone except Mr.&Mrs.Paul Roonopane,
parents of Michael Buonopane,a residing owner of the dwelling unit;
2. The Special Permit shall expire at the time that Mr.&Mrs.Paul Buonopane ceases to
occupy the family mate;
3. The Special Permit shall expire at the time the premises are conveyed to any person,
partnership,trus,corporation or other entity;
4. The applicant by acceptance of the Certificate of Occupancy issued pursuant to the Special
Permit,grants the Building Inspector,or his lawful designee,the right to inspect the
premises annually.
Voting in favor: Ellen P.McIntyre,Joseph D.I.aGrasse,Richard L Byers,Albert P.Manzi,K and David
R-Webster.
The Board finds that the applicant has satisfied the provisions of Section 4,Paragraph 4.121.17 of the
zoning bylaw in that the family suite shall be within 99 Coachman's Lane,less than 251/6 of the existing
single-family dwelling,and less than 1,200 sq.ft.,per"Project:Buonopane Residence"title box. The
Board finds that 99 Coachman's Lane is an appropriate location for a family suite since no Variance relief
is required. The Board finds that the family suite,as developed,will not adversely affect the neighborhood
and that there was no written or spoken opposition. The Board finds that there will be no nuisance or
serious hazard to vehicles or pedestrians;that the"Project:Bwnopane Residence Existing Basement"
shows a 3-car garage and Plan of Land shows off-street parking for the 4 vehicle. Adequate and
appropriate facilities will be provided for the proper operation of the proposed use;Paul Buonopane stated
in his application that utilities,water and septic are included in the present design. The Board finds that the
family suite is in harmony with the general purpose and intent of this Bylaw and that this change,extension
or alteration shall not be substantially more detrimental than the existing mature to the nmghborhood.
Note: The granting of the Variance and/or Special Permit as requested by the applicant does not
necessarily ensure the granting of a building permit as the applicant must abide by all applicable local,
state,and federal building codes and regulations,prior to the issuance of a building permit as required by
the Building Commissioner.
Furthermore,if the rights authorized by the Variance are not exercised within one(1)year of the date of
the grant,it shall lapse,and may be re-establisbed only after notice,and a new hearing. Furthermore,if a
Special Permit granted under the provisions contained herein shall be deemed to have lapsed after a two(2)
year period from the date on which the Special Permit was granted unless substantial use or Construction
has commences,it shall lapse and may be re-established only after notice,and a new haring.

Re: Special Permit Written Documentation
To Whom It May Concern,
1. The specific site is an appropriate location for such use,structure or
condition.
We are desirous of building an addition to our existing single family dwelling in an R-1
zoning district. This lot does not require any variances. This addition would be in the
back side of the house which is the west side of our lot. It would be away from the street
frontage and would not alter the character of our home or the neighborhood in any way.
The purpose for this addition is to add a family suite to our home for use only by our
parents.
2. There will be no nuisance or serious hazard to vehicles or pedestrians.
The proposed addition would be set back from the road by a minimum of 180 feet. The
addition would be far away from vehicles and pedestrians. Proper care and clean up of
the site will take place daily.
3. Adequate facilities will be provided for the proper operation of the proposed
use.
Our lot already has all the necessary amenities such as town water hook-up,town sewer,
electricity, etc. There will be no additional utilities needed for this addition. The existing
home already has a three car garage as well as an ample parking space in addition to a
long driveway to accommodate guests. The current facilities are adequate to handle the
current single family dwelling,in addition to the family suite.
4. The use is in harmony with the purpose and intent of the-zoning by-law.
The purpose of this addition will be solely for use as a dwelling for aging family
members. The appearance of the home from the street front will not be altered. The lot
is just slightly larger than two acres and provides an abundance of natural woods and
open space. Even with this proposed addition,the house would sit nestled on a large lot
surrounded by trees and wildlife on all sides.
5. Specific reference to 4.121.17 and 2.37.1
This proposed addition is strictly for use as a family suite by paternal parents/in-laws.
As mentioned in 2.37.1,the appearance of the building as a single-family dwelling will
not be altered in any way. The separate dwelling area will have its own entrance from the
outside and the garage, yet it will flow from the main house to be aesthetically pleasing.

To Whom It May Concern,
1. The specific site is an appropriate location for such use,structure or
condition.
We are desirous of building an addition to our existing single family dwelling in an R-1
zoning district. This lot does not require any variances. This addition would be in the
back side of the house which is the west side of our lot, It would be away from the street
frontage and would not alter the character of our home or the neighborhood in any way.
The purpose for this addition is to add a family suite to our home for use only by our
parents.
2. There will be no nuisance or serious hazard to vehicles or pedestrians.
The proposed addition would be set back from the road by a minimum of 180 feet. The
addition would be far away from vehicles and pedestrians. Proper care and clean up of
the site will take place daily.
3. Adequate facilities will be provided for the proper operation of the proposed
use.
Our lot already has all the necessary amenities such as town water hook-up,town sewer,
electricity,etc. There will be no additional utilities needed for this addition. The existing
home already has a three car garage as well as an ample parking space in addition to a
long driveway to accommodate guests. The current facilities are adequate to handle the
current single family dwelling, in addition to the family suite.

outside and the garage, yet it will flow from the main house to be aesthetically pleasing.
