North Andover, MA 01845 SUBJECT: Variance Application A. My particular Variance request for the proposed use of the stucture is an addition and a deck to enjoy the summer in the backyard. B. The particular circumstances of my lot relating to soil condition are not interfering or changing in anyway with any other abutting property. The particular circumstance of my lot relating to shape is that my loyis irregular shaped in the back making the proposed addition and deck 11.5 ft less than 30 foot rear setback. To construct the proposed addition to the right of the garage prevents continuity of habitable space The particular circumstance of my lot relating to tonography is not changing because the proposed structure will be built lower than the current existing property. C. It is my contention that the hardship exist due to the restriced size and shape of the lot which greatly affects the use of the premise, but not R-2 zoning district in which it is located, and a literal enforcement of the bylaws would result in a substantial hardship to us. If a literal enforcement of the bylaw is required,the resulting shape of the addition wiil be trapezoidal and effectively unuseable. The only other legally buildable space available on the lot is on the right side of the garage which would be cost prohibitive to modify into a usable space. D. The proposed structure will be in the back of the existing property which does not affect any view from the front.Also, in the back is the Harold Parker Forest so it won't substantial detriment to the public good. E. Approval of the proposed addition to the current existing house is desireable as it could not be located on the opposite side of the garage due to obvious reasons I F. I am seeking setback relief from the literal enforcement of by the law to allow less than the required 30 foot distance from the rear property line. The proposed addition and deck will be approximately 21 feet and 18.5 feet respectively from the rear property line as shown on the attached plot plan. It is my contention that the hardship exist due to the restricted size and shape of the lot which greatly affects the use of the premise,but not the R-2 zoning district in which it is located, and a literal enforcement of the bylaws would result in a substantial hardship to us. If a literal enforcement of the bylaw is required,the resulting shape of the addition will be trapezoidal and effectively unusable.
