side of Willow Street within the I-1 zoning district. Legal notices were sent to all names on the abutter's lists deemed
by the Assessor's Office of North Andover to be affected,and were published in the Eagle-Tribune,a newspaper of
general circulation in the Town of North Andover,on December 26,2005&January 2,2006.
The following voting members were present: Ellen P.McIntyre,Richard J.Byers,Albert P.Manzi,III,Thomas A
Ippolito,and Richard M.Vaillancourt. The following non-voting member was present: Daniel S.Braese.
Upon a motion by Richard J.Byers and 2'd by Richard M. Vaillancourt,the Board voted to GRANT a Special Permit

The Board finds that the applicant has satisfied the provisions of Section 9,Paragraph 9.1 of the zoning bylaw and that
granting a Special Permit from 4.132.16 of the Zoning Bylaw for a Day Care Center at 140 Willow Street will not
adversely affect the neighborhood nor will this use be a nuisance or serious hazard to vehicles or pedestrians. The Board
finds that 140 Willow Street is an appropriate location for a Day Care Center. The Board finds that adequate and
appropriate facilities are required for the proper operation of Day Care Centers by the Commonwealth of Massachusetts.
The Board finds that this use is in harmony with the general purpose and intent of 4.132.16 and that this change,
extension or alteration shall not be substantially more detrimental than the existing structure to the neighborhood.
Note: The granting of the Variance and/or Special Permit as requested by the applicant does not necessarily ensure the
granting of a building permit as the applicant must abide by all applicable local,state,and federal building codes and
regulations,prior to the issuance of a building permit as required by the Building Commissioner.
Furthermore,if the rights authorized by the Variance are not exercised within one(1)year of the date of the grant,it
shall lapse,and may be re-established only after notice,and a new hearing. Furthermore,if a Special Permit granted
under the provisions contained herein shall be deemed to have lapsed after a two(2)year period from the date on which
the Special Permit was granted unless substantial use or construction has commenced,it shall lapse and may be re-
established only after notice,and a new hearing.

Brief.History
Out Country Preschool, Inc. was formed in September 1984, in North Andover, MA.
During the last 22 years it has developed and evolved into one of the premier schools in
this community. It has a longstanding reputation of preparing young children for
kindergarten in a loving, caring environment We teach two classes per day, and have

since its inception. In addition we have at times provided a summer school program. We
hold all of the necessary state certifications to run Out Country and are nationally
accredited by the National Association for the Education of Young Children, (NAEYC).
Operations
Out Country Preschool is widely recognized in the community and enjoys an outstanding
reputation. We have taught in excess of 1000 children. We operate by `word of mouth'
and are able to consistently fill our classes.Classes begin promptly at 8:30 in the morning
and 12:00 in the afternoon, each lasting three hours. This range of hours minimizes any
concentration of families at the center at one time.
Out Country Preschool has always been an active member of the community. This
involvement includes local community partnerships, providing workshops and education
for our parents, open houses and field trips. We specialize in hands-on involvement of
teachers and parents to educate and develop our students for confident learning, social
skills and emotional security to maximize their elementary school experience.
Owners
Georgina Mitchell is the founder and sole owner of Out Country Preschool,Inc. Georgie,
her husband Craig and their family have lived in North Andover since 1983. They raised
and educated their four children in the public schools. This relocation of the preschool
provides a new and more centrally located site for their students. The new location, a
little over a mile away is the ideal facility that meets our needs and those of our students
and parents.

Please be advised that I have discussed the relocation of Out Country Preschool,
Inc. to 140 Willow Street,North Andover with the Director,Georgie Mitchell.We have
specifically addressed traffic impact. I am very familiar with the existing traffic patterns
in the area.
It is my opinion that there will be no nuisance or serious hazard to vehicles or
pedestrians as a result of this relocation. No hazard exists now and none will be created.

Dear Ms. Mitchell:
This letter has been prepared to officially give authorization to install a fence within the limits of
existing lawn,in order to enclose a play area for the above-referenced preschool. As discussed with
you last week,the fence must be placed outside of the regulated 25' No Disturbance Zone associated
with the adjacent wetland resource area.Structures and maintenance of any kind within this area is
strictly prohibited. Enclosed please find a copy of the as-built plan for the building,dated July 11,
2001 for further information. Based on this information,the 25' No Disturbance is concurrent with
the edge of existing lawn and tree line. If you still are not sure as to where this 25'No-Disturbance
line extends,the Conservation Department would be more than happy to identify this area in the
field for you. However, due to the amount of current snow cover,an inspection would have to be
done in the spring or when the weather conditions are more conducive.
Please be aware that as a result of the location of the adjacent wetland resource area and the 100-year
floodplain,the majority of the property falls under the jurisdiction of the North Andover
Conservation Commission(NACC),in accordance with the MA Wetlands Protection Act, (M.G.L.
c.131, §40) and the Town of North Andover Wetlands Protection Bylaw, (Chapter 178 of the Town
General Laws). As such, any exterior work(e.g.,clearing,grading,excavation etc.)must be filed with
the NACC for review and subsequent approval.

regard.
