The North Andover Board of Appeals held a public hearing at its regular meeting on Tuesday,July 12,2005
at 7:30 PM in the Town Hall top floor meeting room, 120 Main Street,North Andover,Massachusetts upon
the application of Richard S.Else, 160 Commandant's Way#406,Chelsea,MA for premises at:85 Main
Street,North Andover,MA requesting a Special Permit from Section 9,Paragraph 9.2 of the Zoning Bylaw
in order to extend a pre-existing,non-conforming structure on a pre-existing,non-conforming lot. Said
premises affected is property with frontage on the Southeast side of Main Street within the B-4 zoning
district. The legal notices were published in the Eagle Tribune on September 27&October 4,2004 and all
abutters were notified by mail.
The following voting members were present: Ellen P.McIntyre,Richard J.Byers,Thomas D.Ippoiito,and
Richard M.Vaillancourt.
The following non-voting member was present: Joseph D.LaGrasse.
Upon a motion by Richard J.Byers and 2d by Richard M.Vaillancourt,the Board voted to DENY the
Special Permit to extend a pre-existing,non-conforming structure on a non-conforming lot. The Board finds
that the applicant's plan is not able to provide sufficient driveway width as required by 8.1.7(Off-Street
Parking)of the North Andover Zoning Bylaw for emergency vehicles to respond to the proposed handicap-
accessible third story dwelling unit. Voting in favor of the denial: Ellen P.McIntyre,Richard J.Byers,and
Thomas D.Ippolito. Voting in favor of the Special Permit: Richard M.Vaillancourt.

RE: Special Permit Written Documentation;
1. The particular use proposed for the land or structure:
I wish to add a third floor handicap access apartment I wish to ask a variance on the side
lot set back to accommodate a shed building that will provide space for heating,hot water
and machinery systems to serve the new apartment. I wish to construct a stairwell and
elevator shaft to service the new apartment.
2.The specific site is an appropriate location for such use,structure or condition.
After much consultation with the Architect it was obvious that the locations selected for
the shaft and shed are the only place where they fit in.
3. There will be no nuisance or serious hazard to vehicles or predestines.
Most of the construction will be up the drive and to the back. Any activity near the front
will be carefully screened from the sidewalk.
4. Adequate facilities will be provided for the proper operation of the proposed used.
The new apartment will have its own heat,hot water and mechanical systems.
5.The use is in harmony with the purpose and intent of the zoning by-law.
In the old central business district the buildings are very close together and most are
three stories. This update to 85 Main St. will be attractive and allow this Iocation to
blend in with the neighbor hood.. In regard to the side set back I only need a five foot
extension to the sixty feet or so of the pre existing building on the lot line. This should
not impose on our neighbor.
6. Speck reference and response to the criteria required by the particular
special permit for which this application is made.
I currently have a serious problem with water damage to the interior from leaks through
the flat built up roof. These leaks have been repaired many times but in too short a time
the leaks start again. On the fiont portion of the building there is a very old very steep
shingle roof. This roof also leaks and damage is spreading below. It is my hope to get a
new roof in place before the wet snow and rains of winter. Both of the steps and porch
entrance do not meet code requirements. My plan will remove the old and replace with
an improved design.
